TERMS AND CONDITIONSINCLUDED IN SANCTUARY LODGE PROGRAMS: Prices are valid thru June 30, 2019 and include lodging accommodations with en suite bathrooms; all meals as specified; arrival and departure transfers from local airports (New Orleans being the farthest airport); fully-guided hunts; bottled water supplied during hunts; house wine, beer, spirits included with dinners (special note: alcoholic beverages are offered for moderate consumption and the bar closes at midnight); non-alcoholic beverages included with breakfasts and lunches, handling of two pieces of baggage per person; taxes, gratuities to Sanctuary Lodge staff, motorized 4X4 transport throughout the property. Meals of presented “family style” at the large timber table in the lodges main dining room and dietary restriction cannot be accommodated. Meals feature are delicious Southern home cooking. (Special Note: We can arrange a chef from New Orleans to prepare a special dinner with wine pairing for your group - which will be quoted as an additional enhancement.) For hunting clients who harvest an animal, the Sanctuary Lodge will field dress the animal and transport to a local wild game processing facility. NOT INCLUDED IN SANCTUARY LODGE PROGRAMS: Passenger Travel Protection and/or cancellation insurance, medical evacuation insurance, international and regional airfares; excess baggage charges, gratuities (see below); meals other than specified in the program literature; beverages other than noted in the literature; activities not included in the program; personal expenses such as laundry and communication charges, excursions off property, any items or activities not mentioned in the inclusions paragraph. Firearms, ammunition. Wild game processing and shipping are not included in the price, but can be arranged for an extra fee. We can recommend a local respected taxidermy shop, but do not guarantee the quality of the work.GRATUITIES THAT ARE NOT INCLUDED IN THE PROGRAM:Porters at the airports, drivers transporting guests from/to the airport. Hunting guides on the Sanctuary Lodge Property. Any other persons who have provided personal services to guests.HUNTING PROGRAMS:The Sanctuary Lodge features trophy White Tail Deer and Elk, both species are native to the state of Mississippi. The Delta Region of the state offers prime feed and temperate climates that promote maximum growth for these two species. Although trophy animals abound and our expert guides will locate these animals, a successful harvest cannot be guaranteed for any/all hunter(s). If a hunter harvests or wounds an animal during a hunt, regardless of the size and stature of the animal, that specific animal will be assigned to that hunter. The Sanctuary Lodge also reserves the right to withdraw any hunter who demonstrates conduct that is unsportsmanlike or unsafe to himself or others during the hunt. Sanctuary Lodge management and guides have the authority to prohibit any hunter who is, or is believed to be under the influence or alcohol or drugs before or during a hunt. Weather conditions, hunting conditions, animal sightings are beyond the control of The Sanctuary Lodge and cannot be guaranteed. ARRANGEMENTS: Quoted program prices include planning, handling and operational charges, and are based on current rates for this program and the services that are provided and are subject to change on or before June 30, 2019. If increases in these rates occur, The Sanctuary Lodge will notify guests who have booked programs and advise of any increases that may be passed through to guests in the form of a surcharge. The Sanctuary Lodge is under no obligation to give breakdown costs involved in any program within this program. Modification of program content to accommodate a smaller group size (less than 6 guests) may affect the per person price. IMMEDIATE CHECK-IN:The Sanctuary Lodge plans for new guest check-in to take place after 2PM. Based on flight times and travel schedules, guests may, at times, arrive early, and in these cases, the Lodge staff will do their best to accommodate these early arrivals, but immediate check-in to private accommodations cannot be guaranteedACTIVE ELEMENTS:The Sanctuary Lodge offers hunting in a hilly forested habitat that requires a varying degree of physical conditioning. We rate our program as “moderate” for the level of physical strain and severe weather/climate conditions that will be faced while participating in these programs. It is important to consider the degree of difficulty for these programs and prepare yourself accordingly. Preparation pertains to physical conditioning, mental preparation, and making sure you have the right clothing and equipment. SHOULD YOU HAVE ANY QUESTIONS OR NEED ANY CLARIFICATION A PLEASE ASK FOR DETAILS AT THE TIME OF BOOKING. CHILD POLICY:A minimum of 10 years of age is required to hunt. Minors must have passed the hunters safety course and have their license in their possession at all times when hunting. HUNTING LICENSES:Hunters must have the applicable MS State hunting and/or fishing license. WEAPONS:Rifles must be of 270 caliber for hunting White Tail Deer and Elk. The Sanctuary Lodge adheres to Mississippi State regulations pertaining to legal weapons