CLUB CONSTITUTION1.NAME OF CLUB1.1The Club shall be called Spa Golf Club2.CLUB OBJECTIVE2.1The club objective shall be to provide and maintain a Golf Course and Clubhouse, to promote and encourage the playing of golf and such other sports and pastimes as may from time to time be approved by the Council and generally to promote facilities for recreation and social activities among members.3.CLUB COLOURS3.1The Club Colours shall be Navy Blue and Gold.4.MEMBERSHIP4.1The Club shall consist of Full, Honorary, 4-Day, 5-Day, 6-Day, Summer, Associate, Country, Intermediate, Juvenile, House and Temporary members as defined in this Constitution.5.OFFICERS OF THE CLUB5.1The Officers of the Club shall be the Captain, Vice-Captain, Immediate Past-Captain, Secretary and Treasurer.6.CONDUCT OF THE CLUB6.1The Club shall not be conducted for profit and any surplus of income over expenditure in any year shall be used and applied for the benefit of all the members.6.2 If, at any General Meeting, a resolution for the dissolution of the Club is passed by a majority of the members, eligible to vote, present: and (a) at a Special Meeting held not less than four weeks later (of which not less than two weeks written notice has been given to each member eligible to vote) and (b)at which at least half of the members, eligible to vote, are present that resolution is confirmed by a resolution passed by a majority of at least two thirds of the members, eligible to vote, voting on it then the Council must immediately, or at such future date as specified in the resolution, proceed to realise the property of the Club. After discharge of all liabilities the Council must divide such property equally among all members irrespective of their voting rights and on completion of the division the Club will be dissolved.6.3There shall be no distribution in any manner whatsoever of the profits/surplus arising from any activities of the Club including the supply of intoxicating liquor and any other goods or services or a distribution of any assets which belong to the Club whilst the Club continues to operate as a Club under this Constitution.7.THE COUNCIL7.1 The Council of the Club shall consist of: -(a) The Officers of the Club, (b) five other either Full or Honorary Members,(who have not held office in the previous three years) and(c) the President and Vice-President as ex-offico members.7.2 All Officers and members of the Council shall be elected at an Annual General Meeting.7.3 The five members of the Council shall serve for a maximum of three years at any one time in that role.7.4 A Council member who fails to attend 5 Council Meetings in a 12 month period, without due cause, shall cease to be a member of the Council.7.5The procedure for election of Officers and Members of Council shall be as follows:-(a) At least 2 months before the Annual General meeting the Secretary will place a notice on the Club Notice Board and the Club Website identifying the vacancies on Council and seeking nominations from Members.(b) The name of each candidate as an Officer or as a member of Council shall be proposed in writing, by a member and seconded by another member, to the Secretary.(c) The proposal shall say for which vacancy the candidate is proposed and be signed by the candidate indicating his willingness to act in that capacity.(d) Proposals shall be delivered to the Secretary not later than 30 days preceding the date of the Annual General Meeting.(e) Proposals judged by Council, to be properly made in accordance with (a), (b), (c) and (d) above shall be displayed on the Club Notice Board for a period of at least 21 days before the date of the Annual General Meeting.(f) The Agenda for the Annual General Meeting shall give the details of the said proposals. At the Annual General Meeting a proposal shall not be disqualified by the absence of the proposer, seconder or candidate from such meeting.(g) A candidate shall be elected at the Annual General Meeting by a simple majority vote of the members eligible to vote who are present.7.6A member of the Council on ceasing to be a member of the Club shall cease to hold Office.7.7A member of the Council may be removed from Office by Resolution of a General Meeting of the Club.8.TRUSTEES8.1The property and effects of the Club shall be vested in three Trustees who shall hold such property and effects in Trust for the members of the Club. The Trustees shall (in so far as the assets of the Club may be deficient for that purpose) be indemnified by the members, for the time being, of the Club against liability and expense incurred by them by reason of their position as Trustees unless the same occurs through their own wilful default.8.2The Trustees shall, when authorised by a Resolution passed by a majority of those eligible to vote present and voting, at a General Meeting sell, lease, grant, demise, mortgage or charge any of the property and effects of the Club, vested in them, and execute all documents necessary to the same effect. The minutes of the meeting where such a Resolution is passed shall, when confirmed, be evidence of such authority.8.3Only Full and Honorary members of the Club shall be eligible for nomination as a Trustee. 