Parties: This Rental Agreement is made this day of , 20 by and between Daniel & Anne Peters, (hereinafter called Owner), whose present mailing address is 3 No. Garand St. Winslow, Maine, 04901, and , (hereinafter called Homeowner). Approval for occupancy is also extended to the additional registered person(s) compromising the Homeowners family structure:NameRelationshipDOB No additional persons or other individuals are permitted to reside with Homeowner without the Expressed and prior permission of Owner. Homeowner may neither assign this agreement nor sublet the home or lot. The Homeowner may /may not maintain pets on leased premises. If the Homeowner is allowed to have pets, only the following pets may live on the premises: (limited to 2 per lot)Pet NameBreedSize in pounds Color 2. Term: This Rental Agreement shall commence on , 20 and continue for one (1) year, thereafter continuing as a month to month tenancy until terminated as provided in either this lease or Title 10, Chapter 953 of the Maine Statues.3. Leased Premises: Homeowner does hereby lease from Owner a certain lot or parcel of land known as address .No ownership rights whatsoever arise from this Rental Agreement. Upon termination of this tenancy, through sale of the mobile home or otherwise, said mobile home must be removed unless Owner agrees to enter into a new Rental Agreement.4. Ownership of Mobile Home: The Homeowner has represented to the Owner that he/she is the owner of the mobile home described in Section 5 below. Any transfer of title to said home to any other person or entity is prohibited and shall terminate the Homeowners tenancy.5. Mobile Home: Homeowner is hereby authorized to locate the following described mobile home (and no other) Make and year: Model: Make: Serial number: Color: 6. Rent: The initial monthly rent shall be $205.00 , plus $10.00 for each additional persons for a total of $ per month, payable in advance prior to Homeowner moving into the Community and on the first day of each month thereafter until this Agreement is terminated. The monthly rent may be changed by Owner at any time in the future, as circumstances require, upon giving thirty (30) days written notice to the Homeowner setting forth the date upon which such changes shall become effective. A late payment of four percent (4%) of the total monthly rent will be charged and is due and payable during any month in which payment is received on the Fifteenth (15th) day of the month or later. Each Homeowner is jointly and severally liable for the rent and any other Community charges. Homeowner shall pay a Twenty-five ($25.00) service fee as additional rent for any check returned to the Owner by Homeownerss bank for insufficient funds and/or other reasons.7. Change of Ownership Fee: Each Homeowner currently living in the Community that wishes to buy or swap homes in the Community from another community resident is required to pay a change of ownership fee. This fee is two (2) times the monthly rent. This amount must be paid in advance and is not refundable under any circumstance.8. Entrance Fee: For new Community residents, there is a non-refundable Entrance Fee of $ payable at signing of this lease.9. Security Deposit: Homeowner shall pay to Owner, upon execution of this Agreement, a security deposit equivalent to months rent . Said deposit may be applied by Owner toward reimbursement for any reasonable cost to repair or cleaning necessitated by Homeownerss acts or omissions in violation of this Agreement (normal wear and tear excluded) and for rent or other financial obligations which are due, unpaid and owing.10. Fees, Charges, and Assessments: Homeowner does hereby agree to pay all fees, charges, and assessments due pursuant to the Rules and Regulations of the Community and this lease. Any such fees, charges, and assessments may be increased by Owner upon giving thirty (30) days written notice.11. Rules and Regulations: Homeowner does hereby acknowledge receipt of the Community Rules and Regulations, along with a copy of the Sate Law governing Mobile Home Parks, Title 10 Chapter 953 of the Maine Revised Statues Annotated. Having had an opportunity to review said Rules and Regulations, Homeowner does hereby acknowledge that he, his family, guest, and invites will comply with all such Rules and Regulation. Homeowner further acknowledges that Community Rules and Regulations may be changed by Owner anytime in the future upon giving the Homeowner thirty (30) days written notice setting forth the date upon which such change shall be effective. Violation of the above-referenced Rules and Regulations may, at the sole discretion of Owner, lead to eviction pursuant to the laws of the State of Maine.12. Eviction: Homeowner hereby acknowledges his status as a renter at this Community and agrees that if it becomes necessary to evict him due to failure to pay rent or other violations under the Rules and Regulations, that he/she will be obligated to reimburse Community for all reasonable cost (i.e. rental arrearage, damages to Community property, or any other miscellaneous fees charged) incurred by Community as a result thereof. If the Homeowner remains at the leased premises beyond the termination date, Owner may begin a legal action for possession. Until Homeowner vacates the leased premises all provisions of this lease shall remain in effect. Any payment received by Owner during or after an eviction is for use and occupancy only and is not accepted as rent.13. Waiver: Owner retains the right, for demonstrated good cause, to waive in writing any one or more violations of any rule with respect to one or more Homeowners. Waiver of any rule shall not be deemed a waiver of any other rule unless expressly stated therein, nor shall a waiver on behalf of any specified individual or individuals be deemed a waiver for any unspecified individuals.14. Indemnification: Homeowner agrees to indemnify and save Owner harmless from all liability, loss, or damage arising from any nuisance made or suffered on the leased premises by the Homeowner, his household members, his guests, or his invites, or any carelessness, neglect, or improper conduct of any such persons. All personal property of the Homeowner shall be kept and maintained at the sole risk of said individual. Owner shall not be liable for damages to or loss of any property of any kind which may be lost or stolen, damaged or destroyed by wind, fire, water, steam, defective refrigeration, or otherwise while on the leased premises, unless due to the negligence of Owner or its agents. Owner cannot and will not accept any liability because of Act of God. Homeowner agrees to defend (including payment of attorneys fees and court cost), indemnify and hold Owner harmless from any loss, damage, claim, demand, suits, judgments of liabilities to which Owner may be put arising from any injury or resulting from the use of the leased premises or common areas by Homeowner, his household member, his guest, or his invites, not occasioned by the negligence of Owner or it agents.15. Breach: Any violation of the provision of this agreement or the rules by the Homeowner shall be deemed to be a breach of the lease, and remaining term shall be forfeited and Homeowner shall be subject to a forcible entry and detainer action (eviction) as well as a suit for damages. Any false or misleading information provided by Homeowner in an Application for Tenancy will be considered a breach of this Agreement and management shall have the right to cancel and terminate this agreement immediately. All monies received shall be forfeited in favor of the Owner as liquidated damages.16. Rules & Regulations & Benefits: By signing this agreement the tenant acknowledges that they have been give a copy of Rules Regulations & Benefits list.17. Other Agreements: 18.
