PRH Waivers – Applies to all centers where social distancing protocols are still in effect. During the reopening process, centers must abide by federal, state, and local regulations regarding physical distancing, size of group gatherings, and wearing face masks by following whichever regulations are the most restrictive. In some cases, PRH requirements will not be able to be met because they are in conflict with regulations. Compliance with other PRH requirements may present unnecessary risks to students and staff or may be impossible to comply with given the logistical and operational challenges associated with state and local restrictions related to COVID-19. PRH references and requirements that either need to be adjusted or removed are annotated below with suggested replacement language.Chapter 1. Enrollee Services1.2EligibilityR1. Interacting with the ApplicantWhile social distancing and/or distance learning is in effect, admissions service staff must interview each applicant to discern pertinent data to make a determination of eligibility based on the Workforce Innovation and Opportunity Act (WIOA)? eligibility requirements referenced in PRH Exhibit 1-1, Job Corps Eligibility Requirements as well as the center’s additional COVID-19 criteria, as appropriate. OA-OMS requirements are suspended while a center is operating in a social distancing and/or distance learning capacity. 1.5 Center Applicant File ReviewR2. Requirements for the Center Applicant File ReviewApplicant files will be required to be processed within 60 days instead of 30 days to account for medical documentation delays. 1.6 Assignment and DepartureR7. Arrival SchedulingAt least 30 days prior to the approved reopening date of any center, operators must share their social distancing operations plans with local officials, including local health officials, in collaboration with local emergency management.While social distancing and/or distance learning is in effect, centers must schedule timely enrollment of applicants referred by ACs for distance learning and, as appropriate, arrival on center in accordance with the center’s social distancing operations plan and capacity. Chapter 2. Student Support Services2.2 Community Living (Residential)While social distancing and/or distance learning is in effect, off center community service activities and community service requirements are suspended. Chapter 3. Student Training Services3.1Training Management RequirementsR1. Managing the Learning Environment While social distancing and/or distance learning is in effect, student-to-teacher ratio requirements for academics and CTT are suspended. R2. SchedulingWhile social distancing is in effect, center will prioritize safety requirements associated with respect to social distancing when developing flexible student schedules to promote synchronous and asynchronous learning opportunities for all students. R9. Evening/Weekend Studies Program Due to the lack of accountability measures to support Evening and Weekend Studies those requirements are suspended. Centers will continue to encourage synchronous and asynchronous learning opportunities for all students.R10.Testing While social distancing and/or distance learning is in effect, required instructional hours will be reduced from 60 to 40 to support follow-up TABE testing per Appendix 301, considering both on-center and through distance learning.R12. Concurrent Training While social distancing and/or distance learning is in effect, students engaged in concurrent training are exempted from CPP requirements that must be completed on-center. R13. Other Training ProviderWhile social distancing and/or distance learning is in effect, students engaged in OTP training are exempted from CPP requirements that must be completed on-center. R14. Advanced Career Training (ACT) ProgramsWhile social distancing and/or distance learning is in effect, students engaged in ACT training are exempt from full time requirements and shall be offered flexibilities for online instruction through the college or university. 3.3 Career Technical Training RequirementsR5. Job Shadowing While social distancing and/or distance learning is in effect, centers will not offer off-center job shadowing but will, where feasible, facilitate virtual job shadowing opportunities. R6. Work-Based Learning ProgramWhile social distancing and/or distance learning is in effect, centers may facilitate off-center work-based learning only when such opportunities are supported by an MOU to enable students to acquire eTAR skills needed for completion and/or certification. Otherwise, all other off-center WBL requirements during the social distancing period will be suspended. Chapter 5. Management Services5.1Program ManagementR2.Quality AssuranceWhile social distancing and/or distance learning is in effect, on center Regional Office Center Assessments will be suspended.R14. Annual Occupational Safety and Health (OSH) Program ReviewsCenters with no students on site may delay the required annual Occupational Safety and Health (OSH) Program Review for up to 6 months. DOL will adjust the schedule once centers are opened. R15. Occupational Safety and Health PlanWhile social distancing and/or distance learning is in effect, the requirement for student Occupational Safety and Health Committee members to participate in safety inspections at least monthly is suspended. 