Lake Angelus City Council MinutesJune 11, 2019Present: Mayor, Dennis Mitchell; Mayor Protem, Natalie Forte; Council members, Joe Hilger, Dan Jenaras, Gary Parlove; Treasurer Julie Frakes; Attorney Charles Kennedy III; LAPD Chief Farley; Building Official, John Jackson; Clerk, Sarah Razzaque. Absent: NoneVisitors, Residents: Dick Lund, Rosalie Lake, Jim Cortez, Katie Williamson, Kathy McGinnity, Don McClellan, Bill Johnson. Mayor Mitchell opened the meeting at 7:00pm with the Pledge of Allegiance. Joe Hilger moved to approve the May 14, 2019 minutes as noted. Natalie Forte seconded, and the motion passed unanimously. Resident/Mayoral Comments/Pending Actions:Joe Hilger has been working on many city building/upkeep projects including, LAPD building, dam repair, and City Hall updates. At this point in time it is suggested that we convene a Property Assessment Committee to review and make suggestions to the council regarding upcoming projects. Joe Hilger has agreed to be the liaison for the committee. The proposed committee would be made up of; Brian Sheridan, Chairman; Mike Shaller, Member; John McNew, Member. Joe Hilger moved to approve the formation and appointments to the committee. Natalie Forte seconded, and the motion passed unanimously. Resignations Special thank you to Don McLellan for all of his efforts with the LAPD. He will be retiring effective July 1. Thanks to Ursula Froelich for her efforts with the Environmental Board. She resigned effective May 16. Special Thanks/CongratulationsCongratulations to Katie Williamson who has received a promotion to Corporal in our Reserves Unit. And if that wasn’t enough, she was elevated to Assistant Auxiliary Aviation Coordinator of Administration and Personnel in the Coast Guard Thanks to the LAWC for sponsoring the welcome back barn party and to the LAYC for throwing another fantastic pig roast. OrdinancesDock Ordinance A revision to dock ordinance 1248.02(g) has been suggested for adoption by the Planning Commission (PC). Gary Parlove moved to approve the revision to dock ordinance 1248.02(g). Dan Jenaras seconded, and the motion passed unanimously. Building and Lot Coverage StandardsA revision to the Building and Lot Coverage Standards ordinance numbers; 1240.08, 1242.04, 1246.07 and 1248.08, has been suggested for adoption by the PC.There was discussion of section 1248.05(b) specifically regarding upper level attics and the language surrounding if they are included in building size calculation. It was decided that it would be the clearest to remove the last sentence of 1248.05(b)(2)(D). Natalie Forte moved to approve the revision to Building and Lot Coverage Standards with the noted modification to 1248.05(b)(2)(D). Gary Parlove seconded, and the motion passed unanimously. Principal Permitted Uses OrdinanceA revision of Principal Permitted Uses ordinance 1254.01 has been suggested for adoption by the PC. This revision is correcting a typographic error. Natalie Forte moved to approve the revision to Principal Permitted Uses ordinance 1254.01. Gary Parlove seconded, and the motion passed unanimously. LAPD/Chief Michael FarleyThe decommissioned LAPD vehicle has been sold. New decals are being placed on the new LAPD vehicle; we hope they will be completed by next meeting. The Chief has selected a new style of “steath decal” for this new vehicle. The department LEIN audit took place and the department results were outstanding. Congratulations to all. The department is currently holding warrants that require monitoring. It has been suggested that we contract with the Oakland County Sheriff to handle this moving forward. The cost is $20 per year per warrant. The Chief will come back to the Council next month with a formal quote. Building and Permits: McKenna Associates/John JacksonPlease see report below. Fire Truck UpdateWe are in the process of getting an expert letter regarding the rust on the fire truck. In addition, we are testing the integrity of the material of the frame. Clerk ReportThere will be 3 City Council positions open at the November election. Appropriate nomination petitions and affidavits will be available upon request and will be due by July 15. A notice will be sent out shortly on the listservEPollbook laptop/accessories have been received and the clerk and deputy clerk have received training on setup. Unfortunately, election workers need to be retrained on the new EPollbook. I will be reaching out to all current city election workers and working to possibly find a few more additions to our list. We will meet some time in July and make sure that we have enough people trained on the EPollbook by our November Election. The new phone system has been in place for several weeks and we have had great success in eliminating hang-ups and it is getting people to the right department. If you call the clerk’s line now you are given options of reaching the clerk, assessor, treasurer, building department and non-emergency lapd. 20 foot strip letters – The Deputy Clerk has received the names and date of sales for the parcels adjoining the twenty foot strip and that is working on compiling the letters to send by certified mail. Attorney Kennedy’s office is in process of scanning and cataloging the important city documents that were discussed last month. Property Manager ReportLooking forward to engaging the new Property Assessment Committee. There is outstanding money to be spent before June 30th, 2019, including money for non-motorized improvements. We will make efforts to spend that before the deadline. As we have had residents use the city barn, it has become clear that we need to update the use agreement. Attorney Kennedy presented the Council with a revision that included a revised “insurance, Liability, and Assumption of Risk” section. In order to rent the barn, a resident must have insurance with a minimum coverage of $500,000 Bodily Injury and Property Damage Liability and $1,500,000 single occurrence. The resident will need to provide proof of insurance in the form of a certificate of insurance showing the City of Lake Angelus as an additional insured. There were