A motion to accept the minutes was made by Mr. Davis and seconded by Mr. Hutsell. Motion passed with a voice vote.LEGISLATIVE UPDATEDr. Smith recognized Mr. Jeremy Davis, Office of Legislative Affairs, and Tennessee Department of Health, who provided the board with a Legislative update. Mr. Davis updated the board on four (4) legislative bills that passed that may impact the EMS Board or licensee. General Counsel ReportMr. Hodges reported on the number of open cases in his office. Mr. Hodges reported on the Office of EMS legislation request and went over the two (2) bills that have come before the Board. Mrs. Tidwell discussed the compact bill that states are considering to allow EMS personnel to legally work across state lines during incidents when additional resources are needed but the event does not rise to level of disaster declaration. Mr. Hodges reported on the EMS Administration appeared before legislative committee in Sunset law hearing and the EMS Board is extended six more years. He also reported the legislation will be adding an attendance requirement to the sunset law. Members must attend 50% of annual scheduled meetings. The Director will be required to notify the Governor’s Office when a board member does not meet the required attendance requirement. Mr. Hodges reported the Mobile Integrated Health Care rules are in internal review process . COMMITTEE REPORTAir Ambulance CommitteeMr. Byrd presented three (3) items and requested permission to send forward for rule making. The Air Committee would like to address and update the rules for the following: Scheduling of flight crew i.e. length of shift time; .Crew configuration, recommending the medical director or flight physicians when flying, are consider part of the crew. Air ambulance equipment list that would mimic the ground ambulance equipment list.Mr. Hutsell motioned to send these items to rule making. Dr. Brooks seconded. Motion passed with a voice vote.REPORT FROM TENNESSEE PROFESSIONAL ASSISTANCE PROGRAM (TnPAP)Ms. Eliane Eaton presented the TnPAP report.CONSENT ORDERRespondent: Nicholas Eggert, EMT-IV License 39025, Bartlett, TNMr. Eggert was not on the agenda, Ms. Deshpande motioned to proceed with the consent order and Mr. Davis seconded. Motion passed with a voice vote. On or about October 13, 2013, witnesses observed Respondent driving an ambulance erratically and at a high rate of speed. Respondent was taken for a blood alcohol test the same day, the result of which was .201%, an amount over two-and-a-half the legal limit in Tennessee. Respondent was terminated from his employment. There was no known patient harm as a result of Respondent’s acts or omissions. For the purpose of avoiding further administrative action with respect to this cause, Respondent agrees to the SUSPENSION of his license to practice as an EMT-IV in the state of Tennessee, to be effective immediately upon ratification of this Order. Respondent may undergo an evaluation by TnPAP. Should the results of the evaluation recommend monitoring, and the Respondent signs a TnPAP monitoring agreement. Upon receipt by the Office of notification from TnPAP that Respondent has signed a monitoring agreement prior to or during the period of suspension, the suspension shall be STAYED and the license shall be immediately placed on PROBATION. The period of probation shall run concurrent with his or her monitoring agreement, but in no event shall the probation be less than three (3) years. Should the monitoring agreement be extended, the term of probation shall be extended to run concurrent with the new term of the TnPAP monitoring agreement. Respondent’s failure to maintain compliance with all of the terms of the monitoring agreement and the advocacy of TnPAP until the completion of the monitoring agreement and any amendments thereto will be a violation of probation and a violation of this order, and shall result in the immediate lifting of the stay of suspension. Respondent: Louis Davis, EMT-P License 32805, La Follett, TNOn or about February 19, 2015, the Tennessee Board of Nursing ratified a consent order; which was attached to the back of this order, in which Respondent admitted to diverting drugs while employed as a registered nurse at Baptist Memorial Hospital in Memphis, Tennessee from around May 2013 to August 2013. For the purpose of avoiding further administrative action with respect to this cause, Respondent agrees to the Suspension of his license to practice as an EMT-P. Said suspension shall be STAYED upon the ratification of this Order, however, and the license shall be immediately placed on PROBATION with the following terms and conditions. The period of probation shall run concurrent with his TnPAP monitoring agreement, but in no event shall the period of probation end before April 20, 2018. Should the monitoring agreement be extended, the term of probation shall be extended to run concurrent with the new term of the TnPAP monitoring agreement. Failure to maintain 100% compliance with the terms of the monitoring agreement and the advocacy of TnPAP will be a