ORDER

The Delhi Medical Council examined a complaint of Shri Pankaj Chadha r/o. C-7/2, Miya Wali Nagar, Paschim Vihar, Delhi, alleging medical negligence on the part of doctors of Maharaja Agrasen Hospital, in the treatment administered to him at Maharaja Agrasen Hospital

The Council perused the representation of Police, complaint of Shri Pankaj Chadha, written statement of Dr. R K Sharma, Senior Consultant Urologist, Maharaja Agrasen Hospital and copy of medical records of Maharaja Agrasen Hospital, RML Hospital and other documents on record as provided by the office of DCP West District, New Delhi.

Briefly stated the facts of the case are that Shri Pankaj Chadha (referred hereinafter as the patient), with a diagnosis of left renal calculus with diabetes mellitus with hypertension underwent left RGP + PCNL + DJ stenting on 17.8.2007 at Maharaja Agrasen Hospital. The surgical procedure was performed by Dr. R.K. Sharma, consultant Urologist. The patient was discharged on 19.8.2007 with advice to review in urology OPD. The stitches were removed on 31.8.2007 and the patient was booked for admission on 16.2.2008. Post-operatively stitches were removed on 31.8.2007. The patient subsequently received treatment at Dr. RML Hospital for complaints of urinary complaints and underwent DJ stent removal on 15.2.2008. It is alleged by the complainant that the DJ stent which was implanted in him on 17.8.2007 should have been removed after one or two weeks of the operation, instead he was neither advised nor the stent was removed as a result of which he suffered from severe pain. K. Sharma in his written statement averred that the stent is not to removed from the PCS in just 1-2 weeks but has to be kept for 6-12 weeks, which is done in cases of edema, infection & or to avoid post-op obstruction / leakage. Small fragments (upto 4 mm) may remain in the PCS after the process. Even doctors from Ram Manohar Lohia Hospital have clearly written in their treatment record dated 25.9.2007, that the stent was inside the PCS after PCNL, just 1 month after the operation.

In light of the observations made hereinabove, it is held that PCNL (Lt.) with DJ stenting was the appropriate procedure adopted for treatment of complainant’s condition. Patient did not report to the operating surgeon after stitch removal. Initial size of stone not known from records. Post operative u/s KUB and IVP reports show two residual stone (2 mm x 7 mm). This is possible if a large stone is removed by PCNL.

Prima facie no case of medical negligence is made out against doctors of Maharaja Agrasen Hospital.

Complaint stands disposed.
