January 5, 2009

The Burlington City Council held their regular meeting January 5, 2009. Present were Jerome Gruenberg, Mayor, Diane Fugere, Auditor, Councilmen Wayne Walter, Tim Hoff, Brett Casavant & Jack Anderson. Also present were Keith Crabb, Clint Cogdill and Delvin Stemen.

Casavant moved to approve the minutes of the December 1, 2008 meeting, Hoff seconded and motion carried unanimously.

Walter moved to approve all bills and payroll, Anderson seconded and motion carried unanimously.

Clint informed council snow is piling up and he is running out of places to pile it. After much discussion, Clint and Dick will use the city loader and bobcat to push snow back from all city streets. Council will be contacted for approval of commercial snow removal in the event of the next substantial snowfall.

Diane reported Ruth Reisewig rented the city hall for Christmas and has requested a refund due to problems with mice. Walter moved to give Reisewigs a full refund on hall rent, Anderson seconded and motion carried unanimously.

Council instructed Diane to contact Ecolab Pest Control regarding the above matter.

TRANSFERS:

After review of 2008-year end fund balances Hoff, moved to transfer $850.00 from the police budget to the Police Vehicle Reserve Fund, Anderson seconded and motion carried on a unanimous roll-call vote.

Casavant moved to transfer an additional $400.00 from the Highway Fund to the Highway Equipment Reserve Fund, Walter seconded and motion carried on a unanimous roll-call vote.

Diane informed council she will be on vacation January 28 – Feb 1, 2009.

Council discussed correspondence received from Pringle & Herigstad regarding an opinion from Attorney General Wayne Stenehjem regarding prosecution of DUI charges in cities less than 5000 people lacking a law-trained judge. Any DUI’s cited by the Burlington Police Department would go directly to district court. The impact of this information on the police department budget was discussed. Officer Crabb reported to council that he will be attending a Police Chief meeting later this month and would have further information later.

A regular meeting of the Burlington City Council was held December 1, 2008. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Jack Anderson, Auditor Diane Fugere, Public Works Director Clint Cogdill, Police Sgt. Dennis Snodgrass, PW Assistant, Delvin Stemen, Engineer Ryan Ackerman and other members of the community.

Hoff moved to approve the minutes of the January 5, 2009 meeting, Casavant seconded and motion carried.

Anderson moved to approve bills and payroll as presented, Hoff seconded and motion carried.

Clint discovered frame cracks on the bobcat purchased last year and is concerned about further damage to the unit during regular use. He has spoken with the seller about turning it back with monies paid used as rental fees. Clint presented council a price on a new bobcat. Casavant moved to have Clint call for bids on a new bobcat, Anderson seconded and motion carried unanimously. Hoff moved to turn back the present bobcat to the seller, Anderson seconded and motion carried unanimously.

Dennis Snodgrass discussed information on DUI’s being deferred to district court and the impact it would have on the city budget.

Guy Smestad appeared before council to ask that the city maintain the alley between his residence and the two empty lots next to it. Stating he has maintained them for years and now wants the city to take over. No action was taken.

Bill Preston asked council about the positioning of the stop signs on Wallace and 3rd Avenue near the school. After discussion it was determined one of the signs had turned in the wrong direction. Mayor Gruenberg instructed Clint to correct the problem.

Regarding Bill Preston’s building permit #536, issued in April 2008, Bill informed council he is withdrawing the request to build at this time. Anderson moved to approve refunding the building permit fee to Bill, Hoff seconded and motion carried unanimously.

Paul Metz appeared as liaison to Ward County Sheriff’s office to address any issues the city may have.

Council reviewed the Water and Sewer Rate Study as presented by Ackerman-Estvold. Anderson moved to approve Alternate #1 with amendments, motion died for lack of a second.

Discussion followed regarding the proposed Capital Improvement Program 2009 – 2011. Anderson moved to approve Alternate #1 amended as follows:

9.80 Base water rate (includes 1000 gallons)

12.75 Base sewer rate

2.80 Each additional 1000 gallons/water

Casavant seconded and motion carried on a roll-call vote: Anderson – yes; Casavant – yes; Hoff – no.

Hoff moved to increase the water rate to out-of-town customers located across Hwy 2 & 52 to:

16.00 Base water rate (includes 1000 gallons)

2.80 Each additional 1000 gallons/water

Casavant seconded and motion carried on a unanimous roll-call vote.

Anderson moved to increase the water rate to Old Settlers Park to 2.80 per 1000 gallons with no change to the base rate, Hoff seconded and motion carried on a unanimous roll-call vote.

Diane reminded council that an ordinance for purchasing water for distribution to residents must be submitted to the voters for approval. Council instructed Diane to begin this process and contact the city attorney for legal assistance.

After review of the final draft of the Joint Powers Agreement, Hoff moved to accept the rates as approved by the Joint Powers Board at their January 22, 2009 meeting, Casavant seconded and motion carried unanimously.

Council reviewed a snow removal expenses report, which will be submitted to the State for partial reimbursement.

After review of a letter from Bremer Insurance regarding flood insurance for city property due to above normal snowfall council determined no action was necessary.

Diane will be attending the ND League of Cities March Madness workshop in Bismarck March 24-26.

Council reviewed the new enterprise account numbers associated with the Joint Powers Agreement.

Diane was given approval to apply for grants for playground equipment.

Diane and Clint will attend a Workforce Safety Insurance meeting in Minot on February 26.

With fines expected to be under budget by $7000.00, council discussed cutting costs relating to fines. Hoff moved to eliminate the clerk of court position effective immediately, Anderson seconded and motion carried on a unanimous roll-call vote.

With no further business to come before the board, Anderson moved to adjourn, Hoff seconded, motion carried.

