Social Studies7 The Bill of Rights

To make sure the new national government could not violate the individual rights of the people, many insisted that the new US Constitution be amended to include a bill (or list) of these rights, thus guaranteeing them. Several state constitutions already had their own bill of rights and many of them ratified the Constitution on the condition that a bill of rights was added. In 1791, the states ratified the first ten amendments to the US Constitution – the Bill of Rights.

Directions: Use your copy of the Bill of Rights and tell which right applies or has been violated in each situation. If an amendment gives multiple freedoms, be sure to write what part of the amendment you are referring to.

1. The New York State Police barge into Susan’s home without a proper search warrant to look for stolen property.

2. Carlos decides to make a speech on the street that speaks out against the war in Iraq.

3. Tina has been arrested for burglary. Her lawyer advises her remain silent and not take the witness stand at her trial.

4. Ms. Cassaro was found not guilty for the murder of Mr.Chappas. However, the state charged her again with the same evidence, hoping to get her convicted.

5. Joe keeps and collects several shotguns and rifles for hunting deer.

6. Sean decided to convert from Christianity to Judaism.

7. Clearance Earl Gideon has been arrested for burglary in Florida. He is too poor to afford a lawyer and requests that the state give him one for his defense.

8. John is arrested for stealing a Honda Civic. The judge at his arraignment sets his bail at $6 billion dollars.

9. Sam is arrested on the street and thrown into the back of a patrol car. He sits in his jail cell and is not told the crime he is accused of and no date for a trial has been set.

10. A US Army division commanded by General DeHay marches into Fishkill, NY during a time of peace. The general demands that the people of Fishkill give his men food, clothing and shelter for two weeks.

11. Mr. Tarsio begins his trial for “J-walking” with no jury.