8.4A trustee cannot be a member of the Council.8.5In the event of a vacancy occurring among the Trustees this vacancy shall be filled by nomination and election. The Secretary will place a notice on the Club Notice Board and the Club Website identifying the vacancy and seeking nominations from Members. The name of each candidate as a Trustee shall be proposed in writing to the Secretary and seconded by another member. The nominations will be submitted to a General Meeting for election by a simple majority vote of those members, eligible to vote, present at such a meeting.8.6Each Trustee shall be appointed for a minimum period of three years or resignation or until a General meeting shall vote to remove any or all of them. A trustee may be appointed for further periods of three years.9DUTIES OF COUNCIL9.1The Council shall have control of the finances of the Club; engage, control and dismiss all employees (subject always to the provisions of the Employment Rights (N.I) Order 1966 and any amendments thereto and to the general laws of N.I and the United Kingdom); supply refreshments; and have all such power as may be necessary for implementing the objectives of the Club in accordance with this Constitution and, as far as they are applicable, the provisions of the Registration of Clubs (N.I) Order 1996 and the Registration of Clubs (Accounts) Regulations (N.I) 1997.9.2The Council shall have the power to make, vary or rescind bye-laws (consistent with this constitution and the Rules of Golf etc.) and to give orders and directions as it may consider necessary for the wellbeing of the Club.9.3The Council may appoint sub-committees (not necessarily formed by Council members) and delegate to such sub-committees the management of the resources and processes necessary for the administration of any of its powers.9.4If at any time the Club, in a General Meeting, passes a Resolution authorising the Council to borrow money; the Council may borrow, for the purposes of the Club up to the approved amount (either at one time or from time to time) at the rate of interest, in the form and manner and upon the security specified in the Resolution. The Trustees must at the direction of the Council make any disposition of the Club property or any part of it and enter in to any agreement in relation to the Club property as the Council thinks proper to give security for the loan and interest. Every member of the Club, whether he voted on a Resolution authorising borrowing or not, and everyone becoming a member of the Club after the passing of such a resolution is deemed to have assented to the Resolution as if he had voted in favour of it.9.5The Council shall hold meetings at regular intervals as it deems necessary, but not in any event less than six times per year.9.6The Secretary or the Officer deputising for him shall give the Council members at least 48 hours notice of every meeting, either by conventional mail or electronic means, stating the business to be considered at that meeting.9.7The Chair at each meeting shall be taken by the Captain or, in his absence, the Vice-Captain and in the absence of both by such member as the remainder of Council may decide. The Chairman will have a casting vote at Council meetings to be used at his discretion.9.8The quorum for each meeting shall be seven.10CLUB MANAGEMENT10.1The management of the Club shall, subject to the over-riding direction of a General Meeting, be under the Control of the Council.10.2The Secretary shall as a minimum:-(a) Record the minutes of all General and Council meetings.(b) Issue all notices necessary to arrange all General and Council meetings, including those identifying vacancies for General meetings.(c) Keep a file containing a copy of all nominations and proposed Resolutions for General meetings together with any Council decision regarding the validity or otherwise of any proposed Resolution or nomination.(d) Keep a file in which he shall enter a copy of the minutes of all General and Council meetings.(e) Oversee the receipt, acknowledgement and issue any appropriate response for all correspondence whether by conventional mail or electronic means.(f) Keep a record, in the Clubhouse, of the names and addresses of the members of the Club.(g) Ensure that all members personal data is stored, managed and, and where appropriate, destroyed in accordance with current Data Protection Legislation10.3The Treasurer shall, as a minimum:-(a) Manage the processes for keeping of accounts showing the receipts and disbursements of the Club.(b) In compliance with the Registration of Clubs (Accounts) Regulations 1997, present a statement , duly audited by a Chartered Accountant or a member of the Association of Certified and Corporate Accounts, for the Club’s previous Financial Year , ending 30th September, to the Annual General Meeting.