A special meeting of the Burlington City Council was held February 18, 2009. Present were: Jerome Gruenberg, Mayor, council members Wayne Walter, Brett Casavant, Jack Anderson, Diane Fugere, Clint Cogdill, Ryan Ackerman and John Lund. The purpose of the meeting was to pass on 2nd reading an ordinance granting the City of Burlington the authority to enter into a contract to purchase water for distribution.

Anderson moved on 2nd READING TO APPROVE AN ORDINANCE GRANTING TO THE CITY OF BURLINGTON THE AUTHORITY TO ENTER INTO A CONTRACT TO PURCHASE WATER FOR DISTRIBUTION.

BE IT ORDAINED THAT:

Section 9-124.

1. The City may contract to purchase water at wholesale from any person, firm, public or private corporation, or limited liability company able and willing to furnish the same, upon such terms and during such period, not exceeding 40 years, as the city governing body shall deem appropriate. In entering into such contract, the City shall:

A. Establish and maintain rates and charges for supplying water by it to its inhabitants and industries, either according to a prescribed schedule agreed upon, or sufficient to produce net stated amounts for specified periods during the life of the contract, or both, and to appropriate and use the same for payments to become due under the contract and if the contract so provides, the City shall be obligated to pay for such water solely out of such net revenues;

B. Pay an agreed rate or rates for all water taken by the city under such contract and not resold by it; and

C. Do and perform any other acts or things which is the discretion of the governing body are deeded reasonable and appropriate for the procurement of such water on the most efficient and economical basis.

Anderson seconded and motion carried on a unanimous roll-call vote.

The Burlington City Council held their regular meeting March 2, 2009. Present were: Council President Tim Hoff, Council Members Brett Casavant, Jack Anderson, Wayne Walter, Auditor Diane Fugere, Public Works Director Clint Cogdill, Police Sgt. Dennis Snodgrass, Police Chief, Keith Crabb, PW Assistant, Delvin Stemen.

Walter moved to approve the minutes of the February 2, 9, 11 & 18, 2009 meetings with amendments as follows: February 2, 2009 meeting: change December 1, 2008 to February 2, 2009 and to add Tim Hoff as present at the February 18, 2009 meeting; Anderson seconded and motion carried.

Walter moved to approve bills and payroll as presented, Casavant seconded and motion carried.

Officer Dennis Snodgrass explained the Law Enforcement Records Management System (LERMS) to council. At a cost of $25.00 per officer, per month, the program, operated by the state, would take care of all requirements of the police department in scanning tickets, reporting to state and council and a variety of other options. Walter moved to approve installation of this program, Casavant seconded and motion carried unanimously.

Council reviewed a letter from United Community Bank regarding pledged securities and determined they are adequate to cover our investments.

Diane reported the approval of a grant totaling $2,277.00; ($1138.50 city share; $1138.50 grant portion) from the North Dakota Department of Commerce for installation of a new shop furnace. Anderson moved to accept the grant monies and approve purchase of a new shop furnace, Walter seconded and motion carried on a unanimous roll-call vote.

Clint asked council for approval to remove the old water tank during construction of the new walking path. Council gave approval.

Diane presented the ND Department of Health Lab Contract for renewal, Walter moved to approve, Casavant seconded and motion carried on a unanimous roll-call vote.

Diane reported on the new safety management program through Workforce Safety and qualifying for up to a 25% premium discount involving self inspections, new policies, new hire training, safety training and online courses. After review, Casavant moved to approve the Safety Committee Charter as presented, Walter seconded and motion carried on a unanimous roll-call vote.

Casavant moved to assign Diane Fugere Employer Safety Coordinator, Walter seconded and motion carried on a unanimous roll-call vote.

Casavant moved to assign Diane Fugere Employer Workers Comp Claims Coordinator, Walter seconded and motion carried on a unanimous roll-call vote.

Clint asked about a new storage area for office supplies and suggested using the space at the end of the bathroom hallway. Walter moved to approve remodeling for this project, Anderson seconded and motion carried on a unanimous roll-call vote.

The DeSour Valley Economic Development Corporation has asked about the possibility of the council passing a resolution for property tax incentives for new residential construction. Anderson moved to approve the following committee to study the impact of this proposal:

Clark Ranum – Burlington-Des Lacs School Darla Jost – DeSour Valley EDC

Paula Bachmeier – Burlington Resident

Casavant seconded and motion carried on a unanimous roll-call vote.

The Burlington City Council held their regular meeting April 6, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Wayne Walter, Diane Fugere, Clint Cogdill, Dennis Snodgrass, Keith Crabb, Delvin Stemen, Ryan Ackerman, John Pietsch and members of the community.

Walter moved to approve the minutes of the March 2, 17 & 23, 2009 meetings, Hoff seconded and motion carried.

Walter moved to approve bills and payroll as presented, Casavant seconded and motion carried.

Minot Chrysler suggested to Officer Snodgrass the rear differential needs flushing in the Crown Vic. There was no action taken at this time.

Dustin Clementich addressed council about the frozen water line at his residence at 6 2nd Avenue. After review, council discussed installing a new service line due to the inadequate depth of the present line. Hoff moved to pay for repairs from curb stop to main, Walter seconded, motion carried. Council asked that Clementich check into possibility of boring to minimize street damage and work with Clint on these repairs.

After reviewing letters of support for passing a resolution granting property tax exemptions, Casavant moved to approved RESOLUTION GRANTING PROPERTY TAX EXEMPTION PURSUANT TO 57-02-08(35), N.D.C.C. AND 57-02-08(36), N.D.C.C.

