RESOLUTION 01-07-17

"BEADLE COUNTY SPEED LIMITS & WEIGHT PER AXLE LIMITS"

WHEREAS, the County of Beadle, South Dakota, is responsible for the maintenance of certain highways under its jurisdiction,

WHEREAS, it appears that said highways, by reason of deterioration, rain, snow or other climatic conditions will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or restrictions as to the weight of vehicles are imposed, and

NOW, THEREFORE, pursuant to SDCL 32-14-6 and any laws amendatory thereto, be it resolved that effective February 15, 2017 (unless weather conditions deem it necessary to be on earlier) through April 30, 2017 the load limit on all Beadle County oil roads will be posted at 6 ton per axle. With the following exceptions:

1. Yale Road (411 Ave-County Road 31) from Highway 14 north to the Correction Line

(196th St County Road 8) posted at 8 ton per axle and 40 MPH for trucks. From the

Correction Line N on (411 Ave-County Road 31) to SD Highway 28, posted at 6

tons per axle and 40 MPH for trucks.

2. County Road 22 – Custer Ave from Highway 14 south to 4th St, posted at legal weight limits and for Trucks 40 MPH.

3. Morningside Main will be posted at legal load limits and 30 MPH.

IT IS FURTHER RESOLVED: that there shall be erected and maintained signs designating provisions of this resolution as provided by state law and that this resolution shall not be effective until or unless such signs are erected and maintained.

IT IS FURTHER RESOLVED; that the County of Beadle shall request the South Dakota Highway Patrol to enter the County of Beadle with scales adequate to weigh motor vehicles to insure compliance with State Laws pertaining to vehicle weight and with the weight laws established by this resolution.

NOW, THEREFORE, BE IT RESOLVED; That speed limit for trucks on all oil county roads within Beadle County, South Dakota shall be 40 MPH, effective March 1, 2017. Beadle County requests the South Dakota Highway Patrol Officers to enter the County of Beadle to enforce the speed limit of 40 mph for trucks on all Beadle County oil roads.

IT IS FURTHER RESOLVED; that this resolution be effective each and every year hereafter unless repealed or modified by duly enacted resolution.

The Board met with Robert R Nelson Patient Account Attorney for Avera Hospital concerning medical claims.

Moved by Mattke, seconded by Ramsell, motion carried to go into Executive Session pursuant to SDCL 1-25-2 (1) for personnel at 11:00 a.m. Vice-Chair Drake declared Executive Session over at 11:20 a.m.

Moved by Mattke, seconded by Benson, motion carried to accept resignation of Tyler Waldner as jailer effective January 31, 2017.

Moved by Benson, seconded by Ramsell, motion carried to authorize Doug Solem, Beadle County Sheriff to advertise for full time jailer.

Moved by Benson, seconded by Ramsell, motion carried to adopt the following resolution:

RESOLUTION 01-06-17

"NCFE AIR HURON LLC"

WHEREAS, NCFE Huron Air LLC, Huron South Dakota, is requesting permission to

operate, take off or land an aircraft on any county or township road in Beadle County, for

the purpose of servicing said aircraft in preparation for aerial application of chemical or

fertilizer materials, and

WHEREAS, NCFE Huron Air LLC has agreed to abide by the safety rules adopted by

the Aeronautics Commission which is granted authority by subsections 2 and 3 of Section

70:02:02:08 of South Dakota Administrative Rule under the authority of SDCL 50-2-2.1

and assume all liability when using said roads, and

NOW THEREFORE, BE IT RESOLVED: The Beadle County Commissioners in

regular session this 31st day of January, 2017 by unanimous vote, do hereby grant

permission to NCFE Air Huron, LLC to use said roads for requested use. Any signage that

is removed/damaged will be replaced to county specifications.

RESOLUTION 01-05-17

GRANT SUPPLEMENTAL BUDGET

WHEREAS, UNANTICIPATED REIMBURSEMENTS WERE RECEIVED FROM THE STATE OF SOUTH DAKOTA FOR STOP/VIOLENCE AGAINST WOMEN ACT GRANT. THE FOLLOWING ITEM WILL BE ADDED TO THE 2017 BUDGET YEAR.

231.434.411.01 STOP VIOLENCE D GRANT $ 5,086.80

231.434.427.01 STOP VIOLENCE D TRAVEL 1,047.00

231.434.428.00 STOP VILOENCE D PHONE 60.00

231.434.411.02 STOP VIOLENCE P GRANT 1,892.25

TOTAL $ 8,086.05

NOW, THEREFORE, BE IT RESOLVED, THAT THE BOARD OF BEADLE COUNTY COMMISSIONERS DO HEREBY PROPOSE, MAKE AND MOVE FOR ADOPTION OF THIS GRANT SUPPLEMENTAL BUDGET IN THE ITEM SET FORTH ABOVE.

Moved by Mattke, seconded by Ramsell, motion carried to approve Emergency Management Administrative Plan for Beadle County as presented by Zach Nelson, Beadle County Emergency Management Director.

Moved by Benson, seconded by Mattke, motion carried to adopt the 2017 General Policies for Beadle County Employees.

The board adjourned to meet next on Tuesday, February 7, 2017, at 9:00 a.m.
