Dear Parties:

I am writing to inform you of a proposed settlement of the above-referenced case. UGI Utilities, Inc. - Gas Division (UGI), the Bureau of Investigation & Enforcement (I&E), the Office of Consumer Advocate (OCA), the Office of Small Business Advocate (OSBA), the Industrial Energy Consumers of Pennsylvania (IECPA), and the United States Department of Defense and all other Federal Executive Agencies (DOD/FEA) have signed and filed a Joint Petition For Approval of Unopposed Settlement of All Issues (Settlement Petition). A copy of the Settlement Petition was sent via email to you by the company on August 3, 2020.

After I have reviewed the proposed settlement, I will prepare a written recommended decision, which you will receive, recommending that the Commission adopt or reject the Settlement Petition. The Commission will make a final decision on whether or not the proposed settlement should be approved.

As a Complainant, you have an opportunity to submit comments or objections to me after you review the Settlement Petition. If you wish to comment or object, you must send your written comments or objections to me, with a copy to the company, I&E, OCA, OSBA, IECPA, and DOD/FEA. Due to the COVID-19 pandemic, Commission offices are currently closed, and I do not have access to regular mail. Therefore, if you wish to comment on, or object to, the Settlement Petition, you must do so by emailing my legal assistant Pamela McNeal at pmcneal@. Your written comments or objections must be electronically time-stamped as received no later than 4:30 p.m. on Thursday, August 13, 2020. Any correspondence electronically time-stamped as received later than 4:30 p.m. on August 13, 2020, will not be reviewed.

The opportunity to submit written comments on, or objections to, the Settlement Petition is a means of expressing your opinions regarding the proposed settlement and the rate case before my recommended decision is issued. Your right to file exceptions and/or reply to exceptions to the recommended decision is not affected by this settlement unless you decide to join in the Settlement Petition, as explained below. If you intend to object to the Settlement Petition, you must include facts, affidavits, argument and relevant legal analysis as substantiation.

If, after you review the Settlement Petition, you wish to join in, you may do so by completing and returning to me, via email to my legal assistant, a copy of the Signature Page enclosed with this letter. If you wish to join in but are unable to print/sign/scan/email the Signature Page, you may type in your information and email it to my legal assistant. Please understand that by completing and returning the Signature Page you will be signifying that, as a signatory party, you do not wish to further prosecute your Complaint unless the Commission rejects or modifies the Settlement Petition.

If you do not wish to comment on, object to, or join in the settlement, you may do nothing.
