PUBLIC COMMENT:

No one was present to make a public comment.

ZONING:

Erin Collins-Miles, Zoning Director met with the board to discuss zoning business. Gary Gangle was present for the re-zone hearing for his property described as A portion of Lot 1, Block 1 of Gangle’s Subdivision of Roykota in NE ¼ SW1/4 Section 27, T126N, R55W of the 5th P.M., Marshall County, South Dakota to be rezoned from Agricultural to Lake Front Residential. Symens moved, Knebel seconded to approve the Rezone and to proceed with the 1st reading of the rezone ordinance. All members voted aye.

Mark Nelson was present to request a 30 foot variance from the 30 foot setback requirement from the right-of-way line to place a car port. No objections were received from the public. Symens moved, Luttrell seconded to approve the variance as requested. All members voted aye.

Ralph Skare was present to request a building permit. Knebel moved, Luttrell seconded to approve building permits for the following applicants: Ralph Skare, Michael Parham, Sy Hansana, Ryan Furman, Mark Luitjens, Britton Country Club, Maria Crowly, and Kevin Schultz. All members voted aye.

Shannon Lee, Director of Equalization, Harland Peterson, Tom Martins and Jean Fagerland, NRCS met with the board to discuss the County Shelterbelt Ordinance. Peterson stated that the current Ordinance has worked fine, but they can easily handle a change as well. Lee reported that the difference in right-of-way width on some State Highways sometimes could cause confusion because the current ordinance just states that shelterbelts must be 75 feet from the right of way line. The board also discussed that the ordinance would be enforced on new shelterbelts, replacement of current shelterbelts would be grandfathered in.

ORDINANCE 44:

The second reading of Ordinance 44 was completed:

ORDINANCE NO. 44

AN ORDINANCE AMENDING ARTICLE III, SECTION 302

AS AMENDED TO REZONE CERTAIN DESCRIBED PROPERTY

BE IT ORDAINED by the Board of County Commissioners of Marshall County, South Dakota: that Article 3 Section 302 adopted by Ordinance No.31, January 29, 2008 as amended, of the Zoning Ordinance of Marshall County be amended to classify the following property:

Proposed Lot 31B Schlekeway Beach in Gov’t Lot 3, Section 19, T126N, T53W of the 5th P.M., Marshall County, South Dakota also defined as an area 88’ wide by 150’ deep across the 40’ roadway from Lot 31 & 32 Schlekeway Beach.

To “R3” Lake Front Residential District from “AG” Agricultural District

BE IT FURTHER ORDAINED by the Marshall County Commission, Britton, South Dakota, that the zoning official for the County of Marshall is hereby authorized to change the official zoning map for the County of Marshall to reflect this Ordinance.

Knebel moved, Symens seconded to approve the proposed ordinance. All members voted aye.

ORDINANCE 45:

The first reading of the following ordinance was completed in regular session of the Marshall County Commission:

ORDINANCE NO. 45

AN ORDINANCE AMENDING ARTICLE III, SECTION 302

AS AMENDED TO REZONE CERTAIN DESCRIBED PROPERTY

BE IT ORDAINED by the Board of County Commissioners of Marshall County, South Dakota: that Article 3 Section 302 adopted by Ordinance No.31, January 29, 2008 as amended, of the Zoning Ordinance of Marshall County be amended to classify the following property:

A portion of land (proposed Lot 1A) approximately 63’ x 175’; being north and adjacent to Lot 1, Block 1 of Gangle’s Subdivision of Roykota in NE ¼ SW ¼ Section 27, T126N, R55W of the 5th P.M., Marshall County, South Dakota

To “R3” Lake Front Residential District from “AG” Agricultural District

BE IT FURTHER ORDAINED by the Marshall County Commission, Britton, South Dakota, that the zoning official for the County of Marshall is hereby authorized to change the official zoning map for the County of Marshall to reflect this Ordinance. The second reading of this ordinance is scheduled for October 23 at 10:00 am in the Commissioner meeting room.

TAX DEED:

Auditor Megan Biel informed the board that the following properties had been taken by the County on Tax Deed:

1. A tract of land 111 rods north from the southwest corner measured from te center of the county road of the Southwest Quarter (SW1/4) of Section Twenty-five (25), Township One Hundred Twenty-nine North (129N), Range Fifty-three (53), West of the 5th P.M., Marshall County, State of South Dakota, then 38 rods East to west line of parcel, then north 30 rods, then 40 rods east, then 30 rods south, then 40 rods west to the point of beginning. The tract is 30 rods times 40 rods of 1,200 square rods, consisting of 7.5 acres.

2. Lots Five (5), six (6), and Seven (7), Block One (1), Original Veblen, Marshall County, South Dakota.

The board asked that these parcels be advertised for sealed bids to be opened on November 8, 2018 at 10:30 am.

