1. Call to Order

Chairman Betsy Head called the meeting to order at 12:00 PM with a quorum present for the transaction of business.

3. Reports

A. Chairwoman’s Report

Mrs. Head recapped the recently concluded NAR Convention which was held in San Diego, CA. At the NAR Directors meeting, the Board voted to rescind the charter of 16 associations from around the nation who did not complete NAR’s Core Standards requirements.

The Directors also approved of providing ZIP Forms for all NAR members for the next 3 years, which is to include Docusign and Digital Ink. After 2018, the Board will have to decide how to pay for the benefit, but in the meantime NAR is using reserves to pay for it.

B. Treasurer’s Report

1) Finances – Mike Kollmansberger reviewed the GMAR’s May 2015 finances.

Statement of Financial Position – As of October 31, 2015, GMAR had $1,558,644 in Cash & Investment Balances, up $3,495 compared to 2014. Accounts receivable were down $8,266 compared to last year. Prepaid expenses were down $2,103 compared to 2014. Total Assets were $3,261,160 which is down $24,843 compared to 2014.

On the Liability side, accounts payable were up $18,235 compared to last year due to higher dues payable to WRA and NAR than last year; unearned revenue was down $5,039; accrued vacation expenses were up $3,992; the long-term mortgage liability was down $31,643 which is the amount of principal to be paid on the mortgage in 2015. Overall, Total Liabilities were $1,212,975 which is down $12,510 compared to 2014.

For the month ending October 31, 2015, GMAR had Net Income of $182,417, up $14,344 from last year. Overall, Total Net Assets were $2,048,184; $12,333 lower than the same point in 2014.

Statement of Activities – Membership: Through October 2015, $846,460 was collected in dues. Last year at the end of October, the GAMR had collected $768,313 in dues. The association is $78,147 ahead of last year at the same time. New member budget for 2015: 464 REALTORS®, 50 DRs and 20 Affiliates. Through October, actual new members: 484 REALTORS®, 44 DRs and 11 Affiliates.

Promotions: Through October 31, Home and Garden Show income is $862,426 and expenses are $622,443. Current net income is $239,983. The revised budgeted net income for the Home and Garden Show is $260,004. Expenses related to Public Policy and Professional Standards were basically all personnel costs, incurring expenditures primarily in Labor and Overhead. Products (Wisconsin Real Estate Supply): Product sales through October 2015 were $7,324 lower than the sales through October 2014. Total product sales through October 2015 were $64,913. Total revised budgeted product sales for 2015 is $87,400.

The Leadership section includes expenditures for meetings, committees, officer expenses, strategic planning, NAR Home Buyer and Seller survey and NAR meetings. The main expenses recorded through October were officer stipends, registration fees and travel expenses for the Chairman and President to attend several conferences, the NAR Home Buyers and Sellers survey, NAR midyear meeting expenses, and Milwaukee Bucks season tickets.

The Administrative section includes investment and rental income and expenses for professional fees, salaries, fringe benefits, building, insurance, occupancy, property taxes, general office expenses and depreciation.

The bottom line shows Excess Receipts Over Expenditures of $182,417, which will be used up in the coming months. Last year the GMAR’s net revenue was $168,073 for the same time period. The revised budgeted net loss is $1,934.

M/S/C to approve the unaudited Statement of Financial Position (Balance Sheet) and Statement of Activities as of October 31, 2015, and recommend placing on file for audit.

2) 2016 GMAR Budget – Mr. Ruzicka presented the 2016 Budget.

Membership – The GMAR estimated dues income conservatively, with the hope/expectation that the Association will outperform the budget, like in 2015. The Association will continue to conduct PR efforts, but is not budgeting for a Public Awareness Campaign, although the GMAR could spend from reserves for a campaign.

Promotions – The HGS net income number is down $30K due to website upgrades, as well as because the last weekend of the show will face a closure on Easter Sunday. There is some anticipation that ticket sales will be down the second weekend.

