MARIONVILLE BOARD OF ALDERMEN REGULAR SESSION MINUTESMarionville Fire Station Conference Room, 101 S CentralThursday, February 13, 2020Mayor Rapp called the meeting to order at 6:30 p.m. On roll call the following Aldermen were present: Joe Shook, Gina Herndon, Dale Blankenship, Kay Leffingwell, and Melissa Freeman. Jessica Wilson was absent.Following roll call, Mayor Rapp led the Pledge of Allegiance to the Flag of the United States of America and opened the meeting with prayer.Approve Order of Agenda: Alderman Blankenship made the motion to approve the order of the agenda as presented. Alderman Freeman seconded. Motion passed on roll call vote as follows:AYES: 5- Freeman, Herndon, Leffingwell, Blankenship, ShookApprove minutes of the regular meeting on January 9th and the special meeting on January 23rd: Alderman Leffingwell made the motion to approve the minutes of the January 9th and January 23rd meetings as presented. Alderman Herndon seconded. Motion passed on roll call vote as follows:AYES: 5- Blankenship, Leffingwell, Shook, Freeman, HerndonApprove payment of Bills, Adjustments, Bank Recs and Cash Reports: Alderman Freeman made the motion to approve the payment of the bills, bank recs, cash reports and adjustments, seconded by Alderman Shook. The motion passed on roll call vote as follows:AYES: 5- Shook, Leffingwell, Blankenship, Herndon, FreemanCitizens Comments/Official Guests & Visitors:Tina Marque, Director of Business Development with Liberty Utilities: Ms. Marque gave the Alderman a handout to look over. Ms. Marque indicated Liberty Utilities services water and electric and she is reaching out to the board about our waste water operations and the possibility of Liberty Utilities purchasing that from the city. The advantages of selling to them would be to pay down debt, address street repairs and infrastructure needs, etc. They have a community development company to help with economic growth and help service new growth in the community. There are several steps involved in this process. If interested, the board would sign a confidentiality agreement allowing them to study our waste water treatment plant to see what we have going on and the things that need to be addressed. There is no commitment at this point. Liberty Utilities would present a five (5) year plan, including improvements, price and rates. If the board decided to proceed with selling the waste water treatment plant, it would first have to be voted on by the citizens of Marionville, and then approved by another board. There was some concern regarding rate increases. It was noted they cannot just raise rates. They do frequent rate studies to keep the increases small. They have to invest in the plant, then file a case, have an audit, and then through the audit it is determined how much of a rate increase, if any, they can do. The aldermen will consider this option.Joanne Lawrence: She would like to know more about the city’s noise ordinance: when is it in effect and what do you consider noise. One issue she has is the owner of 501 South Street is allowing people to drive four-wheelers and off-road vehicles on their property. He is allowing this so he won’t have to mow the grass. There are from three (3) to seven (7) vehicles at any one time. Children and adults are driving them. Some of them have helmets and some have no helmets. They are very noisy and summer will be here soon, so the daylight hours will be longer. She is concerned that someone is going to get hurt. Ms. Lawrence also asked if the city could look into making a four-way stop on South Street to slow the traffic down. Vehicles are driving too fast and during football season there is lots of traffic. Mayor Rapp indicated she would get her a copy of the noise ordinance and she would get with the street department to look at a four-way stop on South Street. Mayor Rapp will also get with the police department concerning the four-wheelers. DEPARTMENT REPORTSFire Chief Bowling: The fire department has had a lot of training in the last month. Two firefighters attended winter fire training in Columbia. The radios have been working and the new gear should ship tomorrow.Police Chief Witthuhn: Indicated Marionville and Aurora still have openings for police officers. Alderman Freeman asked how we can show the public officers do patrol in Marionville. Chief Witthuhn didn’t know how to show that officers are patrolling in Marionville. This has been an ongoing issue, but they are over here.Sewer Department: Mayor Rapp stated they are getting close to having all the repairs completed at the plant.Karyn Marsh, ACO: She has three (3) dogs at the pound as of now. Cleopatra was adopted earlier this month. She had a trapper come out to help trap a dog, but a resident actually caught it.OLD BUSINESSBill No. 2020-01/Ordinance No. 01-2020—“AN ORDINANCE TO AMEND THE CITY CODES FOR THE CITY OF MARIONVILLE, MISSOURI CHAPTER 205-ANIMAL REGULATIONS”: Bill No. 2020-01 was read twice by title only. Mayor Rapp stated we were trying to coordinate our animal regulations for both communities. Alderman Freeman asked for clarification on cats. The ordinance says cats are to be permitted; but we have said we don’t take cats. Do we have the ability to enforce it and take on more responsibility to deal with cats not permitted? Karyn indicated we can house up to six (6) cats per our state inspector. Alderman Freeman requested to get something in writing from the state inspector