COMMISSIONER’S PROCEEDINGS

REGULAR SESSION

October 20, 2020

The Lyman County Commissioners met in regular session in the Conference Room in the Courthouse at Kennebec, South Dakota, October 20, 2020, at 9:00 a.m. with the following members present: Chairman Bill Lengkeek, Leslie Reuer, Ryan Huffman, Zane Reis, and Auditor Deb Halverson. Jared Schelske was present after bills were approved.

CALL TO ORDER:

Chairman Lengkeek called the meeting to order with the pledge to the flag.

ADOPT AGENDA:

Motion by Reuer, seconded by Reis to adopt the agenda. All voting aye.

APPROVE MINUTES:

Motion by Reis, seconded by Reuer to approve the minutes of October 6, 2020. All voting aye.

BUILDING PERMITS:

Motion by Reis, second by Huffman to approve the following building permits. Roll call vote: Lengkeek – aye, Reuer – abstain, Schelske – aye, Reis – aye, Huffman – aye. Motion carried.

1) Al Arndt to build a 50’x112’ pole barn at SW4SW2 of 20-105-74.

2) Keith & Leslie Reuer to build a 30’ grain bin at 33147 245th St, Reliance SD.

PLAT:

Motion by Reis, second by Reuer to approve the Plat of Arendt Lot 3 Lying in the SW4SW4, Section 20, T105N, R74W, 5th P.M., Lyman County, SD. Roll call vote: Lengkeek – aye, Reuer – aye, Schelske – abstain, Reis – aye, Huffman – aye. Motion carried.

LICENSE AGREEMENT:

Motion by Schelske, second by Reuer to approve a license agreement with Black Knight Data & Analytics, LLC for GIS data. All voting aye.

HOLIDAY ADMINISTRATIVE LEAVE:

Motion by Reis, second by Reuer to approve administrative leave for November 27th and December 24th, following what Governor Noem has approved for State employees. All voting aye.

DEPUTY DOE:

Motion by Reis, second by Huffman to accept the resignation of current Deputy DOE Kayla Beegle effective October 1, 2020, and approve DOE Gran to advertise for a full-time deputy. All voting aye.

AUDITOR’S OFFICE STAFF:

Auditor Halverson explained that on Election Night the ballot counting machine must be run by an Auditor’s Office staff member. In the unusual event that both the Auditor and Deputy Auditor are out due to quarantine or illness on election night, motion by Reuer, second by Reis to give Auditor Halverson the authority to Deputize someone for the sole purposes of running the 2020 General Election. All voting aye.

PRE-DISASTER MITIGATION PLAN:

FEMA has approved the submitted Pre-Disaster Mitigation Plan. Motion by Huffman, second by Schelske to approve Resolution 2020-05. All voting aye.

RESOLUTION 2020-05

A resolution of the Lyman County Commission declaring its support for, and adoption of, the Lyman County Multi-Jurisdiction Pre-Disaster Mitigation Plan.

WHEREAS a Pre-Disaster Mitigation Plan for Lyman County (the Plan) has been developed; and

WHEREAS Lyman County participated in the development of the Plan; and

WHEREAS the Plan will be used as a disaster mitigation planning tool as deemed appropriate by the Lyman County Commission.

NOW THEREFORE BE IT RESOLVED that the Lyman County Commission hereby adopts and supports the Plan, and will take action to ensure that the Plan is implemented.

SCENT POLICY:

Courthouse employees Misti Ramser, Kalli Houchin, Lori Marsh, Sara Floyd, Stacie Gran, Margo Mitchell and Walt Nagel were present. Three different options of a fragrance-free or limited workplace had been presented to employees before the meeting and were discussed as well as a legal opinion submitted from States Attorney Smith. Although Smith recommended passing some sort of policy from a legal standpoint and the majority of employees opted for a fragrance limiting policy option, at this time the commissioners do not feel such a policy is necessary and have advised Custodian Marsh to purchase air purifiers to help with smells in the courthouse. Ramser, Houchin, Marsh, Floyd, Gran and Mitchell left the meeting.

HWY/WEED DEPT:

Hwy. Supt. Walt Nagel discussed the lakebed created on County Road 17. The state has found the culvert that has been in question and the county will send a letter requesting the state fix the issues caused by them filling in our ditch to create the lakebed. The bridge south of Kennebec on the Tripp County line is getting rip rap as part of a state project. The state will be paying 80% of the cost and the other 20% will be split equally between Lyman and Tripp Counties. The shed by the highway shop that the ambulance is housed in is in need of repairs. The crew will plan to work on it in the spring. The highway crew is still working on finishing mowing for the year and plan to start inspecting culverts soon. A road slide is happening on a road south of Reliance. Nagel will look into the possibility of moving the road over enough to get out of the slide area. The State weed grant was discussed at length. At this time, the requirements to get the grant do not justify the small return as the State continues to allocate less money to it each year. The general consensus is to not have Nagel participate in the program unless the funding goes up to make it more justifiable.

FEMA UPDATE:

Auditor Halverson gave an update on 2019 FEMA declarations. As of October 14th, all projects submitted to FEMA have been allocated and our projects are now finished. In total, Lyman County received $422,511.59 from FEMA and another $63,000.00 from the State from the Emergency Relief Fund. That totals reimbursement of $485,511.59 for 2019 flooding.