violation of the probation and shall result in the immediate lifting of the stay of suspension of Respondent’s license. On or about November 5, 2014 the Respondent and her partner responded to a scheduled hospital transport call involving an elderly male at a nursing home. Upon arriving at the patient’s bedside, the Respondent and her partner transferred the patient from his bed to a stretcher, at which point the patient became verbally abusive and attempted to hit the Respondent with his fist. The investigation showed that you were then verbally abusive to the patient in return, and that you threatened the patient with violence if he attempted to hit you again.This conduct is not consistent with the high standards that are required for a licensed health care professional. This letter is to REPRIMAND you for engaging in such conduct and can be used to enhance any punishment administered if you violate any statute, rule, or regulation which governs your AEMT licensure. This reprimand is a formal disciplinary action and is reportable to the National Practitioner Data Band or similar agency. Mr. Hutsell motioned to accept the LETTER OF REPRIMAND as written. During the call Respondent was repeatedly unable to intubate the patient. Patient’s oxygen saturation level began to plummet, Respondent refused to make any further intubation attempts, opting to wait for a helicopter from LifeFlight Vanderbilt instead. Upon arriving at the scene, LifeFlight was able to intubate the patient, who by this point was in cardiac arrest. Patient was transported and later died. On multiple occasions during employment, Respondent failed to complete run reports or failed to complete run reports within twenty-four (24) hours, and failed to comply with important service protocols, including the failure to run twelve (12) lead electrocardiograms on patients with chest pain. It is not known whether or not or to what extent Respondent’s acts or omissions caused any patient harm. For the purpose of avoiding further administrative action with respect to this cause, Respondent agrees to the VOLUNTARY SURRENDER of Respondent’s EMT-P license effective immediately upon ratification of this CONSENT ORDER by the Board. For the purpose of avoiding further administrative action with respect to this cause, Respondent agrees to the SUSPENSION, of her license to practice as an AEMT in the state of Tennessee, to be effective immediately upon ratification of this Order. Respondent may undergo an evaluation by TnPAP. Judge Cambridge then asked if Ms. Joyce Till or somebody representing her was here Mr. Hodges stated that they have talked to Mr. Shular and was not aware that Ms. Bonner was here. Mr. Hodges asked if they could take a brief break to talk to Ms. Bonner. Mr. Hodges informed the Judge that they will go ahead and move forward the cases. Judge Cambridge went over what the Board was expected to do with these cases. Judge Cambridge asked the Board to introduce themselves. Judge Cambridge asked Mr. Hodges if he had proof that they did notify Ms. Till of this hearing. Judge Cambridge did find sufficient evidence that the attempt to notify Ms. Till of this hearing was proven. Judge Cambridge then told the Board that it was up to them to decide to hear this case in default or to move it to another date. Dr. Brooks motioned to hear the case against Joyce Till in default. Respondent submitted to two (2) Breathalyzer tests the same day, both of which were positive for alcohol. Respondent’s employment was terminated effective February 28, 2013.Mr. Hodges passed out statements from Respondents coworkers, testifying to the fact she was under the influence, and the BAC. Judge Cambridge stated that this concludes the CONTEST CASES.SCHOOL APPROVALMrs. Tidwell stated that they were notified by Tennessee Technological University was closing their Paramedic Program. She also announced the University would entering into an agreement for Volunteer State Community College to continue the program on their campus. No action will be needed; Volunteer State is already an approved Paramedic program. Mrs. Tidwell stated that the Motlow State Community College Paramedic Program at the Shelbyville Center had partnered with State Fire and Code Training Facility will be ready for a site visit before the fall semester. COMMITTEE REPORTAmbulance CommitteeMr. Ward presented the report on behalf of Chair Jimmie Edwards, who was unable to attend today.. The Ambulance Committee was continue to review the purposed CASS standards and compare them to the KKK standards. Public comments on CASS concludes in July and the committee will then review the final version and make recommendations.Clinical Issues Committee (CIC)Dr. Holley reported the revision of the destination guidelines and stated that they are out for review. Dr. Holley discusse the Clinical Practice on the blood transfusion. Ms. Yeatman asked why they did not use blood products. Dr. Smith explained what the reasoning was. Mr. White asked when they would be able to see the trauma destination guidelines. Mrs. Tidwell stated