The Board of Aldermen of the City of Elsberry met on the evening of the above date at Elsberry City Hall, 6:30 pm. Mayor Steve Wilch presided over the meeting. Present were Alderman Harper, Alderman Davis, Alderman Short, Alderman Hartley, Alderman Rockwell, City Attorney Rob Guinness, City Clerk Sue Hogarth and City Treasurer Tammy Sharpe. Also present were Brian Hemmer & Ron Smith of Alliance Water Resources.

Mayor Wilch called the meeting to order and led in the pledge to the flag.

Roll call deemed a quorum present.

AMENDMENT TO THE AGENDA

Mayor Wilch asked to make an amendment to the agenda to switch agenda item #10 with agenda item #8 to include the resignation of Chief Brian Jeffries with the resignation of Terry Martin from Planning & Zoning. A motion was made by Alderman Hartley to amend the agenda, seconded by Alderman Harper.

PRESENTATION OF CERTIFIED ELECTION RESULTS FROM LINCOLN COUNTY - City Clerk Sue Hogarth

City Clerk Sue Hogarth received the official election results from Lincoln County on Tuesday morning April 9, 2019. Brent Rockwell was elected from Ward 3, Michael Short from Ward 2 and the elected write-in candidate for Ward 1 is Rita Robinson. The Prop A for 911 Dispatch did pass county-wide.

SWEARING IN OF NEW CITY OFFICIALS / OATH OF OFFICE - City Clerk Sue Hogarth

City Clerk Sue Hogarth asked Brent Rockwell, Michael Short and Rita Robinson to stand before the board of aldermen and they took the oath of office and were sworn in. City Clerk Sue Hogarth had each alderman sign their Oath of Office.

A resignation letter was submitted from Terry Martin from the Planning & Zoning Committee. A motion was made by Alderman Short to accept the resignation, seconded by Alderman Hartley.

Police Chief: No appointment Alderman Rockwell and Alderman Hartley asked about interviewing for the police chief position and if it needed approval by the Emergency Services committee or full board. The Emergency Services Committee will review applications / resumes and the full board will conduct the interviews based on the committee's recommendations. The qualifications for the Police Chief position were submitted to the aldermen via email from City Attorney Guinness. Alderman Rockwell asked what were the best choices to post the position and the State Highway Patrol, city website, Missouri Police Chief Association and Indeed were recommended. Alderman Hartley asked if there should be a board set up with various members to help hire for the police chief position. It was discussed that the ultimate decision is made by the board and appointed by the mayor. City Clerk Sue Hogarth will post the job description and invite applicants to submit their resume or complete a job application. Salary will be based on experience.

PROJECT UPDATES

Boonslick Regional Planning Commission Update – Mayor Wilch Chad Eggen from Boonslick was unable to attend but Mayor Wilch stated that Chad Eggen was still waiting on MECO Engineering to get the amendment out so they can get finalization on the grant.

Update from MECO Engineering – Jim Bensman with MECO Engineering

Jim with MECO Engineering was unable to attend due to a family situation but sent an email to City Clerk Sue Hogarth and Mayor Wilch with his update. Marshall Suddarth and Brian Hemmer with Alliance met with MECO last week and he will provide minutes from the meeting when they are complete.

They discussed both screen and laboratory building redesign using precast concrete structure and not stick built per their previous request. The cost for each building delivered and installed onsite will be $69,000 plus 10% general contractor mark-up which will bring the total cost to $79,900 each. It was requested to have the screen building heated so MECO will have to make it explosion proof because of gas vapors when building vents will be closed during winter months. The lab building will need to be insulated and add (10) additional feet of lab countertop and will provide an emergency shower. They will remove heat trace from sludge loading station riser pipes and install heater inside the insulated enclosure. Eliminate gravel surfacing on lagoon berms that will remain. They requested cost information to consider using non-immersed U/V lamp assembly instead of immersed lamps. Move MCC from inside of screen building to outside. Install mud valves inside all basins and piped to lift station and discharge to storm water retention basin. Alliance is preparing data point list needed to complete SCADA design. They are looking to go out for bids in July.