several small modifications requested including; additional contact information, addition of the phrase “hold harmless” for insurance purposes. Attorney Kennedy will make the requested changes and will bring the agreement back for approval in the July meeting. Treasurer Report: Julie FrakesThe current budget goal is 91.7%, the actual is 84.6%. With revised budget in place, all accounts line up nicely. Environmental is only at 22.8% but weed treatment will be occurring this month. Julie is working with the assessor to initiate 2019 tax year. The Clerk will sign the L-4029 after budget approval. We are still waiting on school district rates but we have all of the others. Tax bills will be printed and mailed by July 1. Building department report is -$13,871.75 ytd.We renewed CIBC CD for 1 year at 2.25%. Major Road CD matures Friday 6.14, it was suggested that we leave at Flagstar for an additional year. Public HearingNatalie Forte moved to open a Public Hearing on the budget. Joe Hilger seconded the motion and it passed unanimously. Julie Frakes reviewed the results of the budget meeting and the resulting proposed Amended 19/20 Budget. There was no public comment. Gary Parlove moved to approve the Amended Budget. Environmental Board Update: Dennis MitchellWeed treatment occurred today. FireworksSpecial thanks to the Jaegers who are allowing the Ace Pyro trucks to stage at their home. Road CommissionWe are interested in discovering if we can get RCOC to grade the barn drive as they used to include it in the rest of the road grading. This will be investigated. At 9:15 pm Natalie Forte moved to extend the meeting by fifteen minutes. Gary Parlove seconded the motion and it passed unanimously. Insurance: Natalie ForteMMRMA member sharing premium refund check is forthcoming and when received will be given to Treasurer Frakes. LegalChuck Kennedy has reviewed the vehicle repair contract with Interlocal. It should be noted that there is no warranty for any work completed. We will need to request the attachment that was referenced but not provided and we also suggest asking Auburn Hills if they have signed the same contract. In order to make the City Boating Rules be more enforceable Attorney Kennedy has created a Resolution to adopt the boating rules. This resolution would formally make any violation of the rules a civil infraction. Should the violation also be a violation of state law, the more severe will apply. Natalie Forte moved to adopt the resolution. Joe Hilger seconded the motion and it passed unanimously. Public CommentIt was noted that there is concern with outboard motors being banned on pontoon boats. There were several comments for and against the current rule. It was suggested that some residents for and against come together to discuss it before bringing it before council. 9:35 pm Natalie Forte moved to adjourn the meeting. An application was received for 2485 N Lake Angelus Road for site plan review for a new home; we have requested additional documentation to complete the application. Ongoing Building and Zoning Activity 70 Gallogly / 3421 Old Baldwin – Lashier Boundary Realignment We have processed the paperwork for the boundary realignment, and the Assessor will finalize the paperwork with the County. Gray Woods Lane – Residence 385Progress continues as expected. 2360 Lake Angelus Lane – Matisse Residence Temporary C of O has been granted, with heated pavement and site plan completion yet to be fulfilled; we continue to hold bonds to ensure completion of these elements. It has also been brought to our attention that the shed by the water may be been moved – we will ensure it is located where it was prior to the renovations, in compliance with the ordinance. 2370 Lake Angelus Lane – Hemphill Residence There is an approved site plan for renovations and an addition, but no permits have been pulled. 945 Lake Angelus Road – Robbins Accessory Barn The special land use was approved in May by Council, and we have notified the owner. 2445 N Lake Angelus Road – Fair Residence Work is progressing as expected. 610 Lake Angelus Shores – Cramer Residence Garage and porch footings have been approved and progress continues. 742 Lake Angelus Shores – Cobb Property Monthly Development Report June 2019 The following development update is intended to provide a snapshot of the City’s Planning and Building activities between May 10, 2019 and June 7, 2019. The plan will likely require some ruling from the City Council, however the exact request is yet to be determined. Administrative Approvals- We have not issued administrative approvals this month. Building Reviews, Permits, and Inspections 555 Gray Woods Final mechanical has been approved. 2360 Lake Angelus Lane Final plumbing, mechanical, and electrical have been approved. Fireplaces have been approved. Soil erosion controls needed some repairs but have been approved twice since issues were identified. 2445 N Lake Angelus Road 2 soil erosion inspections passed, and the most recent failed; corrections have been requested. 610 Lake Angelus Shores 3 soil erosion inspections have passed, as has the footing inspection for the garage and porch. General Activity and Open Planning Items The Planning Commission recommended approval of several ordinance amendments, which are to be considered by City Council at an upcoming meeting. We anticipate new applications in the future for new builds/renovations at the following addresses: 681 Gray Woods Lane – new home 2485 N Lake Angelus Road – Clapham home – plans expected in the coming months. The following items require additional follow-up or may be discussed for future consideration: Tree Preservation Ordinance Review – Beginning to review recent regulations and make improvements to the new process. Seawall Ordinance Review Lake-side setback standards Restoration to original slope with home demolition – new item request from the PC to address e. Fee schedule update Lighting Standards Noise nuisances Nonconforming Structure Ordinance – PC request to review this section of the ordinance Chapter 1220 – outdated Michigan Planning and Zoning act references.
