PENSIONERS EMAILS & FEEDBACK FROM 1 st August 2017:SERIES No 153 & 154---------------------------------------------------------------------------------------------------------------------------------1)Thank you very much for your ?detailed Pensioners Feedback mail.I refer to the statement of Mr G Ramamurthy that we need not argue about the benefits as per Pay Commission Recommendations not flowing to LIC Pensioners.I am not able to agree with him for the simple reason that Rule no 56,Rule no 55B & Rule no 55A read together make application of CCS Pension Rules & Pay Commission Recommendations admirably relevant for LIC Pensioners as well. In my opinion,in the light of the above three Rules ,LIC Pensioners constitutionally enjoy as much of pension rights as GOI pensioners under CCS Pension Rules.I feel that we should not miss the valuable opportunity of stressing this in our arguments before the SC.Kind regards.----------CHMahadevan2)We are well aware that all organizations representing all cadres of pensioners are at the last phase of our legal fight in the Supreme Court to defeat the illogical designs of LIC / GOI and come out with colourful victory in respect of our genuine and legitimate demands of 100% neutralization of DR & periodical revision of pension at every stage of hike in the pay scales for working employees. AIRIEF is fully equipped with substantial case laws, forceful constitutional guarantees and the valid points in the basic document of " Memorandum of Understanding " signed at the initiation of LIC Pension Scheme. We have filed our SLP in the SC on 25th of July itself. It is under scrutiny at the SC Registry. Our leaders M/S S.S.Saxenaji, R.B.Kishoreji along with Sri. R.V..Rameshji, Pramod Bhatnagarji, G.Krishnaswamyji, M.P.Agnihotriji, Ranjan Dey Sarkarji and a few other eminent personalities in our organization have taken utmost care in preparation of our SLP and have spared their comforts in consulting our Counsels at Delhi frequently to bring out our SLP a pucca and flawless one. Our final last legal battle is to commence shortly.? ?Friends !? All our leaders are fighting for the welfare of all the classes of retired LIC employees and not for a section of retirees. Under wrong notion, majority of our colleagues wait for the final result without encouraging the leaders with their share of donation. Paucity of funds at the needed hour may jeopardize our prime motive. You will be surprised to learn that son of the deceased M.L.Gandhi and daughter of deceased M.S.Murty have magnanimously donated Rs.75,000 and Rs.2 lakhs respectively in memory of their dedicated and deceased fathers to help the respective organizations in the legal battle for the welfare of the innocent pensioners at large. Therefore they have introduced the Universal Minimum Wage Code Bill in the just concluded Parliament sessions, though the full content of of the bill is yet to reach the social platforms, it is believed that the wages and other benefits for the entire working class in the country will be as per the 7th Central pay commission recommendations, which are reasonably good . It is expected that the bill will be passed in the coming Parliament sessions. Now it is also interesting to note that the hearing of our Appeals against the Hon DHC judgement of 27th April 2017 , in the Hon Supreme Court is adjourned to?10th November 2017, coinciding with the proposed protest by the Central TUs. In this regard I would like to kindly refer to Shri Lsr Krishna Rao's mail on 23-7-2017, wherein Shri Rao had noted that the proposed Wage Code would be beneficial to all the workers as well as the Pensioners, as the Pension is fixed on the basis of wages earned. His inference was based on a news item in the "News-Business Bureau". I had been to Bangalore (where my son resides) and one of the residents also mentioned about the benefits that may flow from the said Wage Code , to the Pensioners in general but I did not ask him on what basis he gave the impression as ? you had also? forwarded Shri Rao's mail on this. Now the Government has introduced the Code in Parliament on 7-8-2017, but I did not find any mention about the Pension therein. Yet flight time itself is 19 hours and from home to home is 29 hours; baggage clearance at Chennai Airport, just 20 minutes, immigration formalities another 30 minutes, ?awesome quick, thanks to the Wheelchair attendant.The marriage function was grand a success and some of my son's school and college mates from Chennai and India, now based in Australia, US and India had come to participate in the function. In this regard we bring to your kind notice that the vital issue of pension revision of 25000 pensioners and family pensioners, who are senior citizens, has been pending for the period of 15 years since 1st Nov. 2002. This issue could have been addressed by the said Committee had there been opportunity to us to present our case before them. We, however, ?were kept in dark about the visit of such important national level Committee to Mumbai on 5th May 2017. Nor it was told to us by those who were in knowhow of it.?3. And encouraged by the implied display of willingness to spare time to listen to an octogenarian.?The recent report of the Parliamentary Committee on Subordinate Legislation headed by you, on the RBI Pension Regulations has been nectar to the Bank's pensioners, particularly the older ones .They are, however, somewhat disappointed that an issue which is of direct relevance to the study and immense concern to the olders did not find a mention in the report . Obviously, the matter was not brought to your notice.?While formulating the Pension Scheme closely following the Government pattern, the administration had scrupulously ensured that the employees' interests were fully protected. One such instance was Regulation 5 , intended to provide, inter alia, for periodical revision of pension in line with the government practice. This was duly highlighted repeatedly in the early 1990s as a "unique feature" while attempting to improve employees' participation in the Scheme.?Living up to the assurances, the Bank, under the Governorship of Dr. Bimal Jalan, sanctioned, in 2003, revision of pension based on the wage structure effective November 1997. The legality of the action was, as a measure of additional caution, got confirmed by? legal luminaries of the like of Shri Harish Salve. The MOF, however, took exception to the Bank's action on grounds of alleged 'illegality'.Attempts to get the updation rolled back was resisted for almost five years with the Central Board of Directors holding the firm view that it would be "unfair, unjust and untenable to withdraw the revision of pension." Nevertheless , on the eve of the assumption of office by Dr. Subbarao as Governor, the Board, "considering the points made by the Government nominee " and " in deference to the wishes of the Government " agreed (on 14-8-2008) to the roll back. Incidentally, this meeting was the last one attended by Dr Rao in his capacity as Government nominee.?The fact that the Government chose to adopt this course to impose its "wish" on the Bank rather than exorcising it's statutory powers to issue directions is clear evidence of its realisation of the impractability of the latter.?The orders pursuant to the aforementioned decision was got stayed by securing judicial intervention, but the pensioners? remain denied of benefits accruing from three subsequent wage revisions .?The long span of almost a decade had been witness to extreme procrastination and ambivalence by the Government, tacitly acquiesced by the Bank.?The worst affected by these developments are the pre-1997 retirees who are now in the age group of 80 to 89. Their numbers have dwindled to three digits from around 3500 in 2003 when revision of pension was granted. In pending Writ Petition(Updation) in Bombay HC,GOI representative made submission?to expedite the case?at the earliest ?as the Govt. exchequer is put to losses on account?of updation granted to pre 1997 retirees of RBI. Nobody objected to this stance of GOI representative.I was personally present when Hon'ble judge Shri Bobade(now in SC) silenced?the GOI representative. Further, we understand that ?IBA is not divulging status of pension fund of PSU Banks. ?Last year the Bank, in comparison?of earlier year,?transferred less fund( i.e. amount based on?actuarial ?advice)?to RBI Pension Fund but at the same time transferred very huge amount ofRs. 65,876 crores to GOI as a dividend.I have a hunch that behind all these happenings nun but bureaucrats of MoF are active and they do these arm-twisting?tactics with an eye on?fund positions?of GOI?owned undertakings. ?I am afraid that in the days to come some different scenario would emerge and all have to oppose it.We also have to understand?why the Bank has not referred serious issue of?updation ?before Subordinate Legislation Committee.
