6. DEPARTMENT OF PUBLIC WORKS: Budget Transfers

A. For NYC DEP Permit Costs – This is a budget transfer request to cover the cost for the Annual Delaware Aqueduct Tap Permit from the New York City Department of Environmental Protection for 2014. We now budget cost of each treatment plant separately and will need to create a permit cost line separately for the new DAT treatment plant.

B. Interfund Transfer Meter Costs – Focus during the past year was on meter replacement programs to the Meadow Hill North and South sections of the Town and the commercial accounts along Route 300 and Route 32. Replacement of 1092 older meters with new radio reading technology were completed and there are approximately 5500 meters still remaining in the system that will require the newer radio technology. A proposal was made in the 2014 budget process that the Town of Newburgh fund this program again using another $150,000 from the Interfund Transfer Account with a current balance of $800,000.

MOTION was made by Councilwoman Greene to transfer $150,000 from the Interfund Budget Line to Capital Project for meter costs and the motion was seconded by Councilman Ruggiero.

7. HIGHWAY DEPARTMENT: Leaf and Brush Pick-Up Spring 2014

Information on Spring pick-up schedules will be posted in the local newspapers. It was decided that the article will not be posted in the Times Herald Record. Town trucks will pick up bagged leaves and brush tied in bundles no larger than four (4) feet. Leaves will be in CLEAR BAGS ONLY. A leaf and brush recycling bin is available to the public at the Town of Newburgh Highway Department at 90 Gardnertown Road, Newburgh. Hours are Monday thru Friday 7:00 am to 3:00 pm.

8. ACCOUNTING: Hiring of Part Time Accountant

Gil Piaquadio, Deputy Supervisor and Councilman, requested that Jacqueline M. Calarco be hired on a Part Time basis with an hourly rate of $45.00 with a starting date of April 3, 2014. Hours cannot exceed 20 hours and the employee will be required to use the palm reader to record work hours.

MOTION was made by Deputy Supervisor and Councilman Piaquadio to approve the

hiring of part time accountant, Jacqueline Calarco, and the motion was seconded by

Councilman Woolsey.

9. BI WEEKLY PAYROLL FOR CERTAIN PART TIMERS: Discussion Only

The county has lifted the restrictions on part time employment. Part time employees can now be paid on a two week cycle instead of one week.

10. COMPREHENSIVE PLAN IMPLEMENTATION RECOMMENDATIONS:

A. Solar Panels – Mark Taylor, Attorney for the Town. Presented several options with respect to smaller scale solar panel systems. He asked that the following be considered.

1. Consider as an accessory building – allow all uses under Zoning Code.

2. Accessory buildings – limit the types of usage.

3. Treat as accessory use but include supplemental regulations.

4. Special use permit (Planning Board or Zoning Board)

5. Site for Planning Board approval – Residential (1 Way) and Commercial (Another Way)

Mark Taylor didn’t know of any solar farms in Newburgh. Keith Christiansen from Hudson Solar and Ron Bittner were in the audience. Betty Greene, Councilwoman, asked that the information be forwarded to the fire departments. It was decided to continue the discussion at a later date.

B. Signs - Mark Taylor had discussed the following nuances.

1. You can prohibit flashing, blinking lights.

2. The display itself must be static for a certain amount of

time. The sign can be regulated by how fast it changes

and what is the interval: 1 minute, 5 minutes or 10 minutes.

Betty Greene, Councilwoman, suggested that more

research be done as there is a real increase of cost when a clock and temperature is added to the sign. There was

no motion at this time.

11. RECREATION DEPARTMENT:

A. Trolley Request – Robert Petrillo, Parks and Recreation Commissioner, said that the Town of New Windsor has again requested the use of a trolley and one truck with driver for the Memorial Day Parade on Sunday, May 18th in New Windsor. The driver will need to be a Town employee.

MOTION was made by Councilman Woolsey to approve the trolley and one truck with driver request and the motion was seconded by Councilman Ruggiero.

