2011 Legislative Scorecard

Tracked Bill Summary

OCBC’s ability to address tough public policy issues that impact Orange County is aided in part by our annual Legislative Scorecard, which lists the major bills we will be tracking this session, along with the voting record of each member of the Orange County Legislative Delegation.

We will provide this list of tracked bills and voting record to OCBC’s Board members and general membership, as well as the media at the end of each session.

Listed below are the key bills we will track and score as part of the 2011 Legislative Scorecard.

INFRASTRUCTURE

AB 550 (Huber) – Peripheral Canal – OPPOSE

Undermines water supply reliability and threatens the economic viability and stability of areas south of the Delta. It’s also a blatant repeal of the historic Delta/water management legislation enacted in 2009.

AB 700 (Blumenfeld) - Infrastructure and Economic Development Bank- SUPPORT

Provides greater independence and autonomy for the I-Bank.

SB 468 (Kehoe) - State Highway Projects: Coastal Zone- OPPOSE

As introduced, SB 468 will likely prevent any further and necessary expansions of the state highway system within or near the coastal zone.

SB 580 (Wolk) State parks: acquired land: limits on disposition or use - OPPOSE

Stops infrastructure projects (utility, roads or water) from occurring within state park boundaries. Opens up lawsuit opportunities by those alleging the use is incompatible with park purposes.

WORKFORCE HOUSING

AB 208 (Fuentes) – Land use: subdivision maps: expiration dates – SUPPORT

Facilitates the smooth recovery of the housing market by extending the life of active tentative subdivision maps and parcel maps for a period of two years.

SB 469 (Vargas) - Land use: development project review: superstores – OPPOSE

Undermines local land use discretion by mandating a costly economic and community impact report prior to approving a retail business.

SB 643 (Correa) – Administrative Process – SUPPORT

Helps provide a clearer understanding of the economic impacts of new housing regulations by requiring agencies to specifically cite their “estimated cost of compliance” associated with a proposed regulation and to make available the assumptions/analysis used in arriving at those estimated costs.

SB 729 (Leno) - Foreclosures: Loan Modifications - OPPOSE

Hinders recovery of the residential construction industry by reducing the availability of credit due to delays in resolving delinquent loans by requiring lenders to determine a borrower’s eligibility for a loan modification prior to the filing of a notice of default.

WORKFORCE DEVELOPMENT

AB 790 (Furutani) – Linked Learning Pilot Program – SUPPORT

Establishes a Linked Learning high school pilot program that would allow participating districts to implement a district-wide Linked Leaning approach in all high schools.

AB 1304 (Block) – Applied Learning Strategies – SUPPORT

Would encourage the California Commission on Teacher Credentialing to develop a linked learning recognition of study, as well as create a visible teacher pipeline for pathways throughout California.

ECONOMIC DEVELOPMENT

AB 29 (J. Perez) - Codify Office of Economic Development -SUPPORT

Establishes the Office of Economic Development (“GoED”) within the Governor’s Office.

SB 366 (Calderon) - Regulations: agency review - SUPPORT

Imposes a regulatory review process with the intent to improve California’s regulatory environment.

SB 474 (Evans) – Commercial construction contracts: indemnity - OPPOSE

A measure that, in attempting to limit indemnity and defense obligations in the commercial construction, actually provides immunity for subcontractors.

Environment/Environmental Reform

AB 638 (Skinner) - Fuel resources - OPPOSE

This bill would increase transportation costs by mandating an unrealistic reduction of petroleum fuel consumption with an unrealistic increase in alternative fuel consumption

AB 880 (M. Pérez) – Expedited Environmental Review – SUPPORT

Streamlines the California Environmental Quality Act (CEQA) approval process for energy efficiency projects/installs of certain entities subject to greenhouse gas (GHG) regulation compliance under AB 32 by authorizing the use of focused environmental impact report (EIR) for GHG compliance projects.

SB 237 (Wolk) - Climate Change Tax - OPPOSE

This bill seeks to take an unspecified percentage of funds from “market-based compliance mechanisms” (i.e.; Cap-and-Trade) for purposes that are not in the AB 32 scoping plan and that do not meet the criteria of AB 32 by funding grants to the agriculture sector.

SB 533 (Wright) - State Air Resources Board regulations -SUPPORT

Creates a more clear and reasonable pathway for AB 32 compliance by requiring the State Air Resources Board (ARB) to provide appropriate implementation schedules and other notification requirements for regulations adopted by the ARB pursuant to AB 32.

SB 535 (DeLeon) - California Communities Healthy Air Revitalization Trust - OPPOSE

Increases costs and discourages job growth by implementing unlimited fees and taxes under a cap and trade system.

Health Care

AB 52 (Feuer) – Health Care Coverage Rate Approval – OPPOSE

This bill would force implementation fees on health insurers to create additional bureaucracy and apply rate regulation on health insurance products sold in California by requiring a complex and regulated rate approval process.

SB 810 (Leno) Single-payer health care coverage - OPPOSE

Creates a new government-run, multibillion-dollar socialized health care system supported by an unspecified "premium structure" to be determined by 2014 by prohibiting the sale of any private health care insurance.

GENERAL BUSINESS ISSUES

Labor Relations

AB 335 (Solorio) Workers Comp – SUPPORT

This bill would require notices and rules governing notices that are provided to employees in the workers' compensation system be written clearly and in plain language.

AB 350 (Solorio) - Displaced Janitor Opportunity Act– OPPOSE

Inappropriately alters the employment relationship by requiring any successor contractor to retain employees of the former contractor for 90 days and thereafter offer continued employment.

AB 400 (Ma) - Employment: paid sick days -OPPOSE

Unreasonably expands both public and private employer’s costs and liability for new protected and paid sick leave for employees.

SB 432 (De León)  Workplace safety: lodging establishments: housekeeping.- OPPOSE

This bill would require the Occupational Safety and Health Standards Board (OSHSB) to develop an occupational safety and health standard for lodging housekeepers, including the requirement of fitted sheets and long handled tools.

SB 883 (Correa) - Division of Labor Standards Enforcement - SUPPORT

Provides employers who rely in good faith upon and in conformity with the opinions, interpretations, guidance, advice, or orders of the Division of Labor Standards Enforcement (DLSE) with an affirmative defense.

Taxes

AB 935 (Blumenfield) - Foreclosure Tax - OPPOSE

Imposes $20,000 tax on banks per foreclosure with money distributed to a variety of community agencies and local causes unrelated to foreclosure.

AB 1326 (Furutani):  Oil and Gas Severance Tax - OPPOSE

Creates a targeted tax on the oil and natural gas industry in order to fund the California Higher Education Endowment Corporation, thereby discouraging oil production in this state which may lead to the loss of more jobs.

SB 653 (Steinberg) - Proposed Expansion of Local Tax Authority – OPPOSE

This bill would drastically alter California’s tax structure by extending new taxing authority to counties, cities and school districts, creating uncertainty and conflicts for multi-jurisdictional businesses.

Local Government

AB 506 (Wieckowski) - Municipal bankruptcy - OPPOSE

Adds an unnecessary layer of bureaucracy for local government entities that need to file for bankruptcy and could, potentially, raise costs to the business community and the state.

SB 437 (Correa) – OCTA - OPPOSE

This bill would change the way members of the OCTA Board are selected.
