Hayden Construction, LLC, Schriever, Louisiana, On September 5, 2012, the Residential Committee considered an alleged violation by the following State licensed residential building contractors for failure to maintain a current certificate of insurance on file with the Board for workers’ compensation coverage. Sec. 1503 (D) Rules and Regulations of the Board.

Decision & Civil Penalty Assessed at the September 5, 2012 Residential Committee Meeting: A Motion was made by Mr. Ward which was seconded by Mr. Dugas to suspend the license of O D Hayden Construction, LLC and fine administrative costs, giving staff the authority to reinstate the license if the proper proof of insurance is provided with no lapse in coverage. The Motion passed.

D. COMPLIANCE HEARING(S):

1. a) Tim Kinyomi, Port Allen, Louisiana – Consideration of an alleged violation for entering into a contract with an unlicensed contractor involving work or activity for the performance of which a license is required, at but not limited to, 2427 Alvar Street ($106,000.00), New Orleans, Louisiana. Also, consideration of an alleged violation that the contractor did bid, contract for, and/or perform work in a name other than the name which appears on the official records of the State Licensing Board for Contractors for the current license. d) Donald Leighman Martin d/b/a Martin Plumbing Company, Natchitoches, Louisiana – Consideration of an alleged violation for entering into a contract with an unlicensed contractor involving work or activity for the performance of which a license is required, at but not limited to, 407 Saint Francis Street ($15,000.00), Natchitoches, Louisiana. La. R.S. 37:2175.2(A)(1).

Decision & Civil Penalty assessed at the August 1, 2012 Residential Committee Meeting:

A Motion was made by Mr. Dugas which was seconded by Mr. Ward to find ABRY BROTHERS FOUNDATION & STRUCTURAL SOLUTIONS, in violation. The Motion passed. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to fine ABRY BROTHERS FOUNDATION & STRUCTURAL SOLUTIONS, the maximum fine, administrative costs, the issuance of a cease and desist order, and refer the matter to the Attorney General’s office. The Motion passed.

2. Jeffrey L. Schello d/b/a SMC, Inc., New Orleans, Louisiana – On August 1, 2012, the Residential Building Committee considered an alleged violation that no person shall undertake, offer to undertake or agree to perform home improvement contracting services unless registered with and approved by the Residential Building Contractor Subcommittee of the State Licensing Board for Contractors as a home improvement contractor, at but not limited to, 3243/3245 Belfort Street ($68,100.00), New Orleans, Louisiana. La. R.S. 37:2175.2(A)(1).

Decision & Civil Penalty assessed at the August 1, 2012 Residential Committee Meeting:

A Motion was made by Mr. Dugas which was seconded by Mr. Ward to find JEFFREY L. SCHELLO D/B/A SMC, INC. in violation. The Motion passed. A Motion was made by Mr. Dugas which was seconded by Mr. Ward to fine JEFFREY L. SCHELLO D/B/A SMC. INC, the maximum fine plus administrative costs and the issuance of a cease and desist order. The Motion passed.

G. REQUEST FOR RECONSIDERATION OF PENALTY:

1. Alianza Rodgriguez Construction LLC, Kenner, Louisiana – On December 7, 2011, an alleged violation for residential construction without possessing a State Residential Building License, at but not limited to, 821 Fashion Boulevard ($75,127.25), Hahnville, Louisiana. LA R.S. 37:2167(A).

Decision & Civil Penalty Assessed at the December 7, 2011 Residential Committee Meeting:

Mr. Dugas made a Motion which was seconded by Ms. Wendel to find ALIANZA RODRIGUEZ CONSTRUCTION, LLC in violation. The Motion passed. A Motion was made by Mr. Ward and was seconded by Ms. Wendel to fine ALIANZA RODRIGUEZ CONSTRUCTION, LLC the maximum amount, court costs and the issuance of a cease and desist order. The Motion passed.

H. REQUEST FOR REHEARING:

1.
