LYONS CITY COUNCIL MEETING

December 8, 2016

A regular meeting of the Mayor and Council of the City of Lyons was called to order by Mayor Andrew Fuston at 5:30 P.M., December 8, 2016, at the Lyons City Hall. Present were Council members Brink, Steinmeyer, Wheaton, and Minton. Also in attendance were City Attorney Smith, City Clerk Ritter, Utility Superintendent Daberkow, and Carvin Housh.

Visitors at the meeting were June Housh, Pam Thomsen of Three Rivers Housing Development, Lori Wheaton, Brian Depew, Melanie Brandert of the Norfolk Daily News, Jamie Horter of the Lyons Mirror Sun, Mike Heavrin, and Terry Ueding.

The Mayor publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy posted in the room where the meeting was being held. Advance notice of said regular meeting was given to the Mayor and all members of the Council, and a copy of their receipt of such notice and the agenda is filed in the City Clerk’s office. Availability of the agenda was communicated by posting notices in three public places and in the notice to the Mayor and Council. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

The meeting was called to order upon motion by Brink, second by Wheaton. All council members voted yes on roll call.

Moved by Wheaton, seconded by Steinmeyer to approve the following consent agenda:

1. Dispense with reading of minutes of meetings held on November 1 and November 7.

2. Claims as presented.

3. Treasurer report.

All council members voted YEA.

Old Business: Motion by Steinmeyer, second by Brink to approve hiring of Ron Tenney for the temporary part-time help of removing snow for this winter season at $18 per hour. All voted yes on roll call.

Regular Agenda/New Business: Motion by Wheaton, second by Brink to accept the election certificates issued by the Burt County Clerk for the November 8, 2016 City Council General Election. All voted yes on roll call.

Mayor Fuston gave a hand-shake to out-going Council member Minton thanking her for her years of service on the Lyons Council. The remaining council members also gave Minton a hand-shake.

Then, Allen Steinmeyer and Carvin Housh were sworn in as Council Members by City Attorney Dan Smith. Council Members Allen Steinmeyer and Carvin Housh will sign their Oath of Office and be notarized by Dan Smith.

Jamie Horter, as a member of a group working on ideas for downtown revitalization, maintenance of Main St buildings, and housing needs, presented some of those ideas to the Council. Jamie talked with some residents here in town also. Some ideas are to create a building restoration fund instead of a demolition fund, enforce the use of yellow placards, work with a community partner to oversee the implementation of some of the ideas, raise money for repair/restoration of houses and buildings, or if the city owns a building needing repairs, to think about a lease-to-own contract where the lessee would make the needed repairs before the property is deeded over.

Pam Thomsen of Three Rivers Housing Development gave an update on the senior housing project in Lyons that will be north of town on Walnut Street. The two lots are owned by Steve Jensen. One requirement for the project was to be on a paved street but Walnut and Birch Streets are not paved. So Pam asked if a resolution could be passed to exempt this property from any paving assessments in the future. A resolution would need to be written up for the January 3, 2017 Council Meeting. With new incoming Federal government personnel, the regulations may change. Tax credits have been going down.

Motion by Wheaton, seconded by Brink to approve the Certification to Board of Public Roads Classifications & Standards (NBCS forms) and the SSAR report for FY ending September 30, 2016. All council members voted yes on roll call.

Chief Buck was not at the meeting as he was on a police call. Police report was handed out before the meeting. A written complaint letter from a concerned citizen was read by each Council member. The Mayor will talk with Chief Buck on this letter.

Mike Heavrin presented the Library Report and Grants Report. The E-rate process for FY 2016-2017 isn’t going well. Our filed and certified Form 486 was canceled due to it being stuck in the review process. Until the issue is resolved, and in the meantime, we are working on the 2017/2018 application. With the new CIPA (Children’s Internet Protection Act) regulations, we are now required to install an Internet filtering system on all computers in the Library. The software is around $300 per year. December events at the Library includes a Christmas Concert on December 11 at 5 pm and a visit from Santa Claus on December 14 at 5 pm.

The new water lines were installed at Brink Park. We purchased the digger truck from Brehmer Mfg for $21,000.00. Brehmer Mfg is also trying to sell the City’s old digger truck.

City Clerk Ritter reported on the General, Utility, and Debt Service Income Statements for the month ending November 30, 2016. The General side had a month to date net loss of $17,010 and a year to date net loss of $36,540. The Utility side had a month to date net loss of $43,113 and a year to date net loss of $8,284. Debt Service had a month to date net gain of $1,813 and a year to date net loss of 93,179 due to payment of principal and interest of the Pool Bond. Budget reports for the General and Utility side were as follows: General had expended 13.53% of its fiscal year budget in the first two months. The Utility side had expended 12.48% of its fiscal year budget. Two month average is 16.66%. The 2017 Holiday schedule was given to the Council. With the One & Six Year Plan coming up, the Council was asked if they had any street projects to be on the One Year Plan. They will think about projects, if any for the one year plan.

Motion by Council member Steinmeyer, second by Housh to approve the building permit for a 2 car garage to Jon Bacon at 600 South 7th Ave, Lyons, NE 68038. All voted yes on roll call.

Motion by Council member Steinmeyer, second by Brink to approve a concrete sidewalk work permit to Jon Bacon at 600 South 7th St, Lyons, NE 68038, for new sidewalks. All voted yes on roll call.

Council Member Steinmeyer nominated Wheaton for Council President. There were no other nominations. Motion by Steinmeyer, seconded by Brink to nominate Wheaton as Council President. All voted yes on roll call.

Motion by Wheaton, seconded by Brink to approve appointments as named. YEA: Brink, Wheaton, Housh, and Steinmeyer. NAY: None.

Motion by Wheaton, seconded by Steinmeyer to approve the same amount as last year for employee Christmas checks. All council members voted yes on roll call. City employees will be receiving a Christmas check as follows: $150 each to Ron Daberkow, Mary Lou Ritter, Chief Jim Buck, and Mike Heavrin; $100 each to Pam Stansberry, Robert Rivera, Raymond Hayes, Terry Ueding, and Gregg Simonsen; and $50 each to Terry Poland, Jorma Hedges, Mary Jane Bell, Mary Strohmyer, Kevin Hayes, and Jeremy Miles.

The meeting was adjourned at 6:34 P.M., upon motion by Brink, seconded by Steinmeyer. All council members voted yes on roll call.