Public Policy – Not much change for 2016, except for GAD travel costs. Products – The net from various sources is up slightly due to new products and marketing efforts. Professional Standards – Higher spending on Fair Housing.

Leadership – There is less spending on NAR meetings, because none of the Executive Committee members are on committees. Travel to the Midyear Meeting in May will probably be reduced to just a few days surrounding the Hill Visits.

Administrative – The GMAR is expecting less income from NAR grants and more expenses relating to Professional Fees, Staff Salaries, Tech (computers, Internet). The GMAR will commit to putting 3% of dues income into its Reserves account.

The Current Net amount budgeted is ($18,134). Mr. Ruzicka said he would provide an update in January assuming dues revenue is more robust than estimated as of the Directors meeting.

Mr. Ruzicka did say that the staff will look into remodeling the REALTOR® building next year and those expenses would come from the Association’s reserves.

M/S/C to approve of the 2016 GMAR Budget

C. President’s Report

Mike Ruzicka reported the following in addition to his written memorandum to the Board of Directors:

1) Moving Annual Dues Collection Period – A request from a REALTOR® (non-GMAR) was circulating late last month regarding changing the billing period. The GMAR BOD has discussed this issue, in addition to creating tiered memberships and installment payments, occasionally and has consistently rejected those ideas.

The two major reasons against changing the dues billing period are, it would impact how we pay NARs dues and the BOD has said dues are a normally occurring business expense and members should budget and plan for their payment.

2) Below Grade Square Footage – The Association received a request for changes dealing with how MLS treats below grade square footage. Mr. Ruzicka discussed the appraiser member’s idea with Chris Carrillo and he reminded me that MLS only requires “Est Total Sq Ft” which includes both above and below grade, which matches what public records show. Mr. Carrillo also mentioned the perennial liability risk of reporting square footage.

Mr. Ruzicka noted that, at this time, there does not appear to be a pressing need to change.

3) Great FSBO News from NAR - What was probably the best news in years from NAR was published in a blog post on NAR’s Economists’ Outlook on November 9th. The article, Selling Your Home Solo to Save Money? You’ll Actually Make Less Than You Think, spells out the negative consequences of FSBO sales, the tens of thousands of dollars FSBO sellers leave behind and the minority of sales that are FSBO.

4) Board of Directors Election – The GMAR Board of Directors election took place on October 11th and ran for one week, ending at midnight on the 17th. 608 (16%) members started ballots, 596 actually cast them. There were 12 ballots in progress when the election ended. Below is a summary of the results from our election vendor.

5) WRA Management Conference – As in the past, the GMAR will cover the registration fee for any Director who wishes to attend the WRA Management Conference, to be held at the Marriott West this year. Please let me know if you would like to attend.

D. Departments

1) Government Affairs

Marne Stuck reported:

• MKE Residency Rule – Like so many issues, the long-standing city of Milwaukee employee residency rule, has become a political ping pong ball. But the uncertainty of this issue will soon be resolved as the State Supreme Court has agreed to hear the case and decide whether Milwaukee can require its police and firefighters to reside in the city. In July, the court of Appeals reversed a Milwaukee County circuit court judge’s ruling that the state law took precedence, and instead agreed with the city’s position that dictating where tis employees may live is strictly a matter of local concern, not a statewide concern of the Legislature, which violated the home rule amendment to Wisconsin’s constitution. Many Realtors have clients sitting on the sidelines waiting for this decision to be final.

• New Milwaukee Department of Neighborhood Services Commissioner – Tom Mishefske took over the role of DNS Commissioner after the departure of Art Dahlberg on October 18, 2015. He has been working at the City of MKE since 1992 and has been at DNS for most of his tenure. The GMAR has worked with Tom over the years and this change in leadership should be much the same. The REO Task Force will meet with Mr. Mishefske in the upcoming weeks, as part of regular meetings with DNS.

