I hereby declare that I am a Proprietor of the vehicle stated in the above application for a Hackney Carriage/Private Hire Vehicle Licence and that the persons named are the names and surnames and addresses of the applicants herein and of every Proprietor or part Proprietor of such vehicle, or person concerned, either solely or in partnership with any other person, in the keeping, employing or hiring of such vehicle. This information is true to the best of my knowledge and belief.

APPLICANTS ARE ADVISED THAT TO KNOWINGLY OR RECKLESSLY MAKE A FALSE STATEMENT OR OMIT ANY MATERIAL PARTICULAR FROM THIS APPLICATION OR ANY DOCUMENT SUBMITTED WITH IT IS AN OFFENCE PUNISHABLE ON CONVICTION BY A FINE OF UP TO £400.

I/We the undersigned hereby apply to the Fylde Borough Council for a Licence under the Local Government (Miscellaneous Provisions) Act 1976 and Town and Police Clauses Act 1847 and 1889 for a certain vehicle, particulars of which are given above be subject to all conditions as may be contained in such Licence, and also to the provisions of the said Acts in force relating to Private Hire Vehicles all of which conditions and Acts I hereby undertake to observe and perform. I accept that if I infringe or neglect to comply with any of the conditions or provisions of the said Acts or bye-laws subject to which the Licence is held, the same shall be liable to be revoked or not renewed by the Council.

Notes:

1) For all new vehicle or renewal applications the vehicle registration document (log book) must be produced before an inspection appointment is allocated. In the case of recently purchased vehicles where the document is with DVLA Swansea, a Bill of Sale is suitable.

2) Prior to any licence being issued we shall require a valid insurance certificate for the vehicle and, if appropriate, a MOT Certificate. These documents do not have to necessarily be produced when arranging the vehicle inspection appointment, and may be produced when returning to the Offices following a satisfactory inspection.

3) For changes of vehicles, replacement plates will not be issued until the plates from the previous vehicle have been returned.

4) Fylde Borough Council’s Licensing Sub-Committee has adopted the following Policy to assist all persons named on a hackney carriage vehicle licence in the event of a dispute arising between the parties. The aim of this policy is to ensure that, notwithstanding any dispute between parties, the hackney carriage remains licensed for use minimising hardship to the parties concerned.

Disputes over interests in a hackney carriage vehicle licence must be resolved between the parties. The Licensing Sub-Committee does not consider that it is part of the Council’s Licensing function to determine issues which are outside the scope of the powers given to the Council under the Licensing Acts. Such disputes are matters for the individuals concerned to resolve, or in the event of a failure to resolve for the civil courts to determine. In certain exceptional circumstances the Council may agree, purely in an effort to assist the parties concerned, to perform a mediatory role.

It is the Council’s policy not to amend or alter a hackney carriage vehicle licence without the prior written consent of all the parties named upon the licence. The Council has adopted this policy to ensure that a licence cannot be amended or altered against the wishes of any of the parties.

However, the Council accepts that disputes between parties named upon a licence will arise and in the event of such a dispute arising the Licensing Officer will upon receipt of a renewal application, issue a renewal licence in the names of all parties on the current licence pending resolution of the dispute. This action will ensure that the livelihood of the parties will not be affected.

In the event of a party named on a hackney carriage vehicle licence disappearing without a forwarding address that party’s name will remain upon the licence for a minimum period of three years or until such time as notification, in writing, is received indicating that they no longer have an interest in the hackney carriage vehicle licence.

The Licensing Sub-Committee would remind all parties involved in the licensing of hackney carriages that hackney carriage licence plates are the property of Fylde Borough Council and that no other monies or fees are payable in respect of the plates save for those due to the issuing authority.
