Twin Creeks Village HOA Covenants Committee Meeting NotesMeeting Place and Time: August 20, 2019, 6pm at the NestThose present: Ken Howell, John and Dawn George, and Cindi CooperItems discussed: The next 12 months are going to be a time period of transitioning HOA governance responsibilities from the Developers and to the Community Residents. It was decided that a different person would be the main enforcer each quarter. John agreed to start it off. There were no other officers decided.?AirBnB’s are an immediate major issue/ top priority?for this committee.?The covenants state that rental properties are allowed. However, all agreed there needs to be rules and regulations ASAP for them. Each person that rents out their home for this purpose would be required to register it with the HOA (or office) with their contact information, copy of insurance with the HOA listed as additionally assured (incase of damage to the common areas). Ken was going to check on whether a specific type of common area insurance might be required. Other information would possibly be required but would need to be determined.The owner of the unit would be given a copy of the HOA rules for short term rental to post with parking information for their unit. The owner would be?contacted day or night if the major rules (parking, too many people or too much noise and disruption for the neighborhood was an issue.) It would have to be resolved ASAP or owner would be charged a fine.A list of rules should be developed for the owners to give to the short term renters (maybe like the marina rules for boat rentals). It was mentioned that Mike Cantrell or his brother possibly had an AirBnB some time ago- and therefore might be a good resource for rules, paperwork, etc that we might adapt). Twin Creeks staff will research this and draft up some guidelines.Specific rules would include: No more than two people per bedroom, four people max per bonus room - unless a specific waiver was given for an additional number like fold out couches, etc.Parking in driveway or garage only- with all additional vehicles parked in the designated parking areas at pools, near townhouses, etc.?Per the covenants, no parking in the street for over 24 hrs. Fines for unresolved AirBnB issues would be $100 per day with additional action possible for repeat offenders. The covenants would be updated to include a $100 a day fine for unresolved issues. It was discussed that there are several residents that feel that there should be more actual HOA financial information than the budget printed on the web site. It was suggested that an HOA official meeting next Feb/March with new budget, actuals, etc. could help answer questions.? It was decided that the Covenant committee meetings would not be an “open” committee but upon request. Residents with concerns should submit them via convenants@. The committee could?decide to allow individuals to?make presentations or?attend specific meetings. Communication on specific?decisions or directions and updates community from the committee would be sent out after each meeting. A question on the Club House was brought up: Currently on the website it seems that an official application, deposit and non-refundable $150 deposit was required for anyone to use the Club House. It was noted that reservation policy was really designed to cover weddings, showers, big gatherings and large parties. For?small groups of owners (and a few friends to gather to watch tv, play cards, etc) is really not covered in that policy. It was noted that they will just need to let the office know what is planned and they would be responsible for cleanup so that it is left in the condition it was when they arrived. This issue should be referred to the Amenities committee. December 31 was the date suggested as the date boat trailers would be pulled if they were not registered. Signs, emails, etc would be sent out. Also boat owners in the new area need to lock boats since new construction entrance it located there. Only about 50% currently have the tags as required. The lot can be expanded for the new trailers for new boat docks. However, all boat trailers will still have to be for Village owners. Non-Village owners trailers will be towed off-site. There are some individuals, builders that are simply ignoring the restrictions for building homes. Sample issues are wooden fences, patios too large, back porch not built correct etc. At present, the?covenants do not have any penalty for these violations. Liens cannot be placed without a dollar amount. It was suggested that each violation would result in a $50 a day penalty until corrected or approved and the covenants should be changed to reflect this change. This will be added to the covenants. For the pool- there has been a lot of issues with non-residents using it. Liability was also a?concern. A key fob was discussed- but a lower cost alternative was the distinctive? bracelets for each home and AirBnB ( # to be determined) Possibly a $10 cost per household with those not using pool- not having to purchase them. This should be referred to the Amenities committee. It was discussed that now is the time to update, rework the covenants to make everything work more efficiently when the HOA is turned over.An additional meeting will be set in a few weeks. Ken will get with all committee members to find a time that works best for everyone. ................