• Chapter 452: Real Estate Practice Modernization – The objective of this WRA bill is to modernize the statute to reflect changes in Wisconsin real estate practice and interests as well as codify existing Wisconsin law. Several important provisions include:

o Protecting the real estate licensee independent contractor relationship

o Supervision by real estate companies

o Codify the unauthorized practice of law

o Broker liability protection – creating a two year statute of limitation for real estate licensees

o Deleting time-share licenses

o Modernizing the law as to licensed business entities

Rep. Scott Allen has been and will continue to be instrumental with the education and passage of this bill, which WRA is hopeful will be passed by the time the Legislature adjourns in late Winter/early spring.

• RPAC/Direct Giver – It has been a banner year for fundraising for both the RPAC through dues billing and the Direct Giver Program participation. Marne thanked the Directors for their continued support of promoting RPAC and the DGP. Fundraising in 2015 is ahead of 2014 and that can be attributed to the political climate and members more interested in politics and also attributed to the market doing so well this year.

2) Promotions

No report was given.

3) Professional Standards

Scott Bush provided the following report:

• Cases E15-25 and E15-31 were adopted as presented.

4) Communications

Caitlin McCrory provided the following report:

• Social media continues to trend upward with followers. Most engaging posts on Twitter are industry updates, and on Facebook it is fluff pieces highlighting Milwaukee/Wisconsin. We now have over a years’ worth of data on open rates with our email provider. Can start looking at trends (i.e. certain months generate more engagement than others). Spring has the most opens.

5) MLS

Chris Carrillo provided the following report.

• Mr. Carrillo mentioned he awarded the first Peter Shuttleworth Award of Excellence at the NAR Conference in San Diego, CA.

• has made several changes, one of which will include properties agents have sold as part of their agent profile.

• The MLS is redesigning property classifications

In keeping with the rules stated in the GMAR bylaws for election of the Association’s Executive Committee, motions were made, seconded and a vote carried for each of the following posts filled by members of the GMAR Board of Directors.

In 2016, 2015 Chairwoman Betsy Head will assume the role of Past Chair, and 2015 Chair-Elect Roxanne Platz will become the Association’s Chairwoman.

November 2015 Financial Statements

Statement of Financial Position

As of November 30, 2015, GMAR had $1,802,598 in Cash & Investment Balances, up $20,307 compared to last year.

Accounts receivable were up $23,707 compared to last year. Prepaid expenses were down $2,579 compared to 2014.

Total Assets were $3,570,434 which is up $23,195 compared to 2014.

On the Liability side, accounts payable were up $15,793 compared to last year due to payroll taxes and higher dues payable to NAR than last year; unearned revenue was up $35,377 due to 2016 Home & Garden Show income being higher this year; accrued vacation expenses were up $3,992; the long-term mortgage liability was down $31,643 which is the amount of principal to be paid on the mortgage in 2015. Overall, Total Liabilities were $1,563,141 which is up $25,569 compared to 2014.

For the month ending November 30, 2015, GMAR had Net Income of $139,608, up $24,179 from last year. Overall, Total Net Assets were $2,007,292; $2,374 lower than the same point in 2014.

Statement of Activities

Membership: Through November 2015, $851,809 was collected in dues. We had an 87% renewal. Last year (2014) at the end of November, we had collected $772,631 in dues so we are $79,178 ahead of last year at the same time. New member budget for 2015: 464 REALTORS®, 50 DRs and 20 Affiliates. Through November, actual new members: 509 REALTORS®, 46 DRs and 12 Affiliates.

Promotions: Through November 30, Home and Garden Show income is $861,926 and expenses are $622,612. Current net income is $239,314. The revised budgeted net income for the Home and Garden Show was $260,004.

Expenses related to Public Policy and Professional Standards were basically all personnel costs, incurring expenditures primarily in Labor and Overhead.

Products (Wisconsin Real Estate Supply): Product sales through November 2015 were $7,599 lower than the sales through November 2014. Total product sales through November 2015 were $67,727. Total revised budgeted product sales for 2015 is $87,400.

