Public Session Minutes
September 13, 2017
The Legalized Games of Chance Control Commission met on September 13, 2017
Essex Room 7th Floor, 124 Halsey Street, Newark N.J. Present were Commissioners Steven Layman and David J. Grusemeyer. Commissioner Edward F Barrett. Also in attendance were Nancy Miller-Deputy Attorney General, Karl W. Reidel-Executive Officer/Chief Investigator, Martin Silva-Investigator Supervisor, Farah Rodriguez-Commission Staff.
The meeting was opened at 10:35 a.m. by Commissioner Layman pursuant to provisions of the Open Public Meetings Act. N.J.S.A. 10:4-6 et seq. Notice of the Legalized Games of Chance Control Commission’s public meeting was provided by mailing a list of all regularly scheduled Commission meetings to be held during 2017 to the Office of the Secretary of State, Star Ledger, Trenton Times, and the Director of the Division of Consumer Affairs, and by posting in the State Building at 124 Halsey Street, Newark, New Jersey. That notice was also posted on the LGCCC website: state.oag/ca/lgccc.htm.
1. Reading and approval of the September 13, 2017 agenda.
ACTION: The Commission reviewed the September 13, 2017 agenda and on a motion by Commissioner Barrett, second by Commissioner Grusemeyer, unanimously voted to approve the agenda.
2. Minutes of the Public Session Meeting July 12, 2017 Minutes.
ACTION: After reviewing the minutes of July 12, 2017 the Commission, on a motion by Commissioner Barrett, second by Commissioner Grusemeyer, voted unanimously to approve the Public Minutes as amended.
3. Public Comment
Edward McGlynn, Esq., noted that the IAAPA Attractions Expo 2017 Conference and Tradeshow in Orlando, Florida will be held this year on November 13-17.

4. LGCCC statistics reports for June 2017 and July 2017 comparison to the reports from 2016.
The Commission reviewed the reports for June 2017 and July 2017 and noted the reports for the record.
5. Registration approvals and denials for July 2017 and August 2017.
ACTION: The Commission, on a motion by Commissioner Barrett, second by Commissioner Grusemeyer, unanimously voted to accept the list of approved and denied registrations for the months of July and August 2017.
6. Recommendations for approval or denial of Casino Operators, Manufacturers, Distributors, Providers, Compensated Workers and Game Submissions for July 2017 and August 2017.
ACTION: On a motion by Commissioner Barrett, second by Commissioner Grusemeyer, the Commission unanimously voted to accept the approved list of Casino Night Dealers for the months of July and August 2017.
7. Provisional Approval of Games for the September 13, 2017 Commission Meeting

ACTION: On a motion by Commissioner Barrett, second by Commissioner
Grusemeyer, the Commission unanimously voted to issue an Approval of
the noncompetitive skill games, electronic arcade games noncompetitive and electronic
group game competitive.

8. Proposed Schedule of LGCCC Meeting Dates
(Tabled from July 12, 2017 meeting)
ACTION: On a motion by Commissioner Barrett, second by Commissioner
Grusemeyer, the Commission unanimously voted to approve the
proposed meeting dates.
9. Saddle River Valley Lions Club – Raffle winner requests to assign prize (Ford
Mustang) to another organization by direct transfer of title between organizations.
ACTION: The Commission, on a motion by Commissioner Barrett, second by Commissioner, Grusemeyer, unanimously voted to have counsel review the matter.
[Note: The Commission was advised at the November 8 meeting that after the September 13 meeting the Lions Club was directed to award the prize to the winner – the person whose name appears on the ticket drawn in the raffle. If he declines the prize, the Lions Club is to draw a new winning ticket.]
10. Dumont Community Group - Reconsideration of Registration denial.
ACTION: The Commission, on a motion by Commissioner Barrett, second by Commissioner Grusemeyer, unanimously voted to approve the request for registration.
11. People Over Pipelines, Inc. - Reconsideration of Registration denial.
ACTION: The Commission, on a motion by Commissioner Barrett, second by Commissioner Grusemeyer, unanimously voted to deny the request for reconsideration.
12. Outreach for July 2017 and August 2017.
The Outreach for May 2017 and June 2017 was noted for the record.

14. New Business
The Commission reviewed existing protocols employed by licensed arcade operators to assure crane machine compliance and discussed updating and improving those protocols.

15. E.O.‘s Report
- E.O. Reidel informed the Commission of the hiring of two new investigators who will be introduced at the next Commission meeting.
- Dave & Buster’s submitted an application for an amusement game license; p an inspection of the Woodbridge, N.J. location will be conducted on October 26, 2017.

16. UPL Waive Hearing and Request Reconsideration
a. LG 17-77 Eugene Tenuto - Audubon, NJ

The Commission office received a letter from Eugene Tenuto, dated July 31, 2017.
ACTION: After consideration of the information set forth in the July 31, 2017 letter, the Commission was not persuaded by the mitigation offered and on a motion made by Commissioner Grusemeyer, second by Commissioner Barrett, unanimously voted to deny the reconsideration and sustain the penalty.
b. LGA 17-119 Coin Castle Amusements - Seaside Heights, NJ

The Commission offices received a letter from Wayne Cimorelli dated July 31, 2017.
ACTION: After consideration of the information set forth in the July 31, 2017 letter, the Commission, on a motion made by Commissioner Barrett, second by Commissioner Layman, voted to the reduce the penalty to $500.00. Commissioner Grusemeyer voted against the motion.
17. UPL Request Hearing
a. LGA 17- 123 Casino Beach Pier, LLC. – Pt. Pleasant, NJ
Investigator Bruce Hurlburt
ACTION: The Commission, on a motion by Commissioner Grusemeyer, second by Commissioner Barrett, unanimously voted to table this matter until the next Commission meeting.

18. MOVE TO EXECUTIVE SESSION
ACTION: The Commission, on a motion by Commissioner Barrett, second by Commissioner Grusemeyer, unanimously voted to enter into Executive Session to discuss investigative matters, deliberate, and seek advice of counsel. When and if action is taken, it will be reported in the public session.
19. RETURN TO PUBLIC
On a motion made in Executive Session, the Commission re-entered Public Session.
20. ADJOURN
ACTION: On a motion by Commissioner Grusemeyer, second by Commissioner Barrett, the Commission unanimously voted to adjourn the meeting at 1:40 p.m.
