The regular monthly meeting of the Board was called to order by the Chairman at 9:45 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

There being a quorum, the regular order of business began.

Mr. Crain, Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by Judge Darrell White, Hearing Officer then Judge White introduced himself and advised those present of his duties.
A MOTION was made by Mr. Lambert and seconded by Mr. Clouatre to accept the Minutes of the January 21, 2010 regular Board Meeting, as typed. The motion carried unanimously.

◙ Qualifying Party Hearing(s):
Eldorado Casino Shreveport Joint Venture (CL#36582)
Administrative Hearing – Consider suspending or revoking the Louisiana commercial contractor’s license number 36582 held by Eldorado Casino Shreveport Joint Venture for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against ELDORADO CASINO SHREVEPORT JOINT VENTURE then asked if a representative of ELDORADO CASINO SHREVEPORT JOINT VENTURE was present. There was no response.
Mrs. Fitch stated that the qualifying party has taken and passed the Business and Law and trade examinations.
We are looking to make a Motion that they have fulfilled the requirements that this Board set before them.
A MOTION was made by Mr. Meredith and seconded by Mr. Clouatre to approve the ELDORADO CASINO SHREVEPORT JOINT VENTURE has fulfilled the requirements set forth by this Board. The motion carried unanimously.
A.M.E. Disaster Recovery Services, Inc. (CL#47695 / MR# 250367)
Administrative Hearing – Consider an alleged violation by A.M.E. Disaster Recovery Services, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (1) (9), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you, Mr. Moliere, as the only qualifying party for Building Construction and Rules and Regulations for commercial contractor’s license number 47695 and Mold Remediation Contractor and Rules and Regulations for mold remediation license certificate number 250367, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you have pleaded guilty to count number one (1) of the Bill of Information on January 22, 2008 under criminal docket number 08-017, Section: “L” (5), in the United States District Court, Criminal Division, Eastern District of Louisiana, entitled United States of America v. Burnell Moliere. The pending counts were under Title 31, United States Code, Section 5324(a)(3) Structuring, and Title 18, United States Code, & Section 2 Aiding and Abetting. You pleaded guilty and entered into a plea agreement with Mr. Jim Letten, United States Attorney for the United States District Court, Criminal Division, on January 22, 2008. Based on your plea of guilty, Judge Eldon E. Fallon sentenced you according to the plea agreement and the case was terminated on November 5 with the order being signed on November 12, 2009.

Mr. Michael Vallen, Attorney representing the La. State Contractor’s Board questioned Mr. Moliere. Mr. Moliere responded.
Attorney Voss objected to the questions Attorney Vallen was asking Mr. Moliere. Then Attorney Voss handed out some information.
Attorney Vallen gave a statement then responded back to Attorney Voss.
Attorney Voss then responded back to Attorney Vallen.

Attorney Voss, Mr. Moliere and Attorney Vallen all left the Board Room and went into the Administration Section’s conference room to discuss and work out an Settlement Offer/Agreement.
Then they returned to the Board Room and read the Settlement Offer/Agreement. Then several Board Members had questions for Attorney Voss and discussed the Settlement Offer/Agreement.
It was suggested that Attorney Voss, Mr. Moliere and Mr. Vallen go back to the Conference Room and write down the Settlement Offer/Agreement then return to the Board Room with the final Settlement Offer/Agreement.
After a few minutes, Attorney Voss, Mr. Moliere and Attorney Vallen all returned to the Board Room and Attorney Voss read the Settlement Offer/Agreement to the Board Members present.
A MOTION was made by Mr. Meredith and seconded by Mr. Lambert to accept the Settlement Agreement/Offer submitted by A.M.E. Disaster Recovery Services, Inc., A.M.E. Facility Services, Inc., A.M.E. Service Inc., and A. Minority Entity, Inc. listed below:
1. Mr. Burnell Moliere voluntarily removes himself as the Qualifying Party for the 4 entities and 6 licenses listed above, effective today, Thursday, February 18, 2010.
2. These Entities will have Sixty (60) Days in which to get a substitute Qualifying Party in place.
3. Because Mr. Moliere’s plead guilty in Federal Court once his probation period is over, he will then be allowed to re-apply to be Qualifying Party for these four (4) entities.
The motion carried unanimously with Mr. Talbot recusing himself.

This violation is based on the fact that you have pleaded guilty to count number one (1) of the Bill of Information on January 22, 2008 under criminal docket number 08-017, Section: “L” (5), in the United States District Court, Criminal Division, Eastern District of Louisiana, entitled United States of America v. This hearing is being called for reason that on information and belief, Bayou Contractor Services, L.L.C., entered into contracts with multiple unlicensed contractors to perform work on the Cordova Apartments-Renovations project in Baton Rouge, Louisiana in an amount in excess of $50,000.00.

Administrative Hearing – Consider an alleged violation by Hamp's Construction, L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 A, and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Hamp’s Construction, L.L.C., caused substantial damage to another, as adjudged by a court of competent jurisdiction, and had problems relating to the ability of the contractor, its qualifying party or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.
Mrs. Bobbie Hughes read the allegations against HAMP’S CONSTRUCTION, L.L.C. then asked if a representative of HAMP’S CONSTRUCTION, L.L.C. was present. Mr. John Hulse, Attorney representing Hamp’s Construction, L.L.C. and Mr. Charlie Hampton were both present.
