MEMORANDUM OF UNDERSTANDING

WHEREAS, the normal workday for full time twelve-month employees for the summer months is set forth in the current Collective Bargaining Agreement between the Pleasant Valley Educational Support Professionals Association (“Association”) and the Pleasant Valley School District (“District”); and,

WHEREAS, the District, starting June 13, 2010 and continuing through August 21, 2010, wishes to institute a four (4) day work week for all twelve-month employees, designated as Energy Conservation Summer Hours (“ECSH”).

NOW, THEREFORE, the Association and the District agree as follows:

1. The hours for support staff personnel shall be defined as between 5:00 a.m. to 11:30 p.m. Monday through Friday. The basic work week during ECSH will be a four (4) day week. Coverage and work done outside of these days and time will be offered to regular employees (first by way of alternate scheduling, second by offering overtime pay) prior to seeking substitute coverage.

2. Full-time Secretaries, Bookkeepers, Computer Technicians, and Help Desk Technicians are to work 32.5 hours per week plus a half (½) hour or one (1) hour unpaid lunch each day during ECSH. These employees shall work eight (8) hours and thirty-eight (38) minutes each day with a half (½) hour or one (1) hour unpaid lunch break. Working hours/shifts shall be determined through the collaboration of employees and supervisors, with the understanding that Supervisors retain the right to set the hours/shifts in the absence of agreement.

3. Full-time Custodial, Maintenance, Warehouse and Courier Staff are to work forty (40) hours per week plus a half (½) hour unpaid lunch each day during ECSH. These employees shall work ten (10) hours each day with a half (½) hour unpaid lunch break.

4. For the summer of 2010, Pleasant Valley High School, Pleasant Valley Middle School/District Office, Pleasant Valley Intermediate School, Pleasant Valley Elementary School, Polk Elementary School, Eldred Elementary School, Chestnuthill Elementary School, and the Pleasant Valley Operations Facility will be open and staffed Monday through Thursday. However, Pleasant Valley High School, Pleasant Valley Middle School, Pleasant Valley Elementary School, and Eldred Elementary School may be open and staffed for partial occupancy on Friday. Additionally, Pleasant Valley High School may be partially open and staffed on Sunday.

5. No employees will lose wages or benefits through the implementation of ECSH. Each day will count as one and one-quarter (1¼) day. This provides the necessary hours to account for a full week. July 4th, which falls on Sunday, will be observed on July 5th. Each employee will receive one and one-quarter (1¼) day of pay for that paid holiday.

6. Regarding the use of a one-half (½) vacation/personal/sick day:  The first time, a half (½) day will be worth one-half (½) of a day.  The second time a half (½) day is used, it will be worth three-quarters (¾) of a day.  This totals one and one-quarter (1¼) days.  For the purpose of half (½) days taken during ECSH, the half (½) day will be the midpoint of the employee’s scheduled shift.

7. The District reserves the right to revoke the four (4) day work week at its discretion.

8. This Memorandum, during the period June 13, 2010 through August 21, 2010, unless revoked sooner by the District, supersedes the following provisions of the current Collective Bargaining Agreement:

(a) Article IV – Wages and Hours, Sections:

2.B. Custodians;

3.B. Maintenance/Warehouse Personnel;

5.B. Secretaries;

6.B. Bookkeepers;

8.B. Courier; and,

9.B. Computer Technicians/ Help Desk Technicians.