WHEREAS, the City of Burlington, acting by and through its duly elected representatives desires to encourage the construction of new residential dwellings; and WHEREAS, North Dakota statutory law authorizes the Burlington City Council to grant exemptions up to $75,000 of the true and full value of residential dwellings for single family homes, condominiums, and townhouses; and WHEREAS, the City of Burlington presently does not have an existing resolution establishing an exemption from real property taxation;

NOW THEREFORE, be it resolved by the City Council of the City of Burlington, that, pursuant to sections 57-02-08(35) and (36), N.D.C.C., $75,000.00 of the true and full value of all new single family residential property, exclusive of the land on which it is situated, is exempt from taxation from the first two taxable years after the taxable year in which the construction is begun.

BE IT FURTHER RESOLVED, that up to $75,000.00 of the true and full value of all condominium and townhouse residential properties, exclusive of the land on which it is situated, is exempt from taxation for the first two taxable years after the taxable year in which construction is begun.

The exemption from taxation authorized by this resolution shall only be effective if all special assessments and other taxes on the property are not delinquent. Further, the first occupant of the property after construction is completed must own the property, Walter seconded and motion carried on a unanimous roll-call vote.

City engineer, Ryan Ackerman, along with Ward County Water Resource Board Chairman, John Pietsch reported on flood conditions in the city limits. There are several areas of concern and the city needs to mobilize all resources for filling sand bags and building dikes. A meeting was scheduled for April 7 with council, fire department, Ward County Sheriff’s office, Corp of Engineers and other entities.

Hoff presented the following building permits to council:

Walter moved to approve, Casavant seconded, motion carried unanimously.

The rest of the media has arrived with installation scheduled for the first week in May. However, with flooding issues in the city, media installation has been postponed to a later date.

Engineer Ackerman will put together a proposal for splitting the sewer force main at the lagoons for the next regular meeting.

Clint is to get estimates for capping Wells 1 & 2 for the next regular meeting.

Discussion followed regarding offering free advertising on the access channel for the months of May and June to anyone in our viewing area. Hoff moved to offer access channel advertising free of charge, one week at a time, requiring a phone call each week to continue the ad, Walter seconded and motion carried unanimously.

Diane presented the Minot Hockey Boosters gaming licenses for renewal. Walter moved to approve renewal, Casavant seconded, motion carried unanimously.

Council gave approval for Diane to attend the MSU Municipal Finance Officers Institute in June.

Clint asked about renting a hot tar machine to seal cracks at a cost of $1400.00 plus estimated $2000 for materials. Council approval was given.

Clint informed council of receiving his Class II license.

Council reviewed pledged securities and determined them adequate to cover our investments.

With no further business to come before the board, Hoff moved to adjourn, Casavant seconded, motion carried.

The Burlington City Council held their regular meeting May 4, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Wayne Walter, Jack Anderson, Auditor Diane Fugere, Clint Cogdill, Dennis Snodgrass, Delvin Stemen, Ryan Ackerman, Glen Stevens, Dodie Stevens, David Thacker & Kevin Archer.

Casavant moved to approve the minutes of the April 6, 9, 24, & 29, 2009 meetings, Walter seconded and motion carried.

Walter moved to approve regular bills and payroll as presented, Anderson seconded and motion carried.

Officer Dennis Snodgrass informed council of complaints about visual nuisance at 2 Willow Street, namely excessive autos. Council tabled the matter for ordinance reference.

Glen Stevens presented plats of Olt 38 & 39 moving boundary lines due to the sale of his Nursery business.

Engineer Ackerman reported that the road right-of-way must be excluded from both plats as presented.

Casavant moved to approve plats of Olt 38 & 39 contingent upon removal of the road right-of-way from the outlot, Walter seconded and motion carried unanimously.

Dodie Stevens presented a plat of Olt 40 proposing to adding 10 acres of the nursery property to their homestead. Anderson moved to approve the plat, Hoff seconded and motion carried unanimously.

After review of the city’s nuisance ordinance, council instructed Officer Snodgrass to send a letter to Ken Faris, 2 Willow Street giving a deadline to comply with the city’s ordinance regarding visual nuisance.

Diane presented FEMA’s Designation of Applicant Agent form. Casavant moved to appoint Diane Fugere Applicant Agent, Hoff seconded, motion carried unanimously.

Clint reported the media installation is still on hold until all flood work is completed.

Diane presented history of West River’s past due water/sewer bill for review. Engineer Ackerman indicated it would be addressed at the next Joint Powers Board Meeting.

Dave Thacker appeared for review of his building permit #555, single-family residence and 16x24 shed. Mr. Thacker asked council for permission to move in a newer model singlewide trailer to live in during construction of the residence. He presented signed, written approval of neighbors for the trailer during construction. Walter moved to approve the building permit allowing the trailer for up to 365 days beginning June 1, 2009, Anderson seconded and motion carried on a unanimous roll-call vote.

Engineer Ryan Ackerman reported to council that cleanup of sandbags in residents yards is the responsibility of the city. Council decided the city would contract for cleanup. Hoff moved to give Clint approval to solicit estimates and contact council member with results, Walter seconded and motion carried unanimously.

The Corp of Engineers will contract for removal of the Hesco barriers. Council asked that Kevin and Clint handle this. Clint or the police department will contact property owners regarding cleanup. Ryan and Clint will assess damage to city streets.

Diane presented the following list of expenses due to flood relief efforts, Casavant moved to approve, Walter seconded and motion carried on a unanimous roll-call vote.

Council member Tim Hoff thanked all who helped with the flood control operations.

The Minot Daily News was designated as the city’s official newspaper.

The Burlington City Council held their regular meeting June 1, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Wayne Walter, Jack Anderson, Auditor Diane Fugere, Clint Cogdill, Dennis Snodgrass, Keith Crabb, Delvin Stemen, Ryan Ackerman, Karter Lesmann, Ryan Schwandt & Ken Kraft.

