Railroad Maps are a major key ingredient in the research to locate a family member, especially one that may be “lost.” These maps primarily are associated with the Northern Pacific Railroad (NPR) and the accompanying Bureau of Land Management (BLM) records plus Yellowstone County records. To better understand the Yellowstone County homesteader records, it is of interest to explain how NPR land management affected the local area residents. It is a very complex mess!
In the 1850’s the US was essentially divided into three separate entities: East Coast, West Coast and land occupied by various Indian Nations in between. Communicating between the political/governmental factions in the East & West took about a year of travel time. To improve relations it was decided to build a railroad connecting the two halves. Bidding was established for mapping out the railroad routes: Northern Pacific, Central Pacific and Southern Pacific. One track line was to be determined for the Northern Pacific route and two track lines for the others. Accompanying the track line surveys were evaluations of the land mass within 20-miles of the track, Indian’s condition, and water sources for major streams and rivers.
NPR line was mapped by Isaac Stevens, newly appointed governor of Oregon Territory in 1853-1854. He became quite ill after the survey and his mapping notes weren’t completed until about 1857. Congress had decided to build the Central Pacific Line in the interim, due to heavy political infighting that favored that selection. At this time the Louisiana Purchase land mass ceased to exist, and was part of the Nebraska, Washington, Oregon Kansas and Unnamed (Oklahoma) Territories, plus Texas and a piece of New Mexico and Utah. The green represents about ½ of the Louisiana Purchase. In 1838 the upper section of the Louisiana Purchase was noted as “Mandan Territory”, and covered most of Montana. Before the surveys commenced, Congress called for a treaty with the Indian Nations to be made. For the area, this took place at Fort Laramie (Unorganized Territory) in 1851, and all Nations assembled agreed to the treaty terms and conditions as negotiated by both sides (US and Indian Nations). That agreement included the Sioux, although Crazy Horse and Red Cloud sustained from the vote, while six other of their tribal leaders agreed; thus carrying the vote agreement. These agreements permitted the US to survey the land for the routes and establish wagon routes, mail delivery, and military posts for the support of the Indians and the travel by settlers. Stevens delineated a virtually accurate map of Montana, and in 1867 the Corps of Engineers finally released the map, and later amended it to include the various military battles in that area through 1876. Although released, apparently only a select few military commanders had access to this map, as it contained information vital to the security of the US. The NPR track line generally appears as a “dashed” survey line on various maps, and labeled as “Gov Stevens 1853 and or 1853-1854”.
In 1864, Congress decided to build the NPR using government money backed by floating $100interest bearing bonds, purchased at only $10 down, they established the founding directors as being members of Congress; and the Secretary of the Treasurer as the NPR Treasurer. Three days after the contract release, the BLM issued a notice to their sub-agencies that all domain land within a 40-mile corridor on each side of the track line in the territories was re-priced to $2.50 minimum/acre, and all odd-numbered sections were not available to homesteaders as the title will be given to NPR after the track line is formally surveyed. The homesteaders already on such land were entitled to stay and complete the homestead process if desired, and “in-lieu” lands were to be set aside for NPR. Unfortunately, it appears that only the BLM knew the route for NPR was along the Steven survey. This survey ran the track line from St Paul northwest to Fort Union, then along the north bank of the Missouri River to the Rocky Mountains, then through the mountains and along the north bank of the Columbia River, ending up in Puget Sound. During the next six or so years the congressional management team spent most of the collected funds for themselves, and many of the US banks collapsed. Arguments over where to start at each end were fully debated, and eventually a small piece of track leading west from St Paul was actually completed. To compound things, Congress had provided that after each 25-miles of completed rail installation the NPR track survey had to be delivered to the US President, and he had to call for independent verification before the Secretary could transfer funds to NPR for that portion of effort. Failing to build the railroad, the NPR congressional team filed for bankruptcy, and was re-chartered as a private enterprise. This is where NPR gained title to all odd-numbered sections of land along the track, and were able to use these land as collateral for construction funding. NPR merely had to identify the track centerline, and the government surveyor teams were responsible to establish the section locations within the corridors. Coincidental with the ownership shift, the owners of NPR decided to change the route to a more favorable location as it passed through the Dakotas and Montana; thus the NPR surveys of 1871, 1872 and 1873 were established. The government as well as investors demanded to know where the line was to be routed; thus establishing the new surveys. This second track line went essentially due west from St Paul, through Bismarck, and onto the Yellowstone River, crossing there at Glendive creek. From there it was planned to intersect a point 20-25 miles north of the Big Horn-Yellowstone Rivers confluence, and then on to Bozeman, and up through Helena to the Steven’s survey route west. Most of Montana’s land was still un-surveyed, and the Surveyor General of Montana attempted to publish maps of the Territory showing its features. None of the Steven’s[1] nearly perfect maps was used, and the eastern land-river features including trails and rivers were basically guesses. After the 1876 Custer Battle homesteaders started to move into the local un-surveyed area, and NPR was rushing to take advantage of that influx. General Adna Anderson was NPR’s Chief Engineer at that time, and he hired three key brilliant engineers to conduct a “secret” survey along the east bank of the Yellowstone River, and crossing that river at the town of Coulson. These persons were: Henry Ward Rowley, Bro’ Breuchard, and Fred Foster. The City of Billings plat was finalized before January 1, 1881, and filed with the Department of the Interior on that date[2]. Until NPR published their completed survey line in 1882 (rr005000.jp2), the route was generally shown as following the 1871-1873 survey routes, accompanied by either a 40 or 50-mile corridor on each side of the track.
Homesteaders were residing on various portions of local land, without benefit of survey knowledge until 1877-1879. When the surveyors came through the area, they placed the various homesteads (generally as delineated by the owner’s fences) and stuffed them into a formal land section platted area. Simultaneously with these surveys, the government enforced a little known change to the Domain Land definition, to include land with gravel content as being Mineral Land, and thus not available for homesteading. Joseph MV Cochran fell into this category, and he had to relinquish title to that land, and take up homesteading in a different location. He and numerous others fall into a BLM category described merely as “abandoned homesteads”. These records are maintained alphabetically on 3x5 blue index cards, and not available on computers, but only in person at the Billings field office. The homesteaders who settled before the land survey (many thousands of them) were considered Pre-emptive Settlers (eg., squatters, and their file record activities are maintained in Washington DC, in the National Archives.) Costs to retrieve these valuable papers are very expensive, and specific annotations of the early filings and rejection locations can be obtained from the BLM for those who want to obtain the real record. Many ancestors are probably presumed “lost” unless this manual search is completed. Details of these actions and how to obtain the records are presented on the website. Sometime after the NPR surveys were completed (c1873+), the GLO revised the land grant to include a 60-mile corridor on each side of the track for establishment of NPR’s tentative odd-numbered sections. After NPR issued a formal declaration of section ownerships, the GLO transferred formal title to them. Since many of the odd-numbered sections were already homesteaded, or in the process of completion, there were massive numbers of land transfers that had to be created to accommodate the congressional agreement on ownerships. Most all of these “in lieu” lands were provided from the vast forest regions of northern Montana, Idaho and Washington. NPR held non-restrictive title for harvesting these trees, and as a result three major lumber industries were created, and much of these forest lands are being shipped overseas without any tariff or duty costs.

There are three other maps defining the completed road through MN, ND, and ID-WA. These are noted in the listing.