and the season and caliber that they need to be. This also pertains to Primitive Weapons, Archery and Youth Gun standards and sizes. Guns and ammunition is the responsibility of the guests. Weapons can only be loaded and ready for firing in designated areas such as Stands and Ranges, and the hunter must be accompanied with the guide at all times.REGISTRATION AND PAYMENT SCHEDULE:For the hunts, a deposition of 20% of the total program price per person is required at the time of booking. Final payment is due 30 days prior to departure. If your reservation is made within 30 days of departure, the entire cost of the program must be paid the time of the request to secure confirmation. CANCELLATION CHARGES: For all hunting programs, cancellations received by The Sanctuary Lodge 90 days or more prior to arrival will be subject to a 10% per person cancellation fee; 89-31 days will be subject to 50% of the land price. 30 days or less will be subject to 100% cancellation. Trip cancellation insurance is strongly advised.CLAIMS AND REFUNDS: Refunds are not made for any missed services, except by verifiable extenuating circumstances. Please see our LIMITS ON SANCTUARY LODGE REPONSIBILITY clause. For verifiable claims to be considered, they must be received in writing within 30 days of the termination of the program and be accompanied by supporting documentation and/or a statement from the local destination management company verifying the claim. Any adjustment considered will be based on the actual price of the services involved and not on a per diem basis. Adjustments will not be made for unused segments of the expedition or meals. Sanctuary Lodge will not accept any liability for any claims that are not received within 30 days of the termination of your program. PHOTOGRAPHY DURING TRAVEL: The Sanctuary Lodge reserves the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. By booking a program with SL, guests agree to allow their images to be used in such photographs. Guests who prefer that their images not be used are asked to identify themselves to their guide at the beginning of their program. LIMITS ON SANCTUARY LODGE (SL) RESPONSIBILITY: Sanctuary Lodge, its employees, shareholders, officers, directors, successor, agents and assigns (collectively SL) does not own or operate any entity which is to or does provide goods or services for your program. It leases transportation, land and lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other affiliated SL companies). All such persons and entities are independent contractors. As a result, SL is not liable for any negligent or willful act of any such person or entity or of any third person.In addition, and without limitation, SL is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, hunting accident, animal attack, disease, acts of war, civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time. There are many inherent risks in hunting programs, which can lead to illness, injury or even death. These risks are increased by the fact that the Sanctuary Lodge is in a remote location, far from medical facilities. Guests assume all risk associated with participating in a Sanctuary Lodge program. ARBITRATION AGREEMENT:Any controversy or claim arising out of or relating to these TERMS AND CONDITIONS, to the LIMITS ON SANCTUARY LODGE’S RESPONSIBILITY clause, to the brochure, to any information relating in any way to the trip, to the trip itself, or to any products or services related to the trip, shall be settled solely and exclusively by binding arbitration in Louisiana, in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except that (a) in lieu of a personal appearance of arbitration, the arbitration may be conducted by telephonic means, (b) arbitration is the exclusive forum for dispute resolution (no court actions), and (c) except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees. GUESTS REPRESENTATIONS:Guest(s) represent that neither he nor she nor anyone traveling with him or her has any physical or other condition or disability that could create a hazard to himself or herself or other members of the tour. SL reserves the right to decline to accept anyone on a trip. SL reserves the right to remove from the trip, at his or her sole expense, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip. ANY PAYMENT TO THE SANCTUARY LODGE CONSITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN AND IN MORE SPECIFIC PRE-DEPARTURE PASSNGER DOCUMENTATION, INCLUDING THE PASSENGER INFORMATION FORM. WAIVER:Upon submitting the initial deposit, guest must read completely and sign The Sanctuary Liability Waiver. Signing this waiver signifies that the guest agrees to its terms and conditions and will hold The Sanctuary Lodge, its executives, officers, management and staff harmless in any/all cases when an accident or incident occurs on the Sanctuary Property and/or related to The Sanctuary Program that the guest(s) is participating in.ASTA TOP Operator ProgramThe Sanctuary Lodge is also a member of the American Society of Travel Agents TOP Program, open only to select tour operators.Travel AgentsA travel agent can enhance your trip by providing information and advice not contained in this brochure.