that she would check to see if there had to be additional approval to change the wording on the clinical practice document for blood transfusion. Education CommitteeMrs. Tidwell reviewed the process the Office took in reviewing of the Continuing Education Hours (CEH’s) at the request of the Education Committe. After the Committee reviewed the results they are rcommending the list of hours before you for Board approval. Mr. Mosby stated his concern about the document. Mr. Davis motioned to accept the hours and Mr. Hutsell seconded. There discussion and concerns about the hours. Question was called and motioned passed with a voice vote with one apposed. Mrs. Tidwell informed the board the committee had voted to have a Subcommitteer to explore having an associate’s degree for paramedic license level. Mobile Integrated Health Care (MIHC)/Community ParamedicMr. Kevin Spratlin reported that the MIHC was requesting approval of the pilot courses of the education curriculum approved by the committee . Mr. Spratlin stated the Community Paramedic curriculum recommended was in use in several other states. Mr. White motioned to move forward with the pilot program with several seconds. Motion passed with a voice vote. Dr. Smith asked to look at the clinical practice document one more time. Mrs. Tidwell went over the changes that they are making. Mr. Hutsell motioned to accept the clinical practice with the changes and Dr. Brooks seconded. Motion passed with a voice vote. Task Force on Non-Transport Mrs. Tidwell reported the committee met and decided they need to look into this more. Mr. Hodges will look at the statue to see if they have the authority to license non-transport services. It was discussed should it be allowed they would like to see the license as optional not a requirement to license with EMS. Committee of Pediatric Emergency Care (CoPEC)In Ms. Phillippii absence Mrs. Tidwell distrubted the annual report that is reviewed by this Board. DIRECTORS REPORTMrs. Tidwell reported the Department rolled out the a new system in April . Mrs. Tidwell explained if the ambulance service license may be delayed due to the change of the new system. Should this delay become an issue the office will send letters of compliance and then send the license as soon as they are received in the office. The new triple K will go into effect in July and the biggest change is on the requirement for cot restraints. Mrs. Tidwell reviewed the National Registry Emergency Technician (NREMT) report. Mrs. Tidwell informed the board of the COOL program with veterns and current military can have the NREMT exam fees paid for them. Mrs. Tidwell presented an instructor course and asked the Board to approve this instructor course. Mr. Mosby motioned to accept the instructor course and Mr. Davis seconded. Motioned passed with a voice vote. Mrs. Tidwell informed the board of the TIMS training available to first response personnel to incidence on highways and interstates. This is the highway incident management course that will train them on how to make responses to accidents on the road safer. Mrs. Tidwell talked about the Sunset and gave the dated for the Instructor Conference July 8-10, 2015 in Murfreesboro. OLD BUSINESSThere was no old business. NEW BUSINESSMrs. Tidwell stated Mr. O’Neal Ellis would like to address the Board concerning lack of Critical Care training programs in the Memphis Delta Region. Mr. Ellis gave the Board a letter requesting board support in the establishment of a Critical Care Program in the Delta Region. Mr. Hutsell motioned to develop a letter for the Critical Care Program and Dr. Brooks seconded. Motion passed with a voice vote.Dr. Smith stated that they had a request from Jeff Fike to join the CIC and would like to approve him to join that Committee. There was a question as to how many are on that Committee and is there a need to add any more to it. Mr. White motioned to deny Mr. Fikes request to sit on the CIC and Mr. Davis seconded. Motions passed with a voice vote, with one (1) abstain. Mr. White asked there be a review of how members are appointed to committees. Dr. Holley agreed the Clilnical Issues Committee appointment needs reviewing. Dr. Smith asked if Dr. Holley and Tyler White work with the Office to bring recommendation for committee structure and appointment of members to the next board meeting. Dr. Smith stated there were concerns from the industry about the AEMT shortage. Tommy Copeland, Putnam County EMS Service Director, and Erin Downey, Rural Metro-Knox County Service Director, spoke to the Board and expressed his concerns about the shortage. Mr. White asked if they would benefit with a survey going out to see if these concerns work statewide or unique to a specific area. Mr. White motioned for the EMS office along with TASA to get a survey to the services for a better understanding and Mr. Davis seconded. Motion passed with a voice vote. Mr. Davis motioned to also get a survey from the schools and was seconded by several members. Motion passed with a voice vote. Meeting was adjourned. ................