Walter moved to approve the minutes of the May 4 & 6, 2009 meetings, Anderson seconded and motion carried.

Walter moved to approve regular bills and payroll as presented, Casavant seconded and motion carried.

Officer Crabb reported the thermal imager was damaged while in the custody of the Minot Police Department.

Cost to repair totaled $1450.34. A bill for the damages was sent to the City of Minot.

**Ken Kraft appeared before council for approval of building permit #562 for a 10x37 garage requesting a variance of 3’ from the side yard. He provided a letter from his neighbors stating: “We, Todd and Connie Hauser, wish to grant permanent permission to Ken and Tammy Kraft, to build a structure within ½ foot to 1 foot of our property line at #5 Fiesta Drive, Burlington, ND. We have no concerns about this matter. We would like the City of Burlington to grant permission for this structure to be built.” Todd and Connie Hauser signed this statement. With this information, Casavant moved to approve building permit #562 allowing the requested 3’ variance on side yard, Anderson seconded and motion carried unanimously.

Ryan Schwandt, dba Hacienda Restaurant and Jack Anderson, dba Idle Hour Bar, appeared for approval of their annual liquor licenses. Casavant moved to approve both licenses, Walter seconded and motion carried unanimously with Anderson abstaining.

*Karter Lesmann appeared before council regarding building permit #560 for a 10x30 garage requesting a 7’ variance from main structure stating he would fire rock all interior walls within 10’ of the house. Anderson moved to approve building permit #560 with 7’ variance as requested, Walter seconded and motion carried unanimously.

Council reviewed a letter from Rich Pardon stating concerns with Aggregate Construction possibly installing a gravel crusher and the mining of a gravel operation, which borders his property. Mayor Gruenberg will follow up on this matter with Ward County in his capacity as County Commissioner.

Discussion followed regarding allowing golf carts, ATV’s, & snowmobiles on city streets. Chief Crabb will put together an ordinance following state law for the next meeting.

Clint updated council regarding ongoing flood cleanup. Sandbags and Hesco baskets have been removed with damage to resident’s yards yet to be repaired. Council instructed Clint to bring in black dirt and seed grass in the effected yards.

Council reviewed a bill from Tony Theilan requesting reimbursement for renting a bobcat to remove sandbags from his yard. Walter moved to approve paying this bill, Casavant seconded and motion carried unanimously.

Clint and city engineer Ryan Ackerman assessed street damage due to flood control efforts and will be putting together an estimate of damage. Diane will report this to ND DES.

Council acknowledged Circle Sanitation’s correspondence donating a 20-yard dumpster to the city for flood cleanup.

Ryan updated council on walking path construction to begin this spring. The Project Concept Report was presented and signed by Mayor Gruenberg.

Council agreed to allow use of 50 chairs free of charge to the Roughrider Chili Society for the chili cook-off, as they are a non-profit organization.

Clint reported Bechtold Paving would be patching the street by Opland’s house at 311 Valley Avenue and Dustin Clementich at 6 2nd Ave.

Ryan will get bids on the RV Dump Station for the next regular meeting.

Clint reported commercial water sales with S & S Trucking have resumed.

Diane reminded council to review the correspondence in their packets regarding root cause analysis and early claim reporting; part of the city’s Workforce Safety discount program. Mayor Gruenberg then reiterated the importance of early claim reporting.

Mayor Gruenberg, as a member of the NDLC Executive Board Nominating Committee, asked council members to consider running for a position on the NDLC Executive Board in the upcoming election.

The Burlington City Council held their regular meeting July 7, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Wayne Walter, Auditor Diane Fugere, Public Works Director Clint Cogdill, Chief Keith Crabb, PW Assistant, Delvin Stemen, Engineer Ryan Ackerman and Ken Faris.

Hoff moved to approve the minutes of the June 1, 2009 meeting, Casavant seconded and motion carried.

Walter moved to approve bills and payroll as presented, Hoff seconded and motion carried.

Clint asked about purchasing a finishing lawn mower, as he is unable to keep up with mowing. He found a used pull-behind finishing mower for $1100. Walter moved to authorize Clint to demo the unit first and purchase if suitable for city use. Casavant seconded and motion carried unanimously. Hoff also instructed Clint to look for a 3-point finishing mower for comparable price and purchase at his discretion.

Clint asked about selling the city’s cold pour pump for street sealing. Approval was given by council.

Officer Crabb asked for council approval to upgrade the plan on his city cell phone, which would result in an additional $10.00 per month, which Crabb would reimburse to the city. Council gave approval to upgrade 500 minutes and reimburse the city for the increase monthly.

Keith reported applying for a grant for in-car cameras for the police vehicles.

Keith needs someone to do dictation for police reports. Casavant moved to add this duty to the job description of the Deputy Auditor, Walter seconded and motion carried unanimously.

Ken Faris appeared before council to address the visual nuisance at his 2 Willow Street residence. Photos of the area provided by the Burlington Police Department were reviewed. Council consensus was that the area was improved and was no longer unsightly. Mr. Faris was asked to keep things neat and orderly in the future.

Walter moved to approve on 1st Reading BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BURLINGTON, NORTH DAKOTA THAT:

SECTION 10-801 BE AMENDED AS FOLLOWS:

Remove all:

Section 10-802 Restrictions on ATV/Snowmobile Operations; Exceptions; Conflicts with Other Provisions.

Add:

Section 10-801.1 All Terrain Vehicles

The City of Burlington shall follow the NDCC, Chapter 39-29-01 through 39-29-12.

Section 10-802. Snowmobiles

The city of Burlington shall follow the NDCC, Chapter 39-24-01 through 39-24-09.

Change Section 10-804 to:

The City of Burlington shall follow the NDCC, Chapter 39-29.1-01 through 39-29.1.09

Section 10-804. Low Speed Vehicles. Definitions.