saying we can house cats and how many. We may need to change this later. Alderman Blankenship made the motion to approve Bill No. 2020-01/Ordinance 01-2020 as presented. Alderman Herndon seconded. The motion passed on roll call vote as follows:AYES: 4- Leffingwell, Freeman, Blankenship, HerndonNAYES: 1- ShookBill No. 2020-02/Ordinance No. 02-2020---“AN ORDINANCE TO ADOPT AN OCCUPANCY PERMIT”: Mayor Rapp stated hopefully this ordinance will help make rental property more habitable. Alderman Blankenship requested a couple of changes. Under Water Heater and Furnace-replace “properly permitted” with “installed per code”, since we don’t permit those items. Alderman 02/13/20Freeman didn’t see where an initial inspection was required. They agreed to add to the permit requirements under No. 1 “Beginning on this date, with the next change of occupancy in any rental property an initial inspection will be required.” Alderman Leffingwell made the motion to approve Bill No. 2020-02/Ordinance No. 02-2020 with the changes requested. Alderman Herndon seconded. The motion passed on roll call vote as follows:AYES: 5- Shook, Blankenship, Herndon, Freeman, LeffingwellBill No. 2020-03/Ordinance 03-2020---“AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF MARIONVILLE, MISSOURI TO ENTER A CONTRACTUAL AGREEMENT FOR OPERATING AND MAINTAINING THE WASTE WATER TREATMENT PLANT FOR THE CITY OF MARIONVILLE”: Bill No. 2020-03 was read twice by title only. Mayor Rapp stated Everett and Zeke are about ready to enter the contract stage. Alderman Blankenship made the motion to approve Bill No. 2020-03/Ordinance 03-2020 as presented and seconded by Alderman Shook. The motion passed on roll call vote as follows:AYES: 5- Blankenship, Leffingwell, Herndon, Shook, FreemanDiscuss Marionville Cemetery Association: Mayor Rapp has done a lot of research. She has access to all the receipts and she has a good record of the south end of the cemetery. She attended the last meeting of the Cemetery Association. The Essary’s have agreed to stay on for two (2) years for the mowing and clean up for ten dollars ($10) per hour each. They will clean up southeast side. We would have to discuss pay for a sexton. Mayor Rapp said there are still some things to look at, but she wanted to know if the board wanted to proceed with this. Alderman Freeman made the motion to proceed with the gift of the cemetery. Alderman Herndon seconded and the motion passed on roll call vote as follows:AYES: 4- Herndon, Freeman, Shook, LeffingwellNAYES: 1- BlankenshipNEW BUSINESSMayor’s Proclamation: Mayor Rapp read the proclamation she signed for the Missouri Farm Bureau celebrating “Thank A Farmer Week”. Mayor’s appointment to the Board of Adjustments: Mayor Rapp re-appointed Donna VanHook to the Board of Adjustments. Alderman Leffingwell made the motion to approve Mayor Rapp’s appointment. Alderman Freeman seconded. The motion passed on roll call vote as follows:AYES: 5- Herndon, Leffingwell, Shook, Freeman, BlankenshipPark Board Appointments: Mayor Rapp thought she had someone to appointment, but they decided they were too busy at this time. Fire Station Meeting Room: At January’s meeting, the Fire Chief asked the board to consider holding board meetings at a different location, due to the department wanting to finish the kitchen, create a day room to try to appeal to new volunteers. They would like to have use of their entire station. Mayor Rapp stated there was not another place to meet except here. This fire station was built 02/13/20with the intention of the Boards meeting in the conference room. The municipal building has too many areas where the public cannot be. Fire Chief Bowling has reached out to Mercy and they will be holding an Emergency Medical Responder class at the Fire Station, free of charge, on Tuesdays and Thursdays for eight (8) weeks beginning March 31. These are the days Mercy has set for the class. Area Fire Departments will also be attending this training. It was mentioned that the City Boards could move the meeting dates for that time period. Alderman Freeman stated these are good ideas, but we need to work together to come up with a solution. It was suggested to check with Court about using that building for meetings. It has been fixed. Alderman Leffingwell also asked about the recycle bins. It was noted they are dumped every other week.Melissa Freeman: Asked if there needed to be documentation to show what the Fire Department officers do extra, since we are paying them above the fire calls. The board didn’t see a problem with the way it is. Alderman Freeman asked about a street light on Market Street between Central and O’Dell. It was noted several street lights are out around town. Mayor Rapp asked Chief Witthuhn if the officers could note the lights that are out while patrolling. Joe Shook: Indicated the flag on the square needs replaced.02/13/20MAYOR COMMENTSMayor Rapp stated the manhole on East O’Dell has been repaired. The mobile home cases have been settled. They should be removed soon. There will be a public hearing and special meeting next Thursday, February 20, 2020. The public hearing is at 6:15 p.m. and is regarding the condemnation of 315 S College. The special with Toth and Associates regarding the I & I will follow the public hearing. Mayor Rapp asked the board to think about what Ms. Marque proposed.ADJOURNMENTAlderman Shook made the motion to adjourn; seconded by Alderman Freeman. All voted aye.