B. Landscape Bid Award – Sealed bids were opened on Thursday, March 27th. Six bid packages were received. Hudson Hills will be awarded the bid for Grounds Maintenance at Chadwick Lake Park with the lowest price quoted at $258.00 per week for 2014. Lynn Warren Landscaping will be awarded the bid for the Grounds Maintenance at the Part B Water District Additional Properties with the lowest price at $440 per week and Lynn Warren Landscaping will be awarded the bid for the Grounds Maintenance at the Part C General Fund Additional Properties with the lowest bid at $300 per week.

MOTION was made by Councilman Woolsey to award the landscape bids as delineated above and the motion was seconded by Councilman Ruggiero.

C. Hiring of Part Time Laborer – Request to hire Ms. Siobhan Jablesnik as a part time laborer starting April 10th at the rate of $8.50/hour. The salary for this position is in the budget under Acct. #7110-0100.

MOTION was made by Councilman Ruggiero to approve the hiring of this part time laborer and the motion was seconded by Councilman Woolsey.

D. Award of T Shirt Bids – Sealed bids were opened on Friday, February 28th. Fusion Graphix located in Montgomery, NY provided the lowest bid at $2.94 per shirt.

MOTION was made by Councilman Woolsey to approve the award of the t shirt bid and the motion was seconded by Councilman Ruggiero.

E. Dumpsters for Removal of Debris – Robert Petrillo received three (3) quotes for the demolition of the house and barn on the Mill Street property. No asbestos was found in either structure. It was requested that the funds for this project be taken from the Parkland Trust account. Dumpster cost is $524.70/container and Mr. Petrillo thought that we may possibly need 6 containers.

F. Excavators Funded from Parkland Trust Fund – Price quotes were also collected for the costs of an excavator rental. The excavator rental quote was $1,600.00/week.

12. POLICE: Purchase of Ammunition – Chief Michael Clancy requested authorization to purchase a supply of firearms ammunition for the Police Department for training purposes as well as for department issue purposes. The requested ammunition includes 40 caliber handgun ammunition, 12 gauge slug shotgun ammunition, 12 gauge 00 buck shotgun ammunition, 9mm Luger duty ammunition and 9mm Luger practice ammunition. The total cost for the above ammunition is $10,811.44. The amount will be disbursed from the account #3030.499.

MOTION was made by Councilwoman Greene to approve the purchase of firearms

ammunition for the Police Department and the motion was seconded by Councilman

Woolsey.

13. ENGINEERING:

A. CAMO Contract – Town Engineer Jim Osborne discussed the contract with CAMO for Water Supply Management & Operations. CAMO is already running the new plant. CAMOs rates have remained the same over their years of service but Mr. Osborne would like a more definitive contract. Councilwoman Greene asked that the Town of Newburgh be notified within 12 hours of an emergency and not the 24 hours that is now stated in the contract. Gil Piaquadio, Deputy Supervisor and Councilman, or John Platt, DPW Commissioner, would be the primary contacts in case of an emergency. Mr. Osborne will update the Addendum “A” CAMO hourly rates schedule.

MOTION was made by Councilman Woolsey to add personnel with the approval from the Town Board and the motion was seconded by Councilwoman Greene.

B. Gardnertown Road Financing – The Town of Newburgh desires to advance the project by making 100% of the Non-Federal share of the costs of the preliminary engineering, construction, and construction inspection work. The permanent repair work to be borne at the ratio of 80% federal funds and 20% non-federal funds. The Town of Newburgh has authorized the issuance of bonds in the sum of $1,005,045 for the above phase of the project and the proceeds of such bond issuance shall be made available and used to cover the cost of participation in the above phase of the project.

MOTION was made by Councilman Woolsey to approve the SEQR and the motion was seconded by Councilwoman Greene.

C. Marlborough WSA (Water Supply Agreement) – A draft has been prepared and will be sent to all Board members by the end of the week for review. Engineer Jim Osborne advised that the budget for water supply will be split between Chadwick and the Delaware Aqueduct. Important consideration: The water supply states that the Town of Newburgh is not the backup supply to the Town of Marlborough. Need approvals of Terms and Conditions and will then send to Marlborough for their review.

