AFFIDAVIT OF MICHELLE ROBINETTE

I, Michelle Robinette, being of legal age and being first duly sworn, attests and states as

follows:

1. I have been employed by the Tulsa County Sheriff's Office since 1995 and most

recently served as the Acting Sheriff for Tulsa County. In 2010, I served as the Chief Deputy

over the Detention Division and Jail Administrator for the Tulsa County Sheriff's Office at the

David L. Moss Criminal Justice Center.

2. In May of 2010, allegations of SOI sexual abuse were made by two females who

were housed in the medical unit of the David L. Moss Criminal Justice Center (Tulsa County

Jail) that a detention officer may have been sexually inappropriate with them. Upon learning of

the accusations, the Tulsa County Sheriff's Office immediately suspended the detention officer

and began an investigation both as a criminal matter and as a matter for internal affairs. The

investigation included interviews with the female inmates and all other possible witnesses to the

alleged conduct. Both females were interviewed and each denied intercourse or oral sex had

occurred but claimed that the detention officer had hugged and touched them inappropriately and

looked on them in the shower on a single occasion. Consistent with our policy and practice, the

information gathered in the investigation was presented by our criminal investigator to the

district attorney's office for prosecution. The State declined to prosecute the detention officer.

Following his suspension and before the criminal investigation was complete, the detention

officer resigned from the Tulsa County Sheriff s Office ending the internal affairs investigation and jurisdiction over him.

3. In response to the panel's February 11, 2011 request for information concerning alleged SOI sexual abuse which had occurred at the facility in 2008-09, the Tulsa County Sheriff s Office chose to voluntarily include data from 20I O even though the information had not been requested. The data provided did not include the allegations by these two female inmates from May of 2010.

4. On September, 16, 2011, I appeared and testified before the PREA Panel along with then Sheriff Stanley Glanz. At the time that I testified, I was unaware that the data concerning the allegation in May of 2010 had not been included in the materials. The omission was not intentional or willful but was an oversight by my office in 2011.

5. The data for alleged SOI sexual abuse in 2010 should have reflected the allegations by these two female inmates and the Tulsa County Sheriff s Office corrects the record at this time.