On February 1st we are changing the format of our real estate summit, with Marquette University taking a larger role in managing the event.

We were able to secure NAR’s Chief Economist, Lawrence Yun, to attend. Along with Dr. Yun will be MU economist David Clark, Executive Associate Dean of Business and Professor of Economics, and Dr. Mark Eppli, Bell Chair in Real Estate and Professor of Finance.

Proceeds from the event will go to Marquette’s Real Estate Department.

The morning will be capped with a panel discussion featuring: Dr. Yun, Dr. Clark, Jim Imhoff, First Weber Realtors, Dave Belman, Belman Homes, and Lee Turner, Bank Mutual.

The GMAR will pick up the tab for all Directors interested in attending. Please let me know if you would like to attend.

GMAR Public Relations

We will work with Monica Baer, Baer-Carlson Communications, again this year to produce media opportunities highlighting the real estate market and solicit area media outlets with real estate-related stories.

We are currently developing a database of potential media stories and would like your thoughts on trends in the industry, recent happenings and other ideas for stories. Here are a few examples to spur your thoughts:

• Single female purchasers

• Female REALTORS®, women entering the business

• Technology in real estate (drones, etc.)

• First-time homebuyers

• April Fair Housing Month

• Impact of Interest Rates

Member Focus Groups

We plan to host a handful of member focus groups in the months ahead to gauge members’ opinions and concerns with their business. We will invite an array of members, including new agents, experienced agents, geographically distributed throughout the region.

I would welcome any questions you may have that would help pull information and insight from the agents we interview.

These types of focus groups usually yield a gold mine of information, much of it detailed, on what is happening in members’ lives. I will provide the Directors with a summary of the focus group results at subsequent Board Meetings.

2016 Strategic Plan P 16

Before the Holidays, the staff and I sat down to review the existing strategic plan and the results of the September 3rd planning session. The attached document is a combination of those two texts. We also evaluated existing program and eliminated a few that are no longer relevant or feasible.

Please take a moment to review the document. At the Directors meeting I will review it and explain the changes that were made, and ask for your approval for 2016.

Appendix A: Public Policy / Government Affairs

GMAR Public Policy Positions

Members of the Greater Milwaukee Association of REALTORS® (GMAR) sell and market more than individual homes, land or businesses; they also sell the quality of life associated with property. This quality of life can extend well beyond the legal boundaries of property to social institutions that purchasers rely on in their daily lives. To customers and clients, as well as other members of the public, the community where a property is located is as important as the property itself.

In recognizing the importance of the quality of life that is inextricably related to property, it is in the Association’s interest to influence activities and organizations which impact the quality of life associated with property, at its discretion.

The GMAR has identified five general quality of life subject areas consisting of:

1. Education/MPS

2. Taxes

3. Jobs/Economic Development

4. Infrastructure

5. Public Safety/Crime

We refer to these five areas as “pillars” of the REALTOR® “Location, Location, Location” mantra regarding the most important aspects of the quality of life associated with a property. We call them pillars, because they shore up the “Location” mantra. If any one of the “pillars” begins to crumble, a property becomes less valuable.

Education/MPS (Adopted by GMAR BOD 09/16/2010)

The quality of schools is a significant component of the quality of life associated with property. In fact, the quality of schools is often the primary factor in the decision by families, and even businesses, on where to purchase property.

With this knowledge, the linkage between real property and the quality of schools must also be of significant concern to REALTORS®, because the quality of schools is directly related to the ability of REALTORS® to conduct their business.

GMAR Goal: To have a regional educational system that produces knowledgeable and skilled graduates who are capable of lifelong learning.

2010-2011 Agenda

• Support efforts to adopt federal "Race to the Top" standards including:

o Common standards and assessment.

o A system that provides timely reports on student performance.

o Elimination of any legal barrier to evaluating teachers and principals based on student achievement.

o Authority to intervene in struggling schools.

• Advocate that children in all schools are at the national average of proficiency in core academic subjects (i.e. reading, writing and mathematics).

