Topic: Cannabis Changes

Due to legislative changes of SB 2228, possession penalties for Cannabis less than 10 grams no longer results in a criminal charge. The Northeastern Illinois Regional Crime Laboratory will no longer accept Cannabis cases less than 10 grams for analysis. Exceptions will be made with direct contact by the State’s Attorney or Police Chief.

Additional legislative changes are also in effect regarding Cannabis (THC) levels while driving under the influence. The arresting officer has time restrictions on when blood for THC levels can be drawn from the driver of a vehicle (as required within 2 hours). Furthermore a lab has to determine the level of a drivers THC in the blood to be deemed driving under the influence of Cannabis. For this new law to be executed, submission of BOTH blood and urine is required. Below is an outline for testing procedures.

1) If testing confirms the level of 0.08 grams/deciliter of blood alcohol, no further analysis will be performed.

2) If blood is negative for alcohol, and the urine is confirmed positive for controlled substances (not including THC), no further testing will be performed.

3) If the urine screens positive for cannabis metabolites, but has no other controlled substances, the blood tubes for these cases will be sent to an outside lab for further analysis.

In the case of both blood and urine testing negative (alcohol in the blood, controlled substances and THC metabolites in the urine), the blood will NOT be sent to an outside laboratory for THC quantitation. Exceptions will be made under unusual circumstances.
