The 2012 NC Residential Code Will Be Available On-Line 02/28/12; Consequently, There Is No Legal Basis For Inspections Departments To Withhold Building Permits

NCHBA is pleased to report that the 2012 North Carolina Residential Building Code will be posted on- line tomorrow (02/28/12) by 2:00 pm. This new code becomes effective on Thursday (03/01/12). The link is as follows:



While the ICC will not have published the code in its traditional book format by Thursday, the on-line version will allow general contractors, code enforcement officials, other industry professionals, and the general public to view the code in its entirety. Consequently, there is no legal basis to withhold building permits as several jurisdictions have recently threatened to do.

NCHBA has been working closely with officials of the NC Department of Insurance, the Governor’s Office, and the leadership of the General Assembly to resolve this impending crisis.

“Any withholding of building permits would have surely harmed the fragile recovery in the housing market that is beginning to take hold in our state,” said Mike Carpenter, NCHBA Executive Vice President. “We appreciate Commissioner Goodwin’s personal involvement in speaking to officials at the ICC to obtain this result.”

In an email to Commissioner Goodwin today, ICC officials said:

Dear Commissioner Goodwin,

 

Good afternoon.   As a follow up to staff discussions between ICC and NC, please accept this email as confirmation that the North Carolina State Building Code:  2012 Residential  Code  will be available on the ICC Free Public Resources site ()  by 02:00pm EST, Tuesday, February 28,  2012. 

 

An ICC staff member will inform you in advance once the upload of the code is complete and viewable by the general public.

Commissioner Goodwin will shortly be sending out a communication to all code enforcement officials advising them of the availability of the new code and affirming that permits should not be withheld.