(c) For the time being be authorised to sue on behalf of the Club, when directed by Council to do so. The Minutes of the Council meeting giving the direction shall be evidence of authority.10.4The Council may delegate the management of its resources and process, necessary for the administration of its powers, to employees as follows:-(a) Identify the roles necessary for the overall management of its resources and processes.(b) Draw up a job description for each role and determine the skills and qualifications, if appropriate, required to fulfil each role.(c) As vacancies occur carry out any necessary recruitment activity and appoint people to these roles, in accordance with the rules and regulations applicable to Northern Ireland. Where the role is considered to be full time such appointments should initially be for a 3 month probationary period. On satisfactory completion of probation the appointee may become a full time employee for a period of three years, including the probationary period. The period of employment may be extended by Council in a maximum of three year cycles.10.5Any dispute regarding pay shall be decided by the Captain or Secretary and two members of Council, whose decision shall be final.11.MEMBERSHIP11.1The Club shall operate an equal opportunities policy and no-one shall be denied the right to equal access to its facilities on the grounds of race, creed, colour, gender, disability, occupation, religion, or sexual or political persuasion. Henceforth there shall be no distinction between men and women as candidates for admission to full membership. (What about Honorary for ladies opting to be full members)11.2Existing or new Lady members shall have the right to elect to become a Full member.11.3A person shall be eligible for membership of the Club as one of the following categories of membership:-(a) A Full member, which term shall mean a male or female (electing to take this option) of twenty-five years of age at 1st March of any given year.(b) An Intermediate member, which term shall mean person of more than eighteen and less than twenty-five years of age at 1st March of any given year.(c) An Associate Member, which term shall mean a female member of twenty-five years of age or more at 1st March of any given year.(d) A Country Member, which term shall mean a former Full or Intermediate Member whose permanent residence is within twenty miles of the Club premises but who is currently employed, on a temporary basis (six months or more), more than one hundred miles from the Club premises.(e) A 4-day (Monday-Thursday inclusive), 5-Day (Monday-Friday inclusive), 6 –Day (Sunday-Friday inclusive), Summer (April-September inclusive) member which term shall mean, a person of twenty-five years of age or more at 1st March of any given year who is entitled to the privileges of the Clubhouse but shall be restricted to playing golf on the course on the days relevant to their membership category. This category of member will not be allowed to play golf on the course on other days except on payment of the visitor green fee.(f) A Juvenile member, which term shall mean a person less than eighteen years of age at 1st March of any given year who shall be restricted to playing golf to the times decreed by the Council for such members and who is entitled to the privileges of the Clubhouse subject to the terms of 18.16(g) A House member, which term shall mean a person is not entitled to play golf on the course except on payment of the appropriate visitor green fee.11.4An Honorary member. As a mark of appreciation for outstanding service to the Club or Golf in general, a General Meeting may (subject to 11.5) elect any member to Honorary membership. On election that member will not be liable to pay annual membership.11.5A proposal for membership must be made in writing in a form and manner defined by the Council. As a minimum, the proposal must be signed by a member of the Council and seconded by a member, other than an Intermediate, Juvenile or House member.11.6The Names and Addresses of those proposed for membership shall be displayed on the Club Notice board for a period of at least two weeks prior to the Council meeting at which the proposal will be considered.11.7Each proposal for membership shall be considered by Council, whose decision will be final.11.8A person whose proposal for membership has been accepted by Council shall become a member on payment of the relevant fees (see section 12) or portion thereof, if joining mid-year. Thereafter membership will be dependent upon payment of the annual subscription fees by 1st March of any given year.11.9Each new member will be given a copy of this Constitution and Cub bye-laws and upon signing for these, will be bound by them.11.10Membership of non-voting categories shall be subject to an overall total number which is not more than three times of the number of members in the voting categories.11.11 All members using Social Media in relation to the Club and its members shall do so in a way that does not injure a member or the good name of the Club.11.12 Members must at all times, when on Club premises or elsewhere whilst on Club business, adhere to the Club’s Child Protection Policy. 