Requirements of an Abstract of Title for Land Donations

1) Abstract must be current (within the last 6 months)

2) Prepared by a reputable title company

3) Certified to the State of New York

4) Contain a period search schedule showing the dates for which all parties in the chain have been run

5) Full runs should be made against all parties for the periods searched

6) All deeds, open mortgages and/other liens and encumbrances of record should be set out as items in the search

7) Searches should contain a full, legible copy of the deed(s) into the party making the donation. Such deed(s) should correspond with the deed(s) referenced on the appropriation map(s).

8) If multiple deeds and/or multiple searches are involved, the relevant items should be clearly identified by the donor, and related to tax parcels and appropriation map parcels.

9) A tax search should be provided for each tax parcel affected by the donation and be included in or accompany the title search.

10) A legible, unreduced copy of the portion of the tax map which covers the parcel to be donated should be included and clearly labeled.
