Encl: (1) Rules of Court, Western Judicial Circuit w/enclosures

1. Purpose. To implement references (a) through (d) and promulgate and establish uniform local rules of practice applicable to court-martial practice within the Western Judicial Circuit.

2. Applicability. The Circuit Rules of Court contained in enclosure (1) and references (a) through (f) shall apply to all Navy and Marine Corps general and special courts-martial tried within the Western Judicial Circuit.

3. Cancellation. All Local Rules of Court within the judicial circuits formerly known as Sierra, Northwest and Southwest Judicial Circuits previously promulgated within those circuits are hereby cancelled.

4. Action.

a. All rules set forth in references (c) and (d), and enclosure (1) shall be followed by military and civilian counsel trying general and special courts-martial within the Western Pacific Judicial Circuit.

b. The Circuit Military Judge shall ensure that copies of references (c) and (d), and enclosure (1) are provided to the Commanding Officers of the appropriate Trial Service Office, Regional Service Office, Regional Defense Counsel, Marine Corps Legal Service Support, Naval Legal Service Office, Staff Judge Advocates, Military Justice Officers and other designated personnel for further distribution to all military counsel under their command and cognizance.

c. The Circuit Military Judge or his designee shall indoctrinate all new military trial and defense counsel in the Western Judicial Circuit on the rules of practice prior to their first court appearance.

5. Responsibility. The Circuit Military Judge, Western Judicial Circuit is accountable for providing timely, efficient and comprehensive judicial services to all Navy and Marine Corps activities within the Western Judicial Circuit area of responsibility as designated by the Judge Advocate General of the Navy. All requests for assignment and detailing of a military judge shall be determined by the Circuit Military Judge or his District designee.