12MEMBERSHIP FEES12.1Membership fees will have three main elements:-(a) An Entrance fee which will be determined by vote at a General Meeting, (b) An annual membership fee for each category of membership which will be determined by vote at a General Meeting, and(c) A Social Supplement, which will be mandatory (except for Junior Members, Full and Honorary Members and Associate Members aged 65 and over). Full and Honorary Members and Associate Members over 65 and Junior Members may volunteer to pay the Social Supplement.12.2At a General meeting an annual re-development levy of ?70 was included as part of the annual membership fees for a period of 15 years. The appropriate amount of re-development levy will be charged to any new member joining the Club for a minimum period of 15 years.12.3The Social Supplement, currently ?100, must be paid between the 1st March and the 1st September in any given year. If, at the 31st December in any given year, the complete ?100 has not been utilised then any remaining money will be surrendered to the Club. A member whose Social Supplement is mandatory and has not paid it by the appointed date that member will be barred from playing in Club competitions until such time as the Supplement is paid.12.4Council has the right to waive all or part of the Entrance fee.12.5Full and Associate members, who joined before 1st January 2000, upon reaching the age of 65 with 15 years continuous membership will qualify for a 20% reduction in the annual membership fee.12.6Full and Associate members over 75 years of age with 25 years continuous membership will qualify for a 50% reduction in their annual membership fee.12.7Any person joining the Club after 1st January 2000 as a full member will not qualify for an annual reduction on reaching the age of 65 years.12.8A member shall not be allowed to play in any competition of the Club unless his current annual subscription has been or is in the process of being paid by instalments.13TEMPORARY MEMBERS13.1A Temporary Member is:-(a) A person participating in a competition or match arranged by the Club, or(b). A person who has signed the Green Fees Book and paid the appropriate fee.13.2Council shall have the right to refuse the admission of any person as a Temporary member.13.3Where a member of the Club introduces a person to Temporary membership for the purposes of playing golf at the reduced Green Fee, as stipulated by Council, such member shall sign the Green Fees book opposite the name of the person introduced and shall play in the company of the Temporary member.13.4Council may by bye-law limit the number of temporary members who may be introduced by a Club member.13.5A Temporary member shall have no say in the management of the Club nor be permitted to introduce visitors nor be entitled to play in internal Club competitions.14DISCIPLINE OF MEMBERS14.1A member on paying the entrance fee and subscription is considered to have submitted himself to the Club Constitution (both as to the privileges enjoyed and the penalties imposed) and on these conditions alone is entitled to enjoy all the advantages of the Club.14.2 All complaints must be made to the Secretary in writing or by e-mail within 21 days of the event giving rise to the complaint. The complaint shall include a statement setting out the full circumstances giving rise to the complaint. Only complaints submitted in accordance with this paragraph will be considered.14.3In the event that it is drawn to the Council’s attention, in writing or by e-mail, that any member wilfully acted contrary to the Constitution or bye-laws of the Club or that any member conducted himself, either in or out of the Club premises so as, in the opinion of Council to injure or discredit the character of the Club then the Secretary will acknowledge the receipt of the complaint within 14 days.14.4The Secretary shall convene a meeting of the Disciplinary Committee and communicate with the complainant and the member against whom the complaint has been made, either by conventional mail (recorded delivery) or by e-mail (requesting acknowledgement of receipt), and inform them that a Disciplinary meeting will be held (providing them with a date, place and time) to consider the complaint. This meeting will be convened within 14 days of the complaint having been received.The person against whom the complaint has been made will be advised of his right to attend the meeting to explain his conduct. The member will be given a minimum of three days written notice of such meeting to afford the member time to prepare an explanation. The Disciplinary Committee shall operate in accordance with Rules of Natural Justice and shall have the power to investigate fully the complaint and to interview witnesses and take and receive statements.14.5 At the