A company registered in England and Wales, registration number 11923819.Kavanagh Rescue (We/Us) are a breakdown, rescue & recovery Company. We deliver roadside assistance and recovery to vehicles that have rendered immobile. Please read these terms & conditions carefully. This document forms the basis of your agreement with us. It is important that you understand the extent of the service provided. If you are unsure or do not understand the following terms, please contact our customer services department who will be happy to assist. Kavanagh Rescue will provide the service that is requested by you. The agreement will only be in force once payment has been made.The service provided may vary depending on the severity of the immobilisation the vehicle has sustained.Services Provided Roadside Assistance / Home StartMisfuel assistance Battery AssistanceRecoveryFree Advice Line DefinitionsThe following words that appear in bold shall have the following meanings where ever they are communicated.Road Traffic Incident – Means the vehicle has been involved in an incident that has resulted in damage that may prevent the vehicle from driving or moving. Battery Assistance - is a call out where the battery on the vehicle is suspected to be at the end of life and a replacement is required to be supplied and fitted at the roadside Breakdown / Broken Down – Means the vehicle has become immobile due to a technical, mechanical or electrical failure which may include tyres, battery, and fuel system. Call Out- A call out is the service requested by you. There is a minimum charge based on the requested service. Database – The information kept by Kavanagh Rescue that identifies each vehicle, customer, registered address and details of service required and any other information provided by the customer.ETA – Estimated time of arrival. Free Advice Line – a service that will provide advice on faults that have occurred with a vehicle. Video / live feed maybe required for this service.Home Start – the vehicle is immobile at the place of residenceMisfuel / Misfuelling – the vehicle has been fuelled with the incorrect fuel type causing contamination.Roadside Assistance – This where the vehicle has become immobile at the side of the road and repair / temp repair is required.Recovery - The vehicle is unsafe or unrepairable or has sustained damage to render the vehicle un-driveable.Service Request- Means the request for assistance Temporary Repair – Is a repair affected at the roadside which enables the vehicle to continue until permanent repair is affected.Where a temporary repair is not possible, the vehicle may need recovery and further costs may apply depending on the vehicle type and distance to the required destination.We/Us/Our – Kavanagh RescueYou – The CustomerInformation Required for serviceYour Name The vehicle make, model, colour & registration numberExact Location or identifiable landmarkBrief description of faultContact detailsHome address Credit /Debit card details Cancellation of Call Out / Vehicle inaccessibleIf you cancel the requested service after booking a call out and have paid the required fee or the vehicle is inaccessible at the location that has been provided, there will be a cancellation fee.Breakdown on Private LandPlease ensure prior to calling us, that we will be lawfully able to access the vehicle. If the vehicle is not accessible, the cancellation fee in clause 5 will apply.Process for Payment All payments should be made by credit / debit card. Please note American express is not accepted. Payment will be taken by a customer service representative once a quote on price and agreement for service has been made. Guarantee/ WarrantyBatteries are warranted for a period of 3 years, from the date of original fitment to the original vehicle. The warranty does not cover any accidental damage, failure caused by an electrical or mechanical fault with the vehicle or errors by the user / owner which may result in a flat or damaged battery. The vehicle must be in regular use and cover a minimum of 2500 miles per year pro rata to maintain the battery in a serviceable condition.Whilst the battery carries a warranty, there maybe a charge for a callout. Limitation of Liability Kavanagh Rescue will try and affect repair or recover a vehicle without causing damage, however we realise that on occasion with certain tasks, damage may be caused.Kavanagh rescue cannot accept liability for Any further damage caused to a vehicle after we have advised not to drive before a full repair has been affected.Any damage that has been sustained before Kavanagh Rescue has attended.Any damage that may occur when entry into a vehicle is forced.Any electrical damage caused from disconnecting jump leads while the engine is still runningAny damage to wheels / tyres where the wheel nuts have not been checked for security after 30 miles / 50 km Any damage caused to private property while unloading such as driveways, manhole covers, walls and fencing etc. tis list is not exhaustive.Any further damage caused to electrical systems if a replacement battery is declinedAny further damage to a vehicle that has sustained severe accident damage Any damage caused by a customer that has taken advice from the free advice line and attempted repair either by themselves or by a third party.No responsibility can or will be accepted for any advice givenWe will make every effort to attend within the estimated time given. We will not accept any liability in respect of late attendance. We will not be liable for any consequences of the delay.This list is not exhaustiveComplaints Procedure It is the intentions of Kavanagh Rescue to deliver a professional service at all times and maintain professional conduct when dealing with all our customers.We realise that there maybe occasion where you do not feel you have received the service that you expected.Kavanagh Rescue takes all complaints very seriously and aims to resolve any issues within a reasonable timeframe, where possible.