Mayor Wilch stated that there was no reply yet from MECO on the amendment.

A motion was made by Alderman Rockwell to move the Girl Scout Troop presentation later in this section since they are still waiting on a few girls to arrive, seconded by Alderman Hartley.

- Variance Approval for Robert Mills to build a 18' x 31' 2-car garage as a separate unattached building at his empty lot located at 305 S. 6th St. adjacent to his home at 307 S. 6th St. - City Clerk Sue Hogarth

The Board of Adjustment met on Monday April 1, 2019 and approved a variance for Robert Mills to build a 2-car garage on his empty lot located at 305 S. 6th St. adjacent to his home at 307 S. 6th St. No one from the board had any objections to the Board of Adjustment recommendation which was passed with a quorum of 4 votes.

- Request for Cristopher Presswood at 810 Lincoln Street to discuss water bill / inaccurate meter reading issue from Dec 2017-Jan 2018 - Cristopher Presswood

Alderman Short spoke with Mr. Presswood prior to the meeting since he was unable to attend. Mr. Presswood had a faulty water meter from Dec 2017-Jan 2018 that was giving an inaccurate meter reading and he received a high bill. City Collector Katie Harper said it would be fixed and the meter/bill has still not been fixed for over a year now. The aldermen were given a report of Mr. Presswood's water usage over the past year. His meter showed usage in November 2017 and April 2018 plus (2) months of no usage and no payment was made in September 2018. There is a balance forward each month but we need to figure out the amount and track the meter usage. The meter did show an interment leak per Brian Hemmer with Alliance but he can only go back 90 days for meter reads.

A motion was made by Alderman Short to table this until an accurate amount can be determined and presented at the May board meeting, seconded by Alderman Rockwell.

- Presentation by Girl Scout Troop #2877 to build a gaga ball pit at the City Park to earn their Girl Scout Silver Award - Troop Leader Aubrey Tapley and Girl Scout Troop #2877

Local Girl Scout Troop #2877 gave a presentation to the Board of Aldermen to build a gaga ball pit between the playground and basketball court at the City Park. The presentation is attached to these meeting minutes for review. The girls will build the gaga ball pit with wood for an estimated cost of $451.91 which will be paid for from fundraising and cookie sales so there will be no funding needed from the city other than maintenance. It can be built over one day on a weekend and assembled on site which they would like to do in June after school is out for summer break. Alderman Short had insurance questions about liability and if it will increase our premiums for the park and he also asked if there was any electrical issues at the park that would affect the placement of the ball pit at the park. Brian Hemmer with Alliance will check on this and report back. The board thanked the Girl Scout Troop #2877 for their presentation. A motion was made by Alderman Short to table the request / vote until the May board meeting to check on some of these issues and to confirm placement of the ball pit at the park, seconded by Alderman Robinson.

- Request from Jesse Simmons at 305 S. 5th Street to have his water turned on after making his first payment agreement of $264.01 prior to this board meeting - Jesse Simmons

Jesse Simmons is requesting that his water be turned on since he made his first payment of $264.01 on April 3, 2019. He has not received a bill yet due to the billing cycle but he made an agreement with previous City Collector Katie Harper to make his payment on the 3rd day of each month. Alderman Short asked about the breakdown of his payment agreement and if the $900 tap fee and $85 disconnect fee was included. Alderman Robinson clarified the payment agreement with Mr. Simmons and Alderman Hartley stated that the contract payment agreement for Mr. Simmons will be amended to start today. It was estimated that his next payment will be about $400 on his next bill ($367.39 plus readings for Monday).