Disciplinary meeting, three members will form a quorum; the member shall be given the opportunity to rebut any allegations made against him. The Disciplinary Committee after hearing all the evidence shall have the power to take such action as it shall deem appropriate including, but not limited to:-(a) a written warning(b) an apology to the person(s) affected by the offending behaviour(c) suspension from Club Membership for a period of time, or(d) expulsion from Club Membership.14.6A Member feeling aggrieved by a decision of the Disciplinary Committee shall have the right to appeal to the Council. This appeal, which must be in writing or by e-mail, must be received by the Secretary within 7 days of the date of the Disciplinary Committee meeting.14.7On receipt of an appeal the Secretary shall refer this to the Captain who shall convene a meeting of Council to sit within 21 days of receipt of the appeal to hear the appeal.14.8The Secretary shall inform the complainant and the person complained against of the date, time and place of the meeting to hear the appeal. At this meeting, five will form a quorum, and no Council Member who sat on the Disciplinary Committee meeting can be present. The person against whom the complaint was made will be permitted to state the basis on which he is appealing.14.9The decision of Council on the hearing of Appeal shall be final and binding.14.10At the hearing of a complaint against a Lady Member or an Associate Member the Lady Captain shall nominate a Lady or an Associate member to be a member of the Disciplinary Committee.14.11Where the Member complained against is a Juvenile the Secretary, in conjunction with the Juvenile Convener, of their own initiative, after hearing all the evidence shall have the power to suspend a Juvenile Member for a period of not more than 2 weeks.14.12A Juvenile Member aggrieved by the decision of the Secretary and Juvenile Convener shall have the right to appeal to the Disciplinary Committee. The appeal must be in writing or e-mail and must be received by the Secretary within 7 days of the decision.14.13A Juvenile Member aggrieved by the decision of the Disciplinary Committee shall have the right to appeal to Council. The appeal to Council must be in writing or by e-mail and must be received by the Secretary within 7 days of the date of the Disciplinary Committee meeting.14.14A Juvenile Member under 18 years of age shall be instructed to attend any meeting accompanied by one or both of his parent or Guardians.At such a meeting, which must be attended by at least five members of Council, the member will be allowed to offer his explanation.14.15In the event of a Temporary member or a visitor to the Club or its premises acts in such a manner which Council considers is in any way objectionable, the Council may debar such a person from the Clubhouse and or course.15RESIGNATION15.1Any member who has not paid their current annual subscription by 31st March of any given year shall be deemed to have resigned and reinstatement to membership shall be at the discretion of the Council.15.2Any Member liable to pay a Mandatory Social Supplement, who has not done so by 1st September in any year shall, at the discretion of Council, be liable to have their membership terminated.15.3Any member may resign membership by giving notice in writing to the Secretary. Every such notice, unless otherwise stated, shall be deemed to be effective from the date when it is receipted by the Club. Any member giving such notice after the first day of a year will be liable for all membership arrears up to the date of their resignation.15.4On ceasing to be a member of the Club a person forfeits all rights and claims upon the Club its property and funds.16ANNUAL/ SPECIAL GENERAL MEETING16.1Only Full and Honorary members are permitted to vote at the Annual General Meeting. Twenty Full or Honorary Members shall form a quorum for a General Meeting. All elections and resolutions will be subject to a simple majority, of those eligible to vote, present at the General Meeting, except for a resolution for the dissolution of the Club (see 6.2).16.2The Annual General meeting shall be held not later than the third Wednesday in December at such time and place as the Council shall arrange. The meeting will receive various annual reports from Council in respect of the preceding year, will allow members present to comment upon such reports and transact business in accordance with the published Agenda.16.3Notice of the date of the Annual General meeting including a request for nominations and resolutions will be placed on the Club Notice board and Website not later than two months prior to the date of the Annual General Meeting.16.4Notice of the Annual General meeting and the business to be transacted shall be given to members by circular not less than seven days before the date of the meeting16.5A member who wishes to bring a resolution before an Annual General Meeting shall give the Secretary notice in writing of the resolution