1. “Low speed vehicle” means a four-wheeled vehicle that is able to attain a speed, upon a paved level surface, of more than twenty miles (32 kilometers) per hour in one mile (1.6 kilometers) and not more than twenty-five miles (40 kilometers) per hour in one mile (1.6 kilometers) and may not exceed three thousand pounds (1361 kilograms) in weight when fully loaded with passengers and any cargo.

Section 10-804.1 A low speed vehicle is a motor vehicle under this title, except:

1. Registration of a low-speed vehicle is governed by this chapter

2. A political subdivision may not require licensing or registration of low-speed vehicles.

3. The governing body of a city may regulate, restrict, or prohibit the use of low-speed vehicles operating in the city limits in areas under the jurisdiction of the city.

Hoff seconded and motion carried unanimously.

Clint reported all flood cleanup, fence repair and landscaping has been completed.

Media replacement is scheduled for the week of July 13 – 17. Council approved paying independent contractors at a rate of $12.00.

Engineer Ryan Ackerman stated all information regarding street damage has been reported to FEMA and NDDES.

Keller Paving requested an extension on the paving project for Rowan Addition. Council denied this request at the request of the developer. Ryan recommends sending a letter to the bonding company giving a 20-day deadline to complete the job. Hoff moved to give approval to Ryan to draft such letter to Keller giving no extension, with penalty in place, Walter seconded and motion carried unanimously.

The Project Concept Report on the new walking path has been sent to the state. Ryan is unsure of topcoat makeup at this time, due to the roughness of the terrain, cost overrun and limited funding.

Council approved signing a Community Military Covenant showing the city’s support for veterans, service members and their families.

Fees for mosquito spraying in Berthold were discussed. The city’s charge will be $25.00 per hour for equipment plus material costs.

Andy Fimrite requested permission to remove existing curb in order to enlarge the driveway at his building at 15 Johnson Street (Old Fire Hall). Council approval was given.

Diane reported on commercial water sales for the month of June. Sales could be increased with a larger and faster fill-station. Ryan was instructed to put together proposals for upgrading and enlarging our existing fill-station or possible construction of fill-station for commercial water sales.

The city received one-time funding from the State of North Dakota (SB2012) for street-related purposes due to the excessive snow and flooding. These funds are to be spent before year-end. Clint will look into options for street equipment and report at next meeting.

Diane reported Rod Schwandt as building inspector and Linda Schwandt as meter reader have been changed to employee status, as they do not qualify as independent contractors. As such, they are to be added to the city’s workers comp and unemployment insurance.

The ND League of Cities convention is in Minot this year. Council advised that employees and spouses signed up for the convention would be obligated to attend. Those signed up who do not attend will be required to reimburse the city for registration costs.

Council reviewed correspondence from the Ward County Water Resource Board regard flood prone areas at Valley Meadow Addition. They are requesting that any further construction be stopped immediately until a hydrology study can be conducted which would allow any additional building to conform to FEMA guidelines. Further stating; if any building continues in flood prone areas or the flood way of the Souris River, they would not be providing resources to alleviate flooding. Diane reported delivery of a copy of the letter and plat to Darla Jost.

Diane reported receiving a complaint about vehicles, campers and a concession stand parked on the grass across from Railway Street. Officer Crabb was instructed to speak to all owners and have these items removed immediately.

Diane asked council about purchasing a weed whacker for the Fire Department for use on the trees located on the Fire Department property. The city obtained these trees through a tree grant in 2007. Walter moved to approve purchase of a weed whacker for the fire department, Hoff seconded and motion carried unanimously.

Diane presented the ND Department of Health Lab Service Contract for approval. Walter moved to approve, Casavant seconded and motion carried on a unanimous roll-call vote.

The legal location of this property is Lot 4, Sec 36-156N-84W. Building Inspector Rod Schwandt recommended the property owner verify that he is in the 100 year flood plain and not the flood way. After review of the flood plain and flood way, action was tabled for proper documentation for development in a flood way and flood plain with a recommendation to follow the FEMA and State Water Commission’s guidelines for building in a flood zone.

Council discussed planting lilac bushes at the end of Soo Street as a living snow fence; approximate cost $500. Hoff moved to approve, Walter seconded and motion carried unanimously.

Keith asked about the possibility of replacing the Crown Vic in 2010. He will check on autos at the State Auction at approximately $6000 and report to council.

The Burlington City Council held their regular meeting August 3, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Jack Anderson, Wayne Walter, Auditor Diane Fugere, Public Works Director Clint Cogdill, Police Chief Keith Crabb, PW Assistant, Delvin Stemen, Darla Jost and Terry Getzlaff.

Hoff moved to approve the minutes of the July 6, 2009 meeting, Walter seconded and motion carried.

Walter moved to approve bills and payroll as presented, Anderson seconded and motion carried.

Terry Getzlaff appeared to ask about parking vehicles across the street from his home on city property.

Walter moved to approve on 2nd Reading: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BURLINGTON, NORTH DAKOTA THAT:

SECTION 10-801 BE AMENDED AS FOLLOWS:

Remove all: Section 10-802 Restrictions on ATV/Snowmobile Operations; Exceptions; Conflicts with Other Provisions.

Add: Section 10-801.1 All Terrain Vehicles

The City of Burlington shall follow the NDCC, Chapter 39-29-01 through 39-29-12.

Section 10-802. Snowmobiles

The city of Burlington shall follow the NDCC, Chapter 39-24-01 through 39-24-09.

Change Section 10-804 to:

The City of Burlington shall follow the NDCC, Chapter 39-29.1-01 through 39-29.1.09

Section 10-804. Low Speed Vehicles. Definitions.