A motion was made by Alderman Hartley to turn on his water and to amend the payment agreement with his next payment due on May 3, 2019, seconded by Alderman Rockwell. AYES - Alderman Rockwell, Alderman Robinson, Alderman Harper, Alderman Hartley, Alderman Davis NAYS - Alderman Short Motion Carried

- Presentation of Northwest Cooperative Police Program - Chief Barnes of Silex / Officer Airianna Brewer

Officer Barnes and his staff of 5-6 officers attended the board meeting and gave a powerpoint presentation on the Northwest Cooperative Police Program. They would like to have the City of Elsberry join forces with their cooperative to work as a team, become more community-oriented and get involved in Community Partnership Programs. The powerpoint presentation is attached to these meeting minutes for review. After the presentation, City Attorney Guinness asked about the existing contract which includes the City of Foley and the City of Silex. Officer Barnes explained that the cooperative is operated from its home base in the City of Silex. The cost for Elsberry to join the cooperative would be $293,500 (savings of $120,000) but that would include 24 hour police coverage with (2) officers per night and (1) back-up officer and they would provide the equipment and vehicles. They currently have (5) vehicles, (1) canine with (1) in training and (5) vehicles. They suggested moving municipal court from county to Elsberry with each city in the cooperative to retain its own court costs. A police board would be set up with (2) citizens from each agency. The board thanked the Northwest Cooperative for the presentation. No action was taken by the board at this time.

UNFINISHED BUSINESS

Obtaining storage facility for Ray Robison nuisance abatement at 510 Bailey - City Attorney Guinness

City Attorney Guinness reached out to Kinion Salvage regarding storage for the abatement but has received no response yet. Alderman Hartley asked about using one of the empty city lots as an impound lot and adding fencing but that wasn't a good idea since it just moves it from one city lot to another. Yondoo Broadband is currently using one of the empty city lots and they rented a fence for the property.

Public Nuisance on Mark Avenue outside city limits - City Attorney Guinness

City Attorney Guinness has not heard back from Mr. Henke on this property yet. There have been no citations for this property on Mark Avenue, only circuit court injunctions. It is a 1/2 mile from the city limits and they have to voluntarily annex into the city in order to shut off their water & sewer.

School Building Permit / Review of current building permit ordinance - Alderman Hartley

Alderman Hartley would like to discuss this issue first in an Infrastructure meeting. A motion was made by Alderman Short to table this discussion for the next Infrastructure meeting, seconded by Alderman Rockwell. AYES – All in Favor NAYS – 0 Motion carried

Increase for Delta Dental Insurance Coverage for 2019-2020 - City Clerk Sue Hogarth

City Clerk Sue Hogarth presented an email that detailed a 3% increase in the dental insurance coverage effective June 2019. There were other options presented from other dental companies but the Delta Dental insurance was the best cost option. Dental insurance is optional and is paid by the employee but she just wanted to make the aldermen aware of the increase. No action was taken by the board.

Resignation Letter from Officer David Ray – City Clerk Sue Hogarth

A resignation letter from Officer David Ray was presented in the aldermen packets. Mayor Wilch stated that he quit, not resigned, since no notice was given and this will be given to Post for his record. No action was taken by the board.

Applications submitted for City Collector position - City Clerk Sue Hogarth

These applications will not be considered since the job was not posted and the position will be appointed later in the meeting.

Letter from Glenn Matter on Locke Lane - Issues with Ordinance Violations - City Attorney Guinness

Alderman Harper was asked by Mr. Matter to present this letter to the board of aldermen for their review. No discussion or action was taken by the board.

Issues with the City Collector Department - Mayor Wilch

Mayor Wilch stated that there will be a full audit conducted after April 15, 2019 in regards to issues in the city collector department. There was a utility surcharge of $24.33 ($15.00 for sewer and $9.33 for water) that was deleted from the bills and this money was used to pay back our loan debt obligation. This surcharge was deleted for the water in December 2017 and for the sewer in August 2017. This will make the city about $399,000 short on debt repayment. Mayor Wilch contacted Michael Hartman at USDA and he said we should be okay since we contacted him and was proactive about the situation. He wanted to thank Alliance for providing help in that department during this transition. There was no water increase in 2017 and it was never implemented in 2018 because it was put on hold to work out some calculations.

Payment for Accrued Vacation for City employees after termination - City Attorney Guinness

City Attorney Guinness stated that there is no city ordinance regarding payment of accrued vacation pay upon an employee termination. A motion was made by Alderman Rockwell to have City Attorney Guinness draft an ordinance to review at the May board meeting, seconded by Alderman Short.