Choice & Charter Schools

• Continue supporting the existence of the Milwaukee Parental Choice Program (MPCP) and charter schools.

• Eliminate barriers to the creation of additional high-quality education options in Milwaukee (i.e. implicit or explicit enrollment caps on Choice and Charter schools).

• Eliminate MPS limits on the percentage of system schools that can be Charter schools

• Allow use of surplus MPS buildings for non-MPS educational options including high-performing Choice and independent Charter schools

• Expand the number of entities authorized to establish Charter schools

• Increase funding for both Choice and Charter schools and reverse cuts on Choice schools that put them at risk.

• Work toward funding equity for all children in Milwaukee by increasing Choice and Charter per pupil funding levels to 80% of the MPS funding level. [The choice parents make as to which school to send their child to has a dramatic impact on state financial support for a child – with funding ranging from over $13,000 per child for a student in MPS to $7,700 per child in a charter school and only $6,400 in a Choice school.]

Milwaukee Public Schools

• Explore a change in MPS governance, including the possibility of moving authority to the Milwaukee Mayor’s office.

• Reform MPS labor agreements to reduce legacy costs and increase the district’s long-term fiscal stability.

• Advocate that MPS achieve a graduation rate equal to the national average for similar sized districts.

• Clearly define what a “high-performing school“ is.

• Measure performance for all schools in the city.

• Hold schools accountable for their results, expanding high performers and reforming low performers.

• Create alternative certification routes for teachers and administrators to attract more high quality leaders and staff.

• Liquidate surplus MPS property and facilities to generate district revenue.

Other

• Add REALTOR® or business leader to the MATC board (an important link to workforce training).

• Implement changes that were made to the State Workforce Training System at the local level, increasing dollars directed at training and creating stronger linkages between K-12 education, technical colleges and employers.

Taxation (Approved by GMAR BOD 03/20/2013)

The GMAR believes lowering property taxes in the Metropolitan Milwaukee market area is a significant public policy objective.

The Association understands our state’s long history of relying on funding most municipal services through the property tax. However, over time, the property tax (essentially local governments’ sole means of raising revenue) has become a burden on homeowners’ ability to pay the tax and prospective home buyers’ ability to purchase a home in Southeastern Wisconsin.

Furthermore, the GMAR believes property taxes place enough of a burden on prospective home buyers that it is a significant disincentive to purchase property.

Lowering property taxes is not a simple or easy task, but the GMAR believes it can be achieved by maintaining a close watch over how and where government spends its resources, as well as funding municipal services via other revenue sources that are not dependent on property ownership are important dual objectives.

The Association will support lawmakers and policymakers who seek more efficiency in government operations and back the exhaustive debate of reductions in government services, while also supporting the creation of different sources of revenue that do not place current or prospective homeowners in danger of losing housing choices.

Residency (Approved by GMAR BOD 03/20/2013)

The PPTF also discussed Governor Walker’s proposal of eliminate residency for all public employees. The TF separated the issue into two parts, a) the policy requiring employees to live within a political jurisdiction, and b) the impact eliminating residency would have on the market.

Given the wide array of opinions among the GMAR’s membership on the merits of residency, the PPTF decided not to take a position in favor or against residency. However, regarding the market impact of the pending policy change, the TF felt it would not dramatically impact the marketplace at this time.

Furthermore, given the improving real estate market and low levels of inventory, the market could absorb an increase in supply of homes.

The TF was concerned about a “grass is greener” effect some public employees might feel after gaining their new rights. The TF’s would caution public employees to contact their REALTOR® and take a very close look at whether listing their home is the smart move financially, for each family and for their quality of life.

The TF also wanted the Association to send a note out to the membership outlining the GMAR’s position, to prepare them to talk about it to clients or the media.

The GMAR has requested assistance from NAR’s My REALTOR® Party effort to poll public employees in Milwaukee to determine their likelihood of exercising their new right, should it pass.
