State Board of DentistryMeeting SummaryDecember 9, 2016Prosecutorial ReportDentist employed an individual without permit to perform radiographs. Consent agreement: for the dentist a cease and desist order, a $2,000 civil penalty, charged the cost of investigation and continuing education. The non-permitted individual was issued a cease and desist order and charged a $500 civil penalty.Dentist with a Pennsylvania and New Jersey license was charged with theft in the latter state. Consent agreement: dentist agreed to a voluntary surrender of his Pennsylvania license.Board Counsel/Regulatory Counsel ReportRegulatory Counsel reviewed the latest draft of new regulations for anesthesia permit holders. The following changes have been made:The regulations now reference the most current guidelines from the American Dental Association (ADA) and the American Academy of Pediatric Dentistry (AAPD). Definitions of the different anesthesia modalities now reflect definitions provided in the ADA and AAPD guidelines.The regulations now include a list of medications that certain permit level holders are prohibited from using. Some board members expressed reservations about providing a list that could become outdated or might adversely change providers’ treatment plans. A representative from the association representing nurse anesthetics also voice concerns about the regulations listing prohibited medications. However, the board did not change the draft as currently written (see attached).The regulations provide further clarification the role of nurse anesthetists in dental offices and dentists’ supervisory requirements over them.The board voted in favor of the draft regulations. They now move to the Governor’s Policy Office for review. From there, the draft regulations will be published as proposed rulemaking in the Pennsylvania Bulletin, initiating a 30-day public comment period for stakeholders, the Independent Regulatory Review Commission and the House and Senate licensure committees. Chair’s ReportDr. Erhard commended Ms. Theresa Groody, Ms. Bonnie Fowler and Dr. Shawn Casey, board members, for having attended the PA Coalition for Oral Health’s (PCOH) Dental Workforce Innovation Summit in November. Ms. Groody reported that they presented information about utilization of expanded function dental assistants in dental offices and clinics. Dr. Erhard stated that the board posted a notice on its website alerting licensees to new continuing education (CE) requirements under Act 124 of 2016. The notice states that those licensees who must adhere to the Act will not have to obtain two hours of opioid-related CE until the 2019/20 licensure cycle. The board is working with the Department of Health (DOH) to approve courses that licensees may take for credit. The board is also currently working on the process for approving coursework taken by new applicants for licensure. Committee ReportsLicensure Committee: The committee is discussing whether or not to recommend that the board increase its continuing education credit requirements from 30 hours for dentists, 20 for hygienists and 10 for expanded function dental assistants. The committee will offer its recommendation in the near future.Legislative and Regulatory Review Committee: No report.