to be proposed not later than fifteenth of November preceding the date of such meeting.16.6Council may, in exceptional circumstances which have arisen after the date set out in 16.3, make a nomination for election or propose a motion for resolution at the Annual General meeting.16.7The Chairman at an Annual General meeting shall have the power to refuse the transaction of any business or the proposal of any Resolution not on the Agenda or not the subject of notice in accordance with 16.5.16.8The Captain will chair the Annual General meeting, in his absence by the Vice-Captain. In the event that both are absent by a person elected, by a simple majority, at the meeting. The Chairman will have a casting vote to be used at his discretion.16.9Voting by proxy shall not be permitted.16.10Should a majority of the members present wish any issue under discussion to be voted on by secret ballet then that method will be adopted.16.11When directed by Council, or when required to do so by a requisition signed by at least 50 Full or Honorary members the Secretary shall call a Special General Meeting. Notice of such a meeting and of the business to be transacted shall be given to members either in writing or electronically not less than seven days before the date of the Meeting.16.12For the purposes of a General Meeting 16.1, 16.7, 16.8, 16.9 and 16.10 shall apply.17CLUB PREMISES17.1All members shall carry membership cards whilst on the premises.17.2No person shall be paid, at the expense of the Club, any commission, percentage or similar payment on or with reference to the purchase of intoxicating liquor by the Club.17.3No person, without the prior approval of the Council, shall directly or indirectly derive any pecuniary benefit from the supply of intoxicating liquor, supplies or services by or on behalf of the Club, members or guests apart from any benefit accruing to the Club as a whole.17.4A guest of a member shall not be admitted to the Club Premises except in the company of a member (other than a Juvenile member). The member shall immediately on the admission of his guest enter the guests name and address in the Guest Book together with the date of the visit17.5A member shall be responsible for his guest strictly observing the Club Constitution and shall not leave the Club premises before his guest. A guest of a member shall not be supplied with intoxicating liquor in the Club Premises unless upon the invitation and in the company of a member.17.6A person, other than a partner or child of a member, may not be introduced as a visitor on more than 20 occasions in any period of 12 months.17.7In the case of a team or other body of persons who are, as members of another Club, Society, or Organisation visiting the Club, it shall suffice for the purpose of 17.5 for a Member of the Club to enter the name of the visiting Club, Society or Organisation in the Guest Book, together with the number of visitors and thereafter on the occasion of that visit intoxication liquor may be supplied to such visitors at the request and in the presence of any Officer of the Club.17.8Council may exclude or limit the number of visitors on any one occasion.17.9A visitor shall conform to the Constitution’s requirements for members whilst visiting the Premises. No visitor shall be admitted to, or remain on the premises, in the absence or after the departure of the introducing member.17.10No member shall introduce to the Club Premises, as a visitor, anyone who has been an unsuccessful candidate for membership or whose membership is suspended or cancelled.17.11Charges for meals, refreshments and the like, snooker and other games shall be agreed by the Council. Every member must, before leaving the Club Premises, ensure that all such charges incurred on his own account or for a guest are paid.17.12Any Society , Charity or member wishing to hold a function on the Club Premises must make application to the Secretary in writing and must undertake to comply with the Provisions of the Registration of Clubs (N.I) Order 1997 and the Registration of Clubs (Accounting) Regulations (N.I) 1997 in relation to the running of the function and the proceeds thereof. The Council has sole discretion on the running of functions on the Club Premises.17.13The course shall subject to 17.13(b) and 17.14, be open to play at all times and on all days. Council may, at its discretion make Regulations as follows:-(a) affecting play on specific days, competition, or match days.