Request to amend bid deadline or go out for bids for retaining wall at Page Branch Park - City Clerk Sue Hogarth

City Clerk Sue Hogarth did not receive any submitted bids for the Page Branch Park retaining wall on March 29th but there were (4) contractors that requested the bid package. The board asked her to follow up with these contractors and try to get (3) bids in before the May board meeting.

Request to go out for (3) bids on the Splash Pad for Page Branch Park - Alderman Short

Alderman Short asked the board if the Page Branch Park Committee could go out for (3) bids for the new splash pad now that they have raised over $20,000 in donations / fundraisers. He will provide plans when the bids are received to present to the board for approval. A motion was made by Alderman Rockwell to have Page Branch Park go out for (3) bids for the Splash Pad, seconded by Alderman Davis.

Street Cutting / Repairs - Brian Hemmer with Alliance

Brian Hemmer with Alliance asked if he could go out for bids for hot mix to repair some of the street cutting repairs in the city because the hot mix will last longer if the city can afford it. He would also like to put concrete at the school street repair. It was recommended to have Brian discuss this in the next Infrastructure meeting and present pricing to the committee at that time.

Leaking Valve at Elsberry School and Discussion to Hire an Outside Contractor for Repair - Brian Hemmer with Alliance

There is a leaking 4" valve that has been isolated at the school parking lot that needs to be replaced. There is an 8" main that parallels the 4" line and Brian recommends that they hook up the 4" line to the 8" main that may help alleviate some brown water issues and also install a water meter at that time. He wanted to make the board aware and he will bring this information with pricing to the next Infrastructure committee meeting.

INTRODUCTION AND READING OF BILLS FOR PASSAGE

- Bill 2019-03-003 – AN ORDINANCE SETTING REQUIREMENTS AND FEES FOR PERMITS, REQUESTS, PETITIONS, AND APPEALS CONCERNING THE CITY’S BOARD OF ADJUSTMENT AND PLANNING & ZONING COMMISSION BY AMENDING SUBSECTIONS 41.250.3 41.710.41, 41.720.b, 41.810.3 TO THE ELSBERRY CITY CODE.

SECTION 1: The Elsberry City Code is amended to delete Subsection 41.250.3 and insert a new Section 41.250.3 in its place as follows: §41.250 Special Uses — Permit Required

A fee of one hundred seventy-five dollars ($175.00) shall accompany each application and, in addition to the filing fee, the applicant shall pay the cost of publication, if any.”

Section 2: The Elsberry City Code is amended to add new Subsections 41.710 (d), (e) & (f) as follows: §41.710 Board of Adjustment Powers d. A person requesting a variance or other relief from the Board of Adjustment shall submit a written application to the City Clerk that shall contain, or be accompanied by, such legal descriptions, maps, plans, names and any other information as may be requested by the City, including the following minimum information: The full names, addresses, and telephone numbers, of the applicant and all owners of the property. A complete, concise legal description of the area in question. Plot plan for the area for which the variance is requested showing existing buildings, proposed buildings, distances from property lines, etc. (may be hand drawn by applicant)..4. Location sketch, or plat of the land, showing adjoining and abutting tracts and the owners of those tracts. Area or size of property in square feet or acres. Whether a variance for this property was requested previously, and if so, when, what was the variance that was requested, and the result of the request.

A list of owners of record title of the subject property and of all property within 185 feet of the boundaries of the subject property with current mailing addresses of such owners as set forth in the land records of Lincoln County, Missouri. Describe the request and any past and present issues related to the request. Current specific use of property (describe all present improvements.) Specific use proposed for the property if the variance is granted. Why, in your opinion, is your current situation, or the existing size/extent of the use not acceptable. List reasons why strict application of the provisions of the zoning ordinance would deprive you of reasonable use of the land, structure or building in a manner equivalent to the use permitted to be made by other owners of neighboring lands, structures or buildings in the same district. Include a statement of specific facts (with any accompanying documentary proof and exhibits) that establish each of the requirements and conditions set out in Elsberry Municipal Code for the granting of variances, including §§ 41.730 and 71.740. The application must be completed and signed by the property owner.