2. “Low speed vehicle” means a four-wheeled vehicle that is able to attain a speed, upon a paved level surface, of more than twenty miles (32 kilometers) per hour in one mile (1.6 kilometers) and not more than twenty-five miles (40 kilometers) per hour in one mile (1.6 kilometers) and may not exceed three thousand pounds (1361 kilograms) in weight when fully loaded with passengers and any cargo.

Section 10-804.1 A low speed vehicle is a motor vehicle under this title, except:

4. Registration of a low-speed vehicle is governed by this chapter

5. A political subdivision may not require licensing or registration of low-speed vehicles.

6. The governing body of a city may regulate, restrict, or prohibit the use of low-speed vehicles operating in the city limits in areas under the jurisdiction of the city.

Hoff seconded and motion carried unanimously.

*Darla Jost appeared before council to address flood-zoning questions in Valley Meadow Addition. Council reviewed correspondence from Houston Engineering addressing these concerns. With this information, council feels all flood issues have been resolved with regard to the lots in Valley Meadow Addition. Diane noted that the Ward County Water Resource Board would like to be asked to attend city Planning Commission meetings in the future. (*see building permits below)

Clint reported FEMA denied about 90% of the city’s claim for street damage. They assist with repairs to streets damaged where there was actually diking, flooding and/or sandbagging operations. Damaged reported on private property was denied 100%.

The RV Dump has been staked, CTI will bore the sewer line at $12/foot. Clint and Ryan plan to do as much work as possible with city resources to keep costs down.

Discussion followed regarding replacing the Crown Vic. Council member Anderson offered to check with local dealers to see what is available.

Council reviewed correspondence from United Community Bank and determined pledged securities are adequate to cover our investments.

Diane presented Clarence Cramer’s lease for extension. Walter moved to approve a one-year renewal of this lease, Casavant seconded and motion carried unanimously.

The Ward County Maintenance/Purchase Agreement was presented for approval. Casavant moved to approve, Hoff seconded and motion carried unanimously.

Council reviewed correspondence from Darren and Jeanine Kabanuk regarding the condition of their lawn after repairs from flood control efforts. Clint has been to Kabanuk’s several times to make repairs and feels he has done all he can do with limited resources. Council member Brett Casavant will go to Kabanuks to look at the lawn.

Due to weather related conditions this spring the new civil defense sirens, plans are to have them installed within two weeks.

Diane presented two estimates on special assessments software from Banyon and Black Mountain Software. Hoff moved to purchase from Black Mountain Software at $3540.00, Walter seconded and motion carried unanimously.

Clint reported on completion of the media installation earlier this month and everything went very smoothly.

The Burlington City Council held their regular meeting September 8, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Wayne Walter, Auditor Diane Fugere, Public Works Director Clint Cogdill, Police Chief Keith Crabb, PW Assistant, Delvin Stemen, Engineer & Ryan Ackerman.

Walter moved to approve the minutes of the August 3, 2009 meeting, Hoff seconded and motion carried.

Walter moved to approve bills and payroll as presented with the exception of $31,876.25 to Ackerman-Estvold Engineering, Casavant seconded and motion carried.

Clint will check on getting a new truck for sanding/snow removal with the monies received from the State of North Dakota under SB2012 for street-related purposes due to excessive snow and flooding and report at the next regular meeting.

Clint has been unable to get a response from CTI to complete the sewer line for the RV dump. Council instructed Clint to contact Main Electric for a quote.

Council reviewed information regarding free water, sewer, and garbage bills for council members and employees. No action was taken.

Engineer Ackerman addressed council regarding the Safe Routes to School path from Soo Street to Wallace Street. Due to the strict ADA guidelines, the project has come in more than double the original estimate of $150,000. Council discussed rerouting the path descending the Northwest end of Soo Street to Wallace Street, as it is cost prohibitive to proceed with the original plan. Walter moved to approve payment of SRTS engineer bill to Ackerman-Estvold and give approval to Engineer Ackerman to go forward with redesign of this project, Hoff seconded and motion carried unanimously.

Ackerman presented council with a recommendation for final Progress Payment #2 to Keller Paving totaling $128,551.32 for Paving District #4. Casavant moved to approve payment, Walter seconded and motion carried unanimously.

After reviewing information on the 2009 – 2010 Burlington/West River Joint Systems Capital Improvement Program, Hoff moved to authorize Engineer Ackerman to get bids for the 2009 projects, Walter seconded and motion carried unanimously.

Ackerman notified council that the Control Panel for the NAWS project is the city and West River’s responsibility at an estimated cost of $30,000.00. Ackerman indicated a desire to work with Sweeney as they designed and installed the existing control panel. Council authorized Ackerman to get a proposal from Sweeney.

Council discussed hiring a part-time City Forester. Hoff recommended forming a Forestry Committee to propose a job description, wages, and other necessary information, which would be presented to council at the next regular meeting. Mayor Gruenberg appointed the following to the Forestry Committee; Wayne Walter, Clint Cogdill and Diane Fugere.

Several options were discussed for a new police car. The total allowance for a police car was determined to be $11,000 to $14,300. Mayor Gruenberg assigned the following committee assist the police department in the purchase of a new unit; Brett Casavant, Tim Hoff and Keith Crabb.

The new civil defense sirens are scheduled to be installed after mid-September. Council addressed information on Siren Planning to be forwarded to Al Reynolds, Ward County Emergency Manager.

Hoff reported meeting with the Ward County Sheriff’s office regarding getting timely notification of schedule changes with the Burlington police department. There is a concern with having no police coverage at times as well as a work schedule being frequently changed or not followed with no notification to Central Dispatch and unanswered phone calls. Officers were asked to ensure contact with Central Dispatch when work schedules change.