(b) restricting the time at which the course will be open for play by weekday, juvenile or temporary members.17.14Council shall have the right to close the course or any part of it for any reason deemed necessary in the interests of the Club.18PROVISION OF INTOXICATING LIQUOR18.1Intoxicating liquor shall not be supplied to: -(a) Persons who are not members of the Club for consumption outside Club premises, and(b) Members of the Club for consumption outside the Club premises except on days that the Sub-Divisional Commander, acting for the district in which the premises are situated, may authorise in writing.18.2No person under 18 years of age will be supplied with intoxicating liquor on the Club premises.18.3No person under 18 years of age will be permitted to consume intoxicating liquor anywhere on Club premises.18.4No person shall obtain intoxicating liquor, for consumption by anyone under 18 years of age, anywhere on the Club premises.18.5The Club shall not permit drunkenness or disorderly behaviour on Club premises nor shall it supply intoxicating liquor to drunken persons.18.6No member shall procure intoxicating liquor on the Club premises for a drunken person, nor shall they aid a drunken person in obtaining or consuming intoxicating liquor on the Club premises.18.7No member shall bring a drunken person into Club premises.18.8A person who is drunk or disorderly will be refused admission to or will be expelled from Club premises and the Club may seek the aid of the PSNI to enforce such action.18.9Intoxicating liquor may only be supplied on the Club premises during the permitted hours, that is to say:-(a) Monday to Saturday, other than Christmas Day and Good Friday from 11.30am to 11.00pm;(b) Sunday, provided it is not Christmas Day, from 12.30pm to 10.00pm;(c) Christmas Day from 12.30pm to 2.30pm;(d) Good Friday from 5.00pm to 11.00pmThe bar shall be kept closed except during the permitted hours stated above.18.10A statement, printed in plain type, of the hours during which intoxicating liquor may be supplied on Club premises, shall be displayed in a conspicuous part of the Club premises.18.11At the end of permitted hours 30 minutes “drinking up” time is allowed.18.12Intoxicating liquor shall not be supplied to any member on credit.18.13Subject to 18.9 and any extension to permitted hours granted under 18.14 no person shall consume any intoxicating liquor in the Club premises.18.14Subject to having received the necessary authority from the Sub-Divisional Commander of the PSNI for the District, Council may at its discretion, extend the hours during which intoxicating liquor may be supplied in Club premises provided that such extension shall not include the hours between 01.00am and 11.30am and provided that Council shall not exceed the said hours on more than 52 occasions in any year.18.15Para 18.9 shall not be construed as implying an obligation on the Club to supply intoxicating liquor during the whole or any part of the permitted hours. Council has the authority to supply intoxicating liquor within the permitted hours at its discretion.18.16Persons under 18 years of age shall not be in any part of the Club premises which contains a bar after 9.00pm except solely for the purposes of passing to and from a part of the premises not containing a bar from which there is no other access, or when a children’s licence is in force.19ALTERATION OF THE CONSTITUTION19.1Subject to 19.2 any additions to, deletions from or amendments of the Constitution may only be made at a General meeting.19.2The Council may amend the Constitution in order to comply with Statutory Regulations.19.3The Council’s interpretation of any doubtful part of the Constitution or bye-laws for the management of the Club, its property and affairs or for the general comfort and accommodation of the members of the Club shall be binding on every member until set aside by a General meeting20INTERPETATION OF THE CONSTITUTION201.In the Constitution the masculine gender shall be deemed to include the feminine gender.21CLUB PROPERTY21.1No member, employee, consultant or agent shall take away from the Clubhouse or premises any books, papers or other articles of Club property without the permission of the Secretary. Any member removing, destroying or injuring Club property shall make such restoration or pay compensation as the Council may determine.CLUB BYE-LAWSUSE OF COURSE Members must observe the regulations regarding courtesy, priority, care of the course and etiquette of the game of golf as outlined in the Rules of Golf as approved by the Royal and Ancient Golf Club of St. Andrews. Members must always display their current membership disc whilst playing the course. Members are responsible for ensuring that they have adequate golfer’s insurance whilst playing the course. Members must ensure that all gates on the course are closed. Members should repair pitch marks on greens, rake bunkers, leave rakes in the bunkers, replace divots, take care when replacing flagsticks and ensure that guests and visitors take similar action. Players must not “cut-in” on any part of the course unless the previous hole, from tee to green, is clear of players. “Cutting-in” is forbidden whilst a competition is in progress. The Club Captain, during his year in office, has priority on the first tee at all times. The course is open for play from 7.00am until sunset unless the Council decrees otherwise. Day to day regulations regarding play on the course displayed at the side of the first and tenth tees must be adhered toCasual