NURSING FACILITY ADMINISTRATOR LICENSURE

SECTION 1 - NURSING FACILITY ADMINISTRATORS ADVISORY COMMITTEE (NFAAC)

1. The Nursing Facility Administrators Advisory Committee (NFAAC) advises TDADS on licensing nursing facility administrators and recommend rules and minimum standards of conduct

2. The Nursing Facility Administrators Advisory Committee has 9 members appointed by the governor.

3. The NFAAC conducts disciplinary hearings for nursing home administrators who violate licensure standards and requirements

SECTION 2 - NFA LICENSE

1. A license is valid for 2 years

2. TDADS can deny a license to an applicant or revoke a license if the individual is sanctioned or found guilty of a felony in Texas or any other jurisdiction

3. An NFA must work at least 40 hours a week

4. A license application is submitted to TDADS

5. A nursing facility administrator's license is not transferable

SECTION 3 - PROVISIONAL LICENSE

1. A provisional license is issued to an applicant currently licensed in another jurisdiction who seeks a license in Texas.

2. The applicant is allowed to practice in Texas under the provisional license until they take and pass the state exam.

3. They are not required to retake the NAB exam or meet any other licensing requirements

4. The applicant must have been licensed and employed as an administrator of record for at least 2 years

5. The applicant must have a nursing facility sponsor and employ them in Texas during this provisional license

2. A provisional license is valid until the date the board approves or denies the provisional license holder's application for a license.

3. In any event, the board must approve or deny a provisional license not later than the 180th day after the date the provisional license was issued.

SECTION 4 - LICENSE RENEWAL

1. May renew a license by submitting an application, paying the renewal fee, submitting a criminal conviction fingerprint card and proof of 40 hours of continuing education credits

2. A person who failed to renew their license timely but renews within 1 year of renewal must pay a higher renewal fee

3. A person whose license has been expired for 1 year or more may not renew the license and must submit a new license application and meet all current licensing requirements.

4. A person who was licensed in this state, moved to another state, and is currently licensed and has been in practice in the other state for the two years preceding the date of application may obtain a new license without reexamination.

5. A license is renewed for an additional 2 years

6. A license can be denied a license or renewal if the default on a student loan

7. A license expires on the date printed on the license!

SECTION 5 -. INACTIVE LICENSE

1. May place a license on inactive status for 2 renewal periods (4 years)

2. Must complete 40 hours of CEUs for period license is in active status

3. If an inactive license expires, the licensee must submit a new license application, meet current requirements and retake the licensing exams

4. The licensee does not have to retake the NAB exam if they passed the NAB exam within the last 5 years

SECTION 6 - CONTINUING EDUCATION

1. Must complete a minimum of 40 hours of continuing education every 2 years.

2. Must complete 6 hours in Ethics each renewal period

SECTION 7 - CHANGE OF ADDRESS

1. Must notify the Department of change of home address of practice address

2. If employed by a facility, the licensee must notify TDADS within 30 days if they change employers

SECTION 8 - NFA COMPLAINT INVESTIGATION

1. The Professional Credentialing Enforcement Unit (PCEU) within TDADS receives all complaints against an NFA and reviews all cited deficiencies from facility surveys to determine if sanctions are warranted

2. Complaints are categorized into 2 priority levels:

Priority 1 – Complaints regarding physical and sexual abuse, neglect, serious injury or death (investigated within 24 hours)

Priority 2 – Complaints regarding all other conduct (investigated within 30 days)

3. After the PCEU completes an investigation, the final report is forwarded to the NFAAC to recommend appropriate sanctions if warranted

4. The NFAAC forwards its recommendation to TDADS which will make one of the following determinations:

a. Impose a sanction

b. Collect additional information

c. Dismiss the case

5. The board must investigate a complaint against an NHA within 30 days of receipt of the complaint.

SECTION 9 - SANCTIONS.

1. The department may impose the following sanction against a licensed administrator:

1. revoke

2. suspend

3. refuse to renew a nursing facility administrator's license

4. assess an administrative penalty

5. issue a written reprimand

6. require participation in continuing education

7. place an administrator on probation
