AT THEIR MEETING ON 25 MARCH 2009 THE PLANNING COMMITTEE OF THE REGULATORY COMMITTEE ON BEHALF OF THE COUNTY COUNCIL RESOLVED, FOR THE PURPOSES OF REGULATION 3 OF THE TOWN AND COUNTRY PLANNING GENERAL REGULATIONS 1992 TO GRANT PLANNING PERMISSION FOR THE DEVELOPMENT REFERRED TO ABOVE AND A COPY OF THE DECISION NOTICE IS ATTACHED.

Therefore, in accordance with Regulation 3 would you please accept this letter in conjunction with the plans shown as formal notification of the development for the purpose of your Register of Planning Applications and Decisions.

In pursuance of their powers under the above mentioned Act, Order and Regulations, the Council as the local planning authority hereby GRANT PLANNING PERMISSION for Installation of a wooden parental shelter adjacent to the eastern school boundary. St Michaels C P School, 1 Station Road, Withyham. (Within land edged red on applicants plan no. WCP2363/01 Rev B) in accordance with your application validated by the Director of Transport & Environment of East Sussex County Council on 14 January 2009 and the plans and particulars submitted in connection therewith and listed below and subject also to due compliance with the condition(s) specified here under:-

1. The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990.

The Development Plan policies of relevance to this Decision are:-

East Sussex and Brighton & Hove Structure Plan 1991-2011: Policies S1 (sustainability), EN1 (environment) EN2 and EN3 (AONBs).

East Sussex Brighton & Hove Waste Local Plan 2006: Policy WLP11

(construction industry waste).

Wealden Local Plan 1998: Policies EN6 (High Weald AONB), GD2 (proposals outside development boundaries) and EN27 (design and impact on amenities).

Non Statutory Wealden Local Plan 2005: Policies GD2 (proposals outside development boundaries), NE5 (High Weald AONB) and BE1 (impact on amenities).

Reasons for approval

The proposal will provide St Michael’s School with a parental shelter. It has been judged not to pose significant harm on either the AONB, landscape or residential amenity. The siting and design of the structure is considered appropriate. The proposal complies with Policies S1, EN1, EN2 and EN3 of the East Sussex and Brighton & Hove Structure Plan 1991-2011 and Policy WLP11 of the East Sussex and Brighton & Hove Waste Local Plan 2006. It also accords with Policies EN6, EN27 and GD2 of the Wealden Local Plan 2006 and Policies GD2, NE5 and BE1 of the Non-Statutory Wealden Local Plan 2005.