Council discussed employee issues regarding sick time and vacation. Hoff suggested the city consider purchasing a time clock for employee hours.

After review of the preliminary budget Hoff moved to approve, Walter seconded and motion carried on a unanimous roll-call vote. The public hearing to approve the final budget was set for October 5th at 8:30 p.m.

The Burlington City Council held their regular meeting October 5, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Wayne Walter, Jack Anderson, Auditor Diane Fugere, Public Works Director Clint Cogdill, Police Sgt Dennis Snodgrass, PW Assistant, Delvin Stemen & Dan Longie.

Walter moved to approve the minutes of the September 8, 15 & 24, 2009 meeting, Anderson seconded and motion carried.

Hoff moved to approve bills and payroll as presented, Walter seconded and motion carried.

Officer Snodgrass presented information on a cover for the rear seat of the Impala. Clint found an outlet for a hard cover seat for the police department. Casavant moved to authorize purchase of the seat, Hoff seconded and motion carried unanimously.

Council reviewed an estimate from Repair Patrol for purchase and installation of a light bar and installation of existing radio system and other police equipment for the Impala. Casavant moved to approve, Walter seconded, motion carried unanimously.

Dan Longie with Professional Concrete Services addressed council regarding issues with Keller Paving regarding Rowan Addition.

A decision regarding Keller Paving’s liquidated damages for a 46-day delay in project completion was tabled for further information. Casavant moved to table, Anderson seconded, motion carried unanimously.

Engineer Ackerman met with DOT regarding SRTS to discuss the budget shortfall and the alternate route for the project.  They indicated that the funding was approved for the current route and that we should build what we can with the funding that we have and reapply for funding again in November to complete the project.  Ackerman-Estvold is finalizing the plans for the proposed scope revision and will be advertising for bids in November.

Regarding Burlington / West River Capital Improvements Program:  Survey data was collected last week for the improvements at the lagoons.  Plans are complete for the raw water line extension between wells 3 and 4.  The lagoon plans will be complete within two weeks with plans to advertise for bids in November.  The intent is to tie the projects together to receive better unit prices for the pipeline construction.  All indications are that the budget numbers supplied by Ackerman during the capital improvements planning process will be sufficient.  Ryan has contacted Sweeney Controls to prepare a proposal for the NAWS controls integration. 

Ackerman has informed Main Electric via Keller Paving of the tilted light poles needing repair in Rowan Addition.

Clint reported on progress of the RV Dump. They have hauled dirt from Clint’s home site to the RV Dump site. The project is 75% complete and will depend on weather conditions for completion this year.

Council authorized advertising the Crown Vic and International Truck for sale on bids on the access channel and in the newspaper.

Council reviewed the list of authorized personnel for the Civil Defense Siren activation.

Hoff moved to amend the budget to increase general fund engineer fees to $32,000.00, Anderson seconded, motion carried unanimously.

Discussion followed regarding H1N1 Flu. Information reviewed indicates that a person is probably contagious for about one week. Risk Management Coordinator Tim Hoff asked that a memo be sent to all employees to use good judgment when ill and deciding how soon to return to work for the sake of co-workers.

The Forestry Committee has recommended hiring for the position of City Forester and presented information on salary, job description and term. Walter moved to advertise for the position in March 2010, Hoff seconded and motion carried unanimously.

Discussion followed regarding the proper use of funds in the Police Association Fund. Jerry Hjelmstad, attorney with the ND League of Cities indicated it is City of Burlington monies and should be run through the General Fund and cannot be used to pay overtime. Mayor Gruenberg reiterated that saying overtime is to be taken as comp time. Diane was asked to contact Rath & Mehrer for further information on what the monies may be used for.

The final budget was presented with no changes from the preliminary. Walter moved to approve the final budget as presented, Casavant seconded and motion carried unanimously.

The Burlington City Council held their regular meeting November 2, 2009. Present were: Mayor Jerome Gruenberg, Council members Tim Hoff, Brett Casavant, Jack Anderson, Auditor Diane Fugere, Public Works Director Clint Cogdill, Police Sgt Dennis Snodgrass, PW Assistant, Delvin Stemen, Paul Metz & Todd Jensen.

Casavant moved to approve the minutes of the October 5 & 22, 2009 meetings, Anderson seconded and motion carried.

Hoff moved to approve bills and payroll as presented, Anderson seconded and motion carried.

Hoff asked for an update on getting the Impala ready for use as a police vehicle. Casavant will talk to James Houston about getting the equipment installed while Dennis is on vacation.

Todd Jensen from Midcontinent Cable TV appeared before council to discuss renewing the franchise agreement between the city and Midcontinent. We are currently at a 3% base rate on basic cable and pay channels. This rate is negotiable as well as other options being available. Todd will work with Diane on projected revenue options and report to council at the next meeting.

Deputy Paul Metz with the Ward County Sheriff’s Department appeared before council to address any issues the city may have.

After review and discussion of proposed amended resolution granting property tax exemption, Casavant move to approved AMENDED RESOLUTION GRANTING PROPERTY TAX EXEMPTION PURSUANT TO 57-02-08(35), N.D.C.C. AND 57-02-08(36), N.D.C.C.

WHEREAS, the City of Burlington, acting by and through its duly elected representatives desires to encourage the construction of new residential dwellings; and

WHEREAS, North Dakota statutory law authorizes the Burlington City Council to grant exemptions up to $150,000 of the true and full value of residential dwellings for single family homes, condominiums, and townhouses; and

NOW THEREFORE, be it resolved by the City Council of the City of Burlington, that, pursuant to sections 57-02-08(35); $75,000.00 of the true and full value of all new single family residential property, exclusive of the land on which it is situated, is exempt from taxation from the first two taxable years after the taxable year in which the construction is completed.