e. A fee of one hundred seventy-five dollars ($175.00) shall be paid by the person requesting a variance or other relief from the Board of Adjustment to the City and, in addition to the filing fee, the requester shall pay the cost of publication, if any. Such fees and costs shall accompany each such request.

f. The applicant must prove undue and unnecessary hardship due to a provision or provisions herein contained as applied to a specific lot or tract. The variance requested must not be contrary to the general spirit and intent of the zoning regulations, nor can it adversely affect the public safety or general welfare.”

Section 3: The Elsberry City Code is amended to delete Subsection 41.720 (b) and insert a new Subsection 41.720 (b) in its place as follows:

§41.720 Appeals from the Board of Adjustment

b. A notice of appeal specifying the grounds therefore and making any requests for variances signed by the appellant, shall be filed with both the Board of Adjustment and the Administrative Officer. A fee of one hundred seventy-five dollars ($175.00) shall be paid by the appellant to the City and such fee shall accompany each such request and, in addition to the filing fee, the appellant shall pay the cost of publication, if any. The Notice of Appeal shall contain or be accompanied by such legal descriptions, maps, plans, and other information so as to completely describe the decisions or interpretation being appealed, the reasons for such appeal, and any variance requested.”

Section 4: The Elsberry City Code is amended to delete Subsection 41.2810.3 and insert a new Subsection 41.2810.3 in its place as follows:

§41.810 Amendment Procedures

A fee of one hundred seventy-five dollars ($175.00) shall be paid by the petitioner to the City for each petition for an amendment and, in addition to the filing fee, the petitioner shall pay the cost of publication, if any. The Board of Aldermen, the Planning and Zoning Commission and Board of Adjustment shall be exempt from this fee.”

A motion was made by Alderman Short to read the ordinance 2 times by title only, seconded by Alderman Harper.

- Bill No. 2019-04-001- Sponsored by Alderman Michael Short - AN ORDINANCE PROVIDING FOR THE HOLDING OF AN ELECTION WITHIN AND FOR THE CITY OF ELSBERRY, MISSOURI, ON THE QUESTION OF THE APPOINTMENT OF A COLLECTOR AND SETTING THE TIME AT WHICH THIS ORDINANCE SHALL BECOME EFFECTIVE.

WHEREAS, Section 79.050, Missouri Revised Statutes, provides that the Board of Aldermen may provide by ordinance, after approval of a majority of the voters voting at an election at which the issue is submitted, for the appointment of a Collector; and

WHEREAS, the Board deems it advisable and in the best interests of the citizens of the City of Elsberry to appoint a Collector;

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF ELSBERRY AS FOLLOWS:

Section 1. An election shall be, and the same is hereby called and ordered to be held in the City of Elsberry, Missouri, on the 6th day of August, 2019, for the purpose of submitting to the qualified electors of said city the following proposition:

“Proposition No. 1

Shall the Board of Aldermen of the City of Elsberry, Missouri, provide by ordinance for the appointment of a City Collector as provided for by the Statutes of the State of Missouri?”

Section 2. The Election Authority of Lincoln County, Missouri, (hereinafter, the "Election Authority") shall conduct the election. Not later than 5:00 p.m. on the tenth Tuesday prior to the August 2019 election, the City Clerk of the City is hereby directed to notify the Election Authority of the election.

The notice shall be in writing and shall specify that the City is calling the election, the purpose of the election, the date of the election, and it shall include a certified copy of the legal notice to be published and the sample ballot.

Section 3. Notice of the election shall be given by the Election Authority by causing legal notice thereof to be published in the manner required by applicable law. The legal notice of the election shall include the purpose, date and time of the election, the name of the officer or agency calling the election, a sample ballot and the location of the polling place or places.

Section 4. The election will be held at the polling places designated by the Election Authority pursuant to RSMo §115.115 in the City.