5.2 Personnel RequirementsR2. Staffing RatiosWhile social distancing and/or distance learning is in effect, student-to-teacher ratio requirements for academics and CTT are suspended. R6. Background Checks and Credential Verification for Employees of Job Corps ContractorsWhile social distancing and/or distance learning is in effect, the background check process may be suspended. Staff may start work prior to receiving the results of the criminal background check as long as continued employment is contingent and provisional upon ultimately receiving a clean criminal background check. Staff shall not be on site or in the vicinity of students until the background check is complete.R17. Fire Safety and Prevention Plana. Fire Prevention PlanCenters without students on site may suspend monthly fire drills.R18. Emergency Action PlanCenters without students on site may suspend monthly fire drills.5.9 Environment and Occupational Safety and Health (OSH)R2. Occupational Safety and Health ProgramWhile social distancing and/or distance learning is in effect, all safety officer training may be conducted virtually.R5. Required Inspections and ObservationsCenters without students on site may suspend required inspections and observations.Chapter 6. Administrative Support Services6.2 Enrollments, Transfers, and SeparationsR1. EnrollmentsWhile social distancing and/or distance learning is in effect, centers may enroll students in distance learning prior to arrival on center by creating a student record in Center Information System (CIS) in accordance with procedures in the CIS documentation. The enrollment date is the date of the student record creation. 6.4 Records ManagementR5. Applicant FilesWhile social distancing and/or distance learning is in effect, OA contractors must ensure that OASIS files are available to the center of assignment. Hard copy documents are limited to the sealed medical records, which shall be available to the center at least 7 working days prior to each applicant’s scheduled enrollment date. PRH Distance Learning Waivers – Applies to all students engaged in distance learningDistance learning and absence of these students from direct center supervision will necessitate changes to multiple PRH requirements. Chapter 2. Student Support Services2.3 Health ServicesR5. Trainee Employee Assistance Program (TEAP) (See Exhibit 2-4, Job Corps Basic Health-Care Responsibilities)Off center statuses, including spring break and PDOF, will not be counted with respect to the requirement to retest students who tested positive on entrance between the 37th and 40th day after arrival on center. Such count will resume upon their return to center, as applied during winter breaks and outlined in PRH 2.3R5.3.a. 2.4 DisabilitiesR2. Disability Accommodationsa. Accommodations for Applicants and Students with DisabilitiesApplicants and students in PDOF status may affirm requests for reasonable accommodation with electronic signatures, recorded phone calls, or emails.Chapter 3. Student Training Services3.1 Training Management Requirements R14. Advanced Career Training (ACT) Programsd. Continued Enrollment While in PDOF status and enrolled in an ACT program, to continue to participate, students must earn credits each quarter/semester. 3.2 AcademicsR8. Online High School Program Requirements b. The use of cell phone and/or other device, including cameras may be necessary to facilitate proctor-led testing in an online environment and during PDOF-Off-Center Distance Learning.e. While in PDOF status, students may take exams outside of the online high school classroom or the academic building.f. While in PDOF status, examinations will follow requirements established by the online high school program. i. High School programs will provide guidance on the issuance of test code for exams for students in PDOF status.3.4 Career Success / Workplace Skills Requirements R22. Activities for Driver's License Attainment Centers will facilitate driver’s education for students in PDOF status, excluding behind-the-wheel instruction.Chapter 5. Management Services5.1Program ManagementR8.Career Development Period Plana.At a minimum, the CDP Plan must address:The organizational structure of CDP and a detailed description of how:The center will ensure that Tests of Adult Basic Education (TABE?) will be implemented using Data Recognition Corporation’s (DRC) INSIGHT? testing system in a designated testing facility, following procedures outlined in DRC’s TABE? 11/12 Test Administration Manual and Job Corps’ TABE? 11/12 Student Testing System Administrator’s Guide for securing test materials, scheduling tests, and administering the tests. The Manual and the Guide are posted on the Job Corps Community website.TABE testing requirements for PDOF students are suspended during Distance Learning period until guidance is provided by DRC Insight? and approved by DOL. Chapter 6. Administrative Support Services6.1 Leaves and Absences R2. Attendance SystemCenter daily attendance system requirements, including morning attendance check, shall not apply to students in PDOF status. Centers shall detail their attendance strategies in their approved distance learning plans.6.2 Enrollments, Transfers, and SeparationsR3. Enrollment ExtensionsA center may request Regional Office approval to extend a student’s enrollment limit for up to one year in order for the student to qualify for graduation if the student was enrolled in PDOF status. If approved, centers must maintain documentation of the approval in the student’s personnel folder. ................
