MEMORANDUM OF AGREEMENT (“AGREEMENT”)BETWEENEDUCATION ASSOCIATION OF PLYMOUTH AND CARVER (“ASSOCIATION”)AND PLYMOUTH SCHOOL COMMITTEE (“Committee”) Collectively referred to as the “Parties”Regarding the Reopening of Schools for the 2020-2021 School Year September 2020WHEREAS, The Committee and Association have engaged in good faith negotiations regarding the reopening of school for the 2020-2021 school year; and WHEREAS, absent a reasonable accommodation approved and provided by the District, or other mitigating reason approved by the District, Educators will be required to report to their school building or other assigned work location for the 2020-2021 school year to perform their work, unless directed otherwise by the superintendent; and WHEREAS, the Parties wish to memorialize their understanding regarding specific aspects of the school reopening plan for the 2020-2021 school year; and NOW THEREFORE, notwithstanding any contrary provisions in the Parties’ collective bargaining agreement or practices, the Parties hereby agree as follows for the duration of the 2020-2021 school year. Health and Safety Committee:The parties agree to establish and maintain a health and safety committee in the district. Said committee shall consist of Association representatives and District administrators. The Committee will meet at least once per week during the months of September and October, at a minimum. After October the committee will continue to meet on an as needed basis.Technology:Staff will use a consistent, District approved technological platform in order to help families navigate said platform appropriately. The District will continue to provide professional development and support.District approved platforms shall be, but not limited to:Seesaw grades K-2?Google classroom grades 3-12A bargaining unit members Primary Evaluator will have access to Google/seesaw classrooms in the role as a student to support teachers?Anyone entering into a Google Meet will have their full name and face visible at all times while in the Google Meet.Pursuant to relevant laws, no recording of an educator, students, or classes shall be made absent consent of all parties. Educators shall not be held responsible in the event a student makes an unlawful recording during their class. Grading K-12:Grades 6-12 shall be graded in a manner consistent with the regular school year (i.e. In person Instruction). Student assessments and report cards shall be issued in the manner outlined in the collective bargaining agreement (CBA) and the student handbook.The Parties shall establish a joint committee to review the elementary report card as initially planned during the spring of 2020.The Parties shall review the Kindergarten and Pre-School report cards/progress reports to assess the scope of standards assessed as well as the frequency of said reports. The Parties may modify said assessments by mutual agreement. Open HouseThe EAPC and the district will continue to have conversations regarding, Fall 2020 open house requirements.Educator EvaluationThe Educator Evaluation Instrument shall remain in full force and effect as outlined in the collective bargaining agreement, however, specific methods of instruction may vary based on the model in which instruction is being delivered to students (i.e. remote instruction, hybrid, or all in-person). If the Educator Evaluation Instrument requires modification to address unforeseen issues, the parties will meet to negotiate said modifications.Both announced and unannounced observations may occur in person, with the evaluator in the room, or remotely with the evaluator in the remote classroom for the remote only teachers. Any observations which occur in-person or in a remote classroom for the remote only teachers will require the evaluator to be visible or verbally announce their presence.In the event the 2020-2021 school year is conducted via remote learning, the Parties shall meet to negotiate further modifications to the Evaluation Instrument during the fully remote period. Such modifications shall only be in place for the fully remote closure period, and shall not establish a practice or precedent. The Parties acknowledge certain instructional strategies may not be feasible during hybrid or fully remote instruction models. In the event specific instructional strategies are not observed during hybrid or fully remote learning, Educators performance rating shall not be negatively affected. This shall apply to all four (4) standards of the Educator Evaluation Instrument.Guidance Counselors, Psychologists, Adjustment Counselors, all non-core specialized teachers (PT, OT, SLP, Reading specialists, academic coaches, etc.) & specialist teachers:For remote days the bargaining unit members in the above referenced positions shall present a tentative work schedule to their building principal. If they are a district wide employee their schedule will go to the principal of their “home” school, by the end of the work day the Friday