Section 5. The election shall be held and conducted and the results thereof shall be canvassed in all respects in conformity with the Constitution and the laws of the State of Missouri. The judges of the election shall be selected and appointed by the Election Authority, in accordance with applicable law. The returns of the election shall be certified to the City by the Election Authority. The City Clerk and the Election Authority are hereby authorized to take all action necessary or appropriate such that the election shall be conducted in full compliance with the requirements of applicable law.

Section 6. This ordinance shall be in full force and effect from and after its passage and approval.

A motion was made by Alderman Hartley to read the ordinance 2 times by title only, seconded by Alderman Harper.

Tree Board: Arbor Day Proclamation at Page Branch Park on Saturday April 13, 2019 at 10AM with local Cub Scouts and Tree City USA representative. Alderman Harper will attend the Arbor Day at Page Branch Park and will discuss the TRIM tree grant with Mike Talbot. Nothing else to report.

Mayor Wilch: Welcome & thank you to Rita Robinson for joining the City of Elsberry Board of Aldermen as our new Ward 1 representative and congratulations to Alderman Short & Alderman Rockwell on their re-election for Wards 2 & 3.

Alderman Davis: Nothing to report

Alderman Hartley: Nothing to report

Alderman Short: Nothing to report

Alderman Harper: She has tried to contact the police with no response regarding the house at 513 N. 3rd Street. There are people living in the home and there is no water and no occupancy permit to live there.

Alderman Rockwell: Nothing to report

Alderman Robinson: Thank you for the opportunity to be an alderman for Ward 1.

REPORTS OF CITY DEPARTMENTS AND OFFICERS

Rob Guinness – Attorney – Closed Session

Brian Hemmer – Street sweeper is being repaired and should be ready to go soon

Police Chief Jeffries - Not Present

Tammy Sharpe – Treasurer – She would like to request permission to attend the court clerk conference in May in Tan-Tar-A again this year. A motion was made by Alderman Rockwell to approve the conference attendance, seconded by Alderman Hartley.

AYES – All in Favor NAYS – 0 Motion carried

She would like to commend Chief Jeffries for his many years of service to the police department and to the City of Elsberry.

Sue Hogarth – City Clerk – For the contract offer that was received on Old City Hall, we did submit a counter offer and there was no counter offer back. There was another showing today but they were not interested. We have it listed for 6 months.

VOTE TO TAKE UP BUSINESS TO BE CONDUCTED IN CLOSED SESSION

A motion was made by Alderman Short to go into closed session with vote to close pursuant to RSMo Section 610.021 Section (1) Legal actions, causes of action, litigation, or confidential or privileged communications with its attorneys, (3) Hiring, firing, disciplining or promoting of particular employees by the city, (13) Individually identifiable personnel records, performance ratings or records pertaining to employees or applicants for employment, and (14) Records which are protected from disclosure by law, seconded by Alderman Rockwell.

AYES – All in Favor NAYS – 0 Motion carried

Closed session started at 8:20PM.

RESUME OPEN SESSION

Mayor Wilch resumed the open session meeting at 8:40PM.

The Board of Aldermen requested City Attorney Guinness to create a building code or adopt the International building code for a "shouse" that can be built in agricultural areas only as a new bill to present at the May board meeting.

A motion was made by Alderman Short to hire Rachel Reed as the new deputy collector at $600 per week plus benefits effective Monday April 15, 2019, seconded by Alderman Davis.

AYES - Alderman Rockwell, Alderman Short, Alderman Davis, Alderman Hartley, Alderman Robinson NAYS - 0 ABSTAIN - Alderman Harper Motion Carried

Alderman Davis stated that there is a home on Browns Mill Road that is owned by Henke and they are running sewage into a ditch and there is a pipe sticking out. There is no septic tank on this property but City Attorney Guinness will check into this situation in the morning and contact Lincoln County since the home is out of our city limits. He stated that sewage cannot be discharged into a ditch that leads into the city.

ADJOURNMENT A motion was made to adjourn the board meeting by Alderman Short, seconded by Alderman Rockwell.

AYES – All in Favor NAYS – 0 Motion carried

Open session meeting was adjourned at 8:51PM.
