Tim Hansen, Attorney ~ Hansen Law Office ~ MN State Bar Association Committee

Tim updated those in attendance with information from the Bar Association Committee on the proposed Transfer on Death Deed. This is a new deed would transfer property upon death of the grantor. This has already gone through the Senate and should become effective August 1, 2008. The deed can be used as a will substitute. However, the grantor reserves 100% interest and control in the property and can sell or revoke at any time prior to death. It is not exempt from medical assistance liens. The Transfer on Death Deed is exempt from State Deed Tax. No CRV is needed and pre-approval from the examiner of titles is required on Torrens property. Upon death of the grantor, the Affidavit of Survivorship and Death Certificate will be recorded and at that time the transfer will take place with the Auditor/Treasurers office

Well Disclosure increasing to $45.00 effective July 1, 2008

See attached letter from the MN Department of Health regarding well disclosures on foreclosed property.

Tim Murphy, Attorney ~ Adverse Possession:

Mr. Murphy discussed with the group issues some counties have with Adverse Possession (boundary issues). A copy of his handout is attached.

Notary Certified Copies:

Some of the counties present noted that they have received documents from the Common Wealth of Pennsylvania where a notary is certifying that the document is a true and actual copy of the original. The county recorders are concerned that they should not be recording the documents, as the notary may not hold the original document.

Affidavit of Lost Mortgage:

The county recorders are also receiving a copy of an original mortgage with an “Affidavit of Lost Mortgage” attached to the top for recording. Per a memo from Bill Lonergan with the Minnesota Department of Revenue, this document is subject to MRT. (See attachment.)

County Recorder Updates:

Reminders from the counties: use Standard Recording slips when submitting documents and have your documents in the same order as listed on the slip. If the property is Torrens, that must be indicated on the recording slip so the documents get sent to the Torrens department. It is the submitter’s responsibility to indicate which department the documents need to be recorded in. Please do not highlight documents. It affects the scanning procedures. All counties require separate checks for MRT, SDT, and recording fees. A question was brought up regarding MRT on an Assignment of Rents document. See attachment regarding the requirements.

Winona ~ A boundary commission is working on an area by Elba, MN that has numerous boundary line issues. They are working on setting up LandShark…no confirmed date yet.

Freeborn ~ They have seen an increase in land sale values.

Dodge ~ Working on converting microfilm to the computer. Land values are also up. They are also having many inquiries with the windmill companies. Sue noted that land owners need to watch the documents they are signing with these windmill companies, as these companies are not clear on the legal descriptions that are being used.

Steele ~ Continuing to convert microfilm to the computer.

Houston ~ Documents are being submitted with missing legal descriptions, signatures, etc. Please proof your documents. They have had issues with LandShark and hope to have it up and running in the near future.

Olmsted ~ Update on the information that is available on their website; vital records information, property tax payment options, tax calculator to find out tax amount (homestead vs. non-homestead), links to MN Department of Revenue, etc. LandShark is now the only document search site available. If you have any issues with the system or would like information on subscribing for LandShark, contact Pam Hameister or Wendy VonWald. Reminder that your Adobe Reader should be at 8.0 in order to image the document from LandShark.