play should be from the yellow or blue markers, depending on type of member, for male golfers and from the red markers for ladies. The white markers are reserved for men’s competition play and should not normally be used for casual play. The practice areas shall be defined by Council. All persons using these practice areas must conform to the rules displayed on the notices in these areas.Practice is confined to the designated areas. Members playing on their own may play a maximum of two balls on each hole.The practice greens to the left of the entrance and on the way to the first tee are for practice putting only and chipping onto the practice greens is forbidden.Trolleys are allowed on the course; however Council may decide to ban the use of trolleys to protect the course. Following a written request Council may grant members exemption from the ban.Subject to written permission from the Council members may use Caddy cars on the course. Council may restrict their use at times to protect the course.Dogs are not permitted on the course at any time.No person shall write on, mark or deface in any way an official notice posted on the course.2Use of the Clubhouse2.1The Clubhouse shall be open daily from 8.00am to 11.00pm unless Council determines otherwise.2.2Bar facilities shall be used in accordance with the Registration of Clubs (NI) Order 1996.2.3Junior members are not allowed to play any gaming machines, use the snooker room or enter the committee room.2.4Golf clubs, other golf equipment (excluding trolleys), rain gear, hats etc. should only be brought into the locker rooms. 2.5Trolleys (other than those on display) in the shop should only be brought into the Trolley room.2.6No shoes (whether spiked or not) which have been worn on the golf course shall be worn in the Clubhouse except in the locker rooms.2.7No animal other than Guide dogs shall be permitted in the Clubhouse.2.8All visitors other than teams playing in competitions must sign the visitor’s book which must be countersigned by the introducing member.2.9No person shall bring food or drink into the Clubhouse for their own consumption.2.10Notices or documents of any kind shall not be placed or displayed in the Clubhouse without the consent of the Secretary.2.11No person shall write on, mark or deface in any way an official notice posted in the club house.2.12Where tables and chairs have been reserved for Club Officers; no member shall use these without the permission of the said Club Officer.2.13Members using the car park must park in the areas designated with white lines except those which have been reserved as determined by Council. Parking on double yellow lines is not permitted.3.DRESS CODE3.1Smart casual dress is essential in the Clubhouse. It must be clean, neat and tidy. Collar and ties is preferred on function nights.3.2Singlets, sleeveless and or collarless shirts, untailored shorts, sweaters without shirts, garments displaying slogans such as soccer, rugby and gaelic shirts, track or leisure suits, headgear of any type (in Clubhouse) are forbidden at all times.PETITIONS AND HANDICAPS4.1Competitions and handicaps shall be managed in accordance with the rules of golf as laid down by the Royal and Ancient Golf Club of St. Andrews and by the appropriate authority for both ladies and men.4.2Competitions and handicaps are managed by the Competitions and Handicaps Committee.4.3House members are not allowed to play in Club Competitions unless after paying the appropriate visitor fee in Open Competitions.4.4In accordance with the rules of their category, Juvenile members, may play in main Club Competitions except for Captain’s and President’s day.4.4All fees for competitions must be paid and all players must sign in on the computer at the shop prior to play.4.5All starting times allocated in Club competitions must be adhered to. Any member entering a Club competition and failing to turn up at the appointed time, without notifying the professional, may be barred from some future competitions at the Council’s discretion.4.6Members winning a trophy may be required to attend the Clubhouse on the evening of the competition to be awarded the prize.4.7When a player has a score, which he considers, may be in contention for a prize in a competition deemed “Rule 6 applies” must contact the Club at a time when all scores are likely to be in (normally 8.30pm) to ascertain the position. If he is eligible for a major prize then he must attend the Clubhouse at the appointed time (normally around 10.30pm) for the award. If he does not attend then that prize will be awarded to the next in line who is in attendance.4.8Local rules for Club and other competitions are displayed on the scorecard and any additional ones will be displayed on notices either in the Clubhouse or on the course5.CONDUCT TOWARDS CLUB STAFF5.1No member must under any circumstances reprimand or complain to a member of Club staff. Any complaints must be made either in writing or verbally to the Secretary. ................