D. Stewart Airport Tank & Related Projects: Financing – The following actions were discussed: Project Elements, Project Financing and Design Engineering Services. Mr. Osborne asked the Board which projects did they want to authorize and how do they want to proceed with the design process. A special meeting in the late afternoon will be scheduled soon to discuss and Jackie Calarco, former Town of Newburgh Accountant, will be asked to attend. Total cost: $2,567,000.

E. Utility Audit: Troy and Banks – Troy & Banks is a professional cost

management and consulting firm specializing in solutions to reduce

utility and telecommunications expenses. T&B will get 33% of what

the Town of Newburgh gets as a refund. Gil Piaquadio, Deputy Supervisor and Councilman, requested review of the contract from Mark Taylor, Attorney for the Town of Newburgh.

MOTION was made by Councilwoman Greene to approve the Troy and Banks consulting firm to reduce the Town of Newburgh utility and telecommunications expenses subject to Mark Taylor, Attorney for the Town of Newburgh. The approval by motion was seconded by Councilman Woolsey.

14. ZONING BOARD: Imposing a Fee for Interpretation – A proposed new Local Law will address a discrepancy between the Town Code’s Schedule of Fees Chapter and its Zoning Code brought to the attention by the Zoning Board of Appeals. The Schedule of Fees provides for a $200 fee for interpretation applications but the Zoning code states no fee shall be required for applications for interpretations. Mark Taylor, Attorney for the Town of Newburgh, will start the process.

MOTION was made by Councilman Woolsey to approve the fee for interpretation and

the motion was seconded by Councilman Ruggiero.

15. ANIMAL CONTROL: Hiring of Part Time Animal Control Officer – Recommendation from Chantel Haight, ACO supervisor, to hire Christopher McFarland as a part time Animal Control Officer. Upon approval from the Town Board, Christopher will need to complete his paperwork, get a physical and have his fingerprints completed. The tentative start date is April 10, 2014 at a rate of $10.40/hour.

16. INSURANCE: Approval of New Amount for Workmen’s Compensation Insurance – The NYS Insurance Fund (Workers’ Compensation) coverage for April, 2014 to April, 2015 is $816,312. Per Gil Piaquadio, Deputy Supervisor and Councilman, the Town of Newburgh received a $38,000 reduction.

MOTION was made by Councilman Ruggiero to approve the new amount for

workmen’s compensation insurance and the motion was seconded by Councilman

Woolsey.

17. CODE COMPLIANCE: Request to Search to Fill Part Time Position – Memo dated March 18, 2014 from Gerard Canfield regarding Patricia Bewick who resigned as 911 Coordinator in Code Compliance effective March 31, 2014. The part time position will need to be filled as soon as possible.

MOTION was made by Councilwoman Greene to fill the part time position

of code compliance and the motion was seconded by Councilman Ruggiero.

18. EXTENSION FOR SETTING OF SEWERAGE RATES: Roseton Hill Sewerage

Works Corp. – The attorney for the Roseton Hills Sewage Works Corp., which

serves the area containing the Parr Valley Condominium and the Orchard Hills of

Newburgh rental complex, advised that the Sewage Works Corporation will be

making an application for a rate modification in the Spring of 2014. The rate per

unit is now $341.00.

MOTION was made by Councilman Ruggiero to approve the resolution on

Roseton Hills and the motion was seconded by Councilman Woolsey.

VOTE: Councilman Woolsey – yes; Councilwoman Greene – yes; Councilman

19. DATA PROCESSING: Purchase of Hours – Purchase of 37.5 hours @ $80.00 per

hour for a total of $3,000.00 for 2010 computer maintenance from Firthcliffe

Technologies of Cornwall, New York (per Gil Piaquadio, Deputy Supervisor and

Councilman). Memo dated 4/2/14 by Deputy Supervisor and Councilman Gil

Piaquadio.

MOTION was made by Councilman Ruggiero to approve data processing:

purchase of hours and the motion was seconded by Councilwoman Greene.