FUEL QUOTES:

Sandy Dinger received the following quotes for #2 Diesel for the Langford, Eden and Veblen shops: DaMar Elevator Langford $2.58, Eden 2.63, Veblen 2.68; Eden Oil All Locations 2.58; Holland Bros Oil All locations 2.60. Diesel fuel was delivered to the Langford, Eden and Veblen shops by Eden Oil.

SURPLUS:

Knebel moved, Schuller seconded to declare the following items previously used in the Sheriff’s office surplus with $0 value and to dispose of the items: HP Officejet 6100 Printer Serial #CN29M2R2RGCJ and 2011 AED Serial # X03C012272. All members voted aye.

RESOLUTION:

Schuller moved, Luttrell seconded to pass the following resolution:

RESOLUTION FOR RAILROAD CROSSING IMPROVEMENTS

WHEREAS, Marshall County desires the construction and improvement of the railroad crossing approximately ¾ mile North of Britton City limits on 423rd Ave. between 108th St and 109th St.

AND WHEREAS, Marshall County is obligated and hereby agrees to provide proper maintenance for approaches, signing, and pavement markings after construction is completed and to regulate or cause to be regulated the installation of utility facilities within the limits of the right-of-way of the proposed project in accordance with State and Federal requirements.

NOW THEREFORE BE IT RESOLVED: That the South Dakota Department of Transportation be and hereby is authorized and requested to program for construction, the rail crossing at the above location. Marshall County will have funds available for the required 10% match on total costs of the project.

Vote of Commissioners: 5 yes, 0 no.

SHERIFF:

Sheriff Dale Elsen met with the board to discuss Sheriff’s office business. The board accepted the resignation of Deputy Thomas Klein effective November 2, 2018.

Elsen informed the board that Mike Marquette has been hired as Deputy Sheriff effective October 29 at a rate of $20.69/hour, Brian Bard has been hired as a transport officer effective October 1 at a rate of $15.26/hour, and Douglas Oelkers and Dave Deutsch have been hired as transport officers effective October 1 at a rate of $12.84/hour. The transport officers were previously contracted officers, but as they use county vehicles to transport prisoners, they will now be county employees so that they will fall under County property insurance coverage. Elsen is also advertising for another deputy position.

Sheriff Elsen informed the board that the Sheriff’s department has been denied the Federal Safety Overtime grant for 2019.

LIQUOR LICENSE:

Chris Green, Mindy Mertens, Pat Mealy and Andrew Glass representing Prairie Sky Ranch and Tom and Deb Opsahl representing Roy View Golf Course were present for the auction of a liquor license in Marshall County. Prairie Sky won the bidding with a high bid of $6,000.

WELFARE:

Knebel moved, Luttrell seconded to deny a welfare claim to Avera St. Luke’s Hospital. Reason: Claim was for Detox and was not pre-authorized. All members voted aye.

SAFETY:

Linda Haaland, Safety Director, met with the board to present the 2018 Loss Control/Safety Awards. Marshall County received both the Gold and Platinum awards.

LEGISLATIVE UPDATE:

Paul Dennert met with the board to introduce himself and discuss legislative updates and concerns with the board.

4H:

Jennifer Ringkob, 4H Youth Advisor met with the board to give a 4H update and to inform the board that she has been asked to be the advisor for a 4H Ambassador group.

ABATEMENT:

Knebel moved, Schuller seconded to abate 9 months 2017 payable 2018 of taxes on a building on parcel 03.01.01.0020 due to the building burning down in March of 2017. All members voted aye.

ADDED TAX:

Knebel moved, Schuller seconded to approve the following added tax bills for 2017 payable 2018 taxes: Parcel 03.01.11.0013 equalized value $44,352, duration: 5 months; Parcel 03.09.01.0007 equalized value $10,806, duration: 7 months. All members voted aye.

EMERGENCY MANAGEMENT:

Knebel moved, Schuller seconded to authorize the chair to sign the SLA quarterly reports as presented. All members voted aye.

CUSTODIAN:

Symens moved, Luttrell seconded to hire Lori Greenmyer as a Part-time (approximately 15 hours/week) custodian at the Courthouse at a rate of $12,860/year and Savannah Person as a part-time (approximately 5 hours/week) custodian at the Courthouse at a rate of $3,920/year. All members voted aye.

TRAVEL:

Luttrell moved, Knebel seconded to authorize the following travel expenses: Jennifer RIngkob to Brookings for an Annual Conference October 22-25; Linda Haaland and Sandy Dinger to Pierre November 7-8 for a Joint safety and Loss Control Training Conference; Dustin Hofland to Rapid City October 16-18 for LTAP Regional Local Road Convention. All members voted aye.
