STIPULATION AND ORDER

STIPULATION

Plaintiffs have moved the Court for an order granting a temporary restraining order and preliminary injunction with respect to the defendants. Defendants U.S. Department of Housing and Urban Development (HUD); and Alphonso Jackson, Secretary of the U.S. Department of Housing and Urban Development, in his official capacity hereby enter into this Stipulation to resolve plaintiffs’ Motion with respect to these defendants. For purposes of this Stipulation, defendants HUD and Jackson shall be jointly referred to below as “HUD”.

Plaintiffs and HUD hereby agree as follows:

The HAP contract has been extended through November 30, 2004. Pending a final determination of the plaintiffs’ claims on the merits, HUD has not and will not take any action which would deny enhanced voucher eligibility for those income eligible tenants in residence at Prince Hall as of the date of termination of the contract on November 30, 2004 or any subsequent extension date.”
