Consent agreement: one year suspension and voluntary surrender of permit.Status of RegulationsRegulations for anesthesia permit holders: The PA Society for Oral and Maxiollofacial Surgeons (PSOMS) submitted comments on the regulatory package updating the requirements for anesthesia permit holders.PSOMS is requesting that the regulations specifically state in what instances dentists who administer oral sedatives would be required to obtain a restricted permit I.PSOMS would like the regulations to address the issue of when a permit holder fails to have an office inspection and clinical evaluation every six years before having to apply for a permit renewal. Technically, the dentist should cease administering anesthesia to patients. Board counsel advised that the board could draft a regulation stating that dentists must schedule an office inspection and clinical evaluation with the Anesthesia Review Committee at least six months prior to the expiration of the last inspection. Or the board could explicitly state in regulation that dentists must not administer because they do not schedule an office inspection and clinical evaluation before the six-year expiration and the permit has not yet expired.PSOMS would like new regulations stating that Certified Registered Nurse Practitioners (CRNAs) may not administer general anesthesia while teleconferencing with medical anesthesiologists. CRNAs would only be able to administer the anesthesia modality on par with the dentist’s permit level. Board counsel opined that she will need to consult counsel for the State Board of Nursing to avoid conflicts in each board’s regulations.PSOMS requested addresses for all licensees in order to inform them that permits are needed when “stacking” medications once the new regulations take effect.PSOMS requested that the board forward information on reports about adverse outcomes from the administration of anesthesia in dental offices (permit holders are required to file reports with the board within 30 days of an incident). PSOMS wants to track this information. Board counsel stated that reports must remain confidential and that staff would need to redact patient and provider personal information.The board plans to discuss PSOMS’ requests and recommendations at its May meeting.Restricted faculty licensure regulations: Board counsel drafted regulations that pertain to Act 89, a law providing for restricted faculty licenses in dental schools. The board will review these regulations.Civil penalty regulations: Board counsel had solicited stakeholder feedback in early 2015 and made minor revisions to the draft regulations raising civil penalties for licensees. The board will review the new draft.Child Abuse regulations: Board counsel revised current regulations to add new requirements under Act 31 for mandates reporters. Committee ReportsEFDA Committee: The committee is reviewing two EFDA program applications and awaiting for more documentation from other EFDA programs. PSI, which administers the certification test, is revising its test questions for review by subject matter experts.Licensure Committee: N/APractice Ownership Committee: N/AScope of Practice Committee: The committee will work with Board Counsel to finalize the draft anesthesia regulations.
