ORDINANCE # 25

Housing Ordinance

This is to amend Ordinance #25 formally known as the Housing Ordinance #25 that was adopted August 13, 2002.

The provisions of this code shall govern the construction, alteration, occupancy, demolition, and moving of all manufactured, sectional and mobile homes within the Town of Big Flats.

1. Permits from the Township must first be obtained.

2. All homes shall conform to HUD energy requirements as established June 15, 1976.

3. No home under 950 square feet minimum, excluding porches, decks, and appurtenances to be set up for a dwelling in the Town of Big Flats.

4. All manufactured, sectional, and mobile homes shall have at least a 3x12 pitched roof.

5. Replacement of existing manufactured, sectional, and mobile homes will comply with parts #1, #2, #3, and #4 of this ordinance. Also need to receive a reconnect sanitary permit from Adams County Planning and Zoning.

6. Any alterations, enlargements, or demolition of a Manufactured, sectional, or mobile home shall conform to the requirement and code of Adams County building ordinance. A hardship variance may be obtained from the Town Board in case of fire or natural disaster. The owner must petition the Board proposing the length of time needed for hardship and specifics.

7. No dwelling shall be brought into the Town of Big Flats without the appropriate County Building Permit, Sanitary Permit, and Electrical Permits.

8. Occupancy shall not occur until the County Building Inspector issues an occupancy permit.

9. All dwellings brought into the Town of Big Flats shall be completed on their exterior walls with finish siding and skirting within 1 year of the issuance of this permit.

10. Any person, firm, or corporation who fails to comply with the provisions of this ordinance shall, upon conviction thereof, be fined not less than $25.00 nor more than $500.00 and cost of prosecution for each violation. Each day a violation exists or continues shall constitute a separate offense.

Adopted at a Town Board Meeting August 12,_2008.

This Ordinance shall take effect upon publication in the Times-Reporter

August 20, 2008 and posting in three public places by the Clerk no later than August 20, 2008.