BE IT FURTHER RESOLVED, that up to $75,000.00 of the true and full value of all condominium and townhouse residential properties, exclusive of the land on which it is situated, is exempt from taxation for the first two taxable years after the taxable year in which construction is completed.

The exemption from taxation authorized by this resolution shall only be effective if all special assessments and other taxes on the property are not delinquent. Further, the first occupant of the property after construction is completed must own the property, Anderson seconded and motion carried on a unanimous roll-call vote.

Work on the RV Dump is on hold until Spring.

With the new civil defense sirens installed Council asked Diane to advertise the old ones for sale on the NDLC listserv. Clint indicated there would be a training session on use of the civil defense sirens.

Diane reported Rath and Mehrer indicated the funds paid to the city by Ward County for park maintenance are city monies and use of these funds must be designated by council. Anderson moved to designate these funds for a police car fund and to pay the seasonal park monitoring fee of $450.00, Hoff seconded and motion carried on a unanimous roll-call vote.

Reid Opland’s property at Parkway 4th Addition has been declared a nuisance due to unsightly accumulation of weeds and tall grass. After a second notice was mailed to Opland with no response, Anderson moved to authorize Clint to give Opland until Friday, November 6, 2009 to abate this nuisance or it will be done by the city at a rate of $75/per hour, plus man-hours and billed against the property if necessary, Hoff seconded and motion carried unanimously.

Clint discussed erosion problems and pavement settling on Robert Street and asked about hauling gravel in to control the erosion. Council feels this is the developer’s responsibility to control erosion during construction and Engineer Ackerman will be contacted regarding this matter.

Clint asked about purchasing locating equipment for city owned underground electrical lines. The matter was tabled until Clint has an opportunity to test a GN501 locator that Casavant offered.

The Senior Center is required to put in two handicapped parking spots to comply with regulations and asked the city about deeding a portion of Lot 6, Hillside Addition to them for this purpose. Hoff moved to deed a portion of Lot 6, Hillside Addition to the Sr. Center for 2 handicapped parking spots, Casavant seconded and motion carried unanimously.

Diane asked permission to apply for an EECBG grant through the ND Department of Commerce for purchase of new garage doors for the shop. Casavant moved to approve, Hoff seconded and motion carried unanimously.

Diane informed council the police department was approved for two grants: $4000 for in-car cameras and $1200 for Alcohol Enforcement.

Council reviewed correspondence from United Community Bank and determined pledged securities are adequate to cover our investments.

Council reviewed the October 1, 2009 Safety Inspection Checklist.

Hoff presented the following building permits:

Casavant moved to approve building permits as presented, Anderson seconded and motion carried unanimously.

The Burlington City Council held their regular meeting December 7, 2009. Present were: Council President Tim Hoff, Council members Brett Casavant, Jack Anderson, Wayne Walter, Auditor Diane Fugere, Public Works Director Clint Cogdill, Police Chief Keith Crabb, PW Assistant, Delvin Stemen, Engineer Ryan Ackerman, Ryan Schwandt and Fire Chief Kevin Archer.

Casavant moved to approve the minutes of the November 2, 2009 meeting, Walter seconded and motion carried.

Walter moved to approve bills and payroll as presented, Anderson seconded and motion carried.

Due to ongoing problems with the police department’s portable radios Officer Crabb reported the need for in-car repeaters. The county may be able to assist in acquisition of these repeaters via a homeland security grant. Officer Crabb will have more information available at the next meeting.

The cage for the Impala is not compatible because of the transport seat. Karter Lesmann may be able to fabricate the cage to work with the Impala at an estimate of approximately $200.00. James Houston will install the strobe lights for approximately $200.00.

Anderson moved to put the Crown Vic and old snow plow up for sale on bids, Walter seconded, motion carried.

Council reviewed applications for the Hacienda and Idle Hour liquor license renewal. Walter moved to approve licenses, Casavant seconded and motion carried on a unanimous roll-call vote with Anderson abstaining.

Kevin Archer appeared before council for review of the Fire Chief’s Job Description and approval signature.

Diane presented a model Flood ordinance from FEMA. Council will review and discuss at the next regular meeting.

After review of Midcontinent Cable TV proposed Franchise Renewal Ordinance and Base Rate, Anderson moved to increase the base rate from 3% to 3.25%, Walter seconded and motion carried on a unanimous roll-call vote with Casavant abstaining. Anderson moved on first reading to approve ORDINANCE AUTHORIZING THE GRANT OF CABLE COMMUNICATIONS FRANCHISES IN THE CITY OF BURLINGTON, Walter seconded and motion carried on unanimously roll-call vote with Casavant abstaining.

Diane reported applying for additional grant monies to complete the SRTS project.

Discussion followed regarding purchasing locating equipment, Brett will work with Clint on this matter.

There was brief discussion about installing a stop or yield sign at the corner of Fiesta and Durango, no action taken.

Council discussed water sales to individuals/farmers. Clint will get estimates for the next regular meeting.

Clint reported the need for rotating lights and signage on the snowplow, bobcat and loader. Council gave approval for these purchases.

Walter moved to authorize payment of year-end bills as necessary, Anderson seconded and motion carried unanimously.

Highway Fund to Street Sealing Reserve $2000.00

Highway Fund to Hwy Equip. Repair up to $14,000.00

Walter moved to approve transfers as presented, Anderson seconded and motion carried on a unanimous roll-call vote.

Council reviewed information from Municipal Judge Cari Olson regarding writing off court fine for Larry Buck who has filed bankruptcy and is incarcerated. If Mr. Buck were sentenced by the city, the cost to the city for his jail fees would be $23.08 per day. Anderson moved to write off Larry Buck’s fine, Walter seconded and motion carried unanimously.

With no further business to come before the board, the meeting adjourned.