before. Said schedule should outline the individual’s plans for each remote day of the following week, and include specific details (e.g. IEP meetings, coaching at Hedge with Teacher X, etc). The daily schedule should include 4.5 hours of scheduled tasks per day. NURSES:For remote days the nurses shall provide tentative work schedules to their direct supervisors as described in section 4 of this Agreement. Plans should include specific details (e.g. student check-ins, telehealth visits, attending related team meetings, classroom google meets, case management, etc.). The daily schedule should include 4.5 hours of scheduled tasks per day. SPECIAL EDUCATION:Special Education timelines and regulations have not been modified by state or federal regulatory agencies. Therefore, the District shall ensure all procedures and services delineated in IEPs will continue to be in place regardless of the model of instruction (i.e. remote instruction, hybrid, or all in-person). All applicable laws and regulations shall be followed in accordance with 603CMR28.00. per DESE guidance from July 9, 2020.SPECIAL EDUCATION TEACHERS:Inclusion Teachers or MSN’s who co-teach should be included in planning for instruction with their general education counterpart as well as any synchronous instruction sessions.Inclusion Teachers or MSN’s shall schedule times to provide “pull out” or C-Grid services in accordance with a student’s IEP. Services shall follow the approved schedule(s) for both hybrid and remote classes and deliver services in a manner consistent with all in-person instruction. Educators assigned to substantially separate programs must maintain in person instruction for students with disabilities and complex needs even if the school or district is operating in a hybrid model. Educators assigned to substantially separate classrooms should prepare to be full in person with students, including on remote Monday’s during the hybrid learning model. Task/Job responsibilities for Special Education Teachers shall remain constant (e.g. 504 Meetings, IEP meetings, Parent Communication, Testing, etc.). Every effort shall be made to conduct such meetings virtually. If an in-person meeting must occur, all health and safety protocols shall be adhered to.Health and Safety training for Parents and Students:Parents and students shall be offered training focusing on health and safety protocols related to COVID-19. Said training shall include protocols for each model of learning (i.e. in person, hybrid model, remote learning).Remote Learning Academies:Remote Learning Academies for grades K-6 will be staffed by select bargaining unit members. Site coordinators for grades 7-12 will also be staffed by selected members of the bargaining unit. SYNCHRONOUS LEARNING:Synchronous learning will take place at all academic levels in the increments outlined for said levels. Instruction may be broken into smaller, meaningful groups as deemed appropriate by the grade level teacher and align with the district curriculum. For example, the expectation will be that students will have synchronous learning during that time, not that direct instruction will take place for the entire period. REMOTE INSTRUCTION BLOCK: Specialist educators and MSN’s, who do not have students assigned to them for a specific period, shall have one (1) “Remote Instruction Block” per week. This block will be scheduled within the remote schedule through the guidance department and shall also take place on remote Mondays. Specialist educators and MSN’s assigned a “Remote Instruction Block” shall only be assigned said block within their content area (i.e. an electrical shop educator will only teach electrical classes, a music educator will only teach music class). The expectation for specialist educators during the Remote Instruction Blocks will be to review previously taught curriculum and offer support. Remote CCTE & Biomed Staff Expectations:Students will join weekly remote Monday Classes Students will connect with the teacher one (1) time per week for fifty (50) minutes consistent with the synchronous learning expectations contained herein. Educators shall be expected to teach the same lessons and share information with students in the remote learning block that was taught during their in-person classes.Students will be assessed and graded by the teacher of record. One teacher will be assigned based on the content area.? When there are multiple teachers in a program, teachers, if they wish, may share the instruction expectations on the synchronous learning day - however their rate of pay cannot exceed $180.00 per week in that program.??Staff assigned to the remote learning blocks shall be compensated at the rate of $60 (Sixty Dollars) per hour for up to three (3) hours per week for a maximum of $180 (One Hundred Eighty Dollars) weekly.This compensation shall be for educators teaching a remote learning block who already have a full schedule of six (6) periods.Agreed to on the date(s) indicated below.
