NHW CLAIM REPORT 2017 03

All new homebuilders in New Jersey are required to register with the New Jersey Department of Community Affairs. A new homebuilder in New Jersey is required to give their customers a ten-year limited warranty. Currently, there is a State New Home Warranty Plan and there are five private warranty plans.

Almost everything is covered for the first year, including defective systems, workmanship, materials, appliances, fixtures, and equipment. The mechanical (heating and air conditioning), electrical, and plumbing systems are covered for two years. Major structural defects are covered for ten years. Since the beginning of 2005, the warranty plans have reported specific claim information to the Department. Those items that a new homeowner reports to the builder and are promptly corrected are not reflected on this list. This list reflects only those "formal" claims filed with the Department or the warranty company. The following report provides the claim data for each registered new homebuilder in New Jersey.

It is not unusual for homebuilders to create a new company for each development. Therefore, the claim information is provided not only for each company, but also all related companies (a related company is one that has one or more principal owners in common with the listed company)

This information is offered to provide potential new homebuyers with information on a builder's track record. The list includes only builders with current registrations. The names of builders whose registrations have been revoked, suspended or expired may be found in the list of registered new home builders on the Department's website at .

This is the builder's registration number that is assigned by the Department.

This is the number of new homes for which warranties were issued from 1993 to the present.

This is the number of claims submitted by homebuyers to any of the warranty plans from 2005 through 03/31/2017. A claim is a formal filing with the warranty company for correction of defects in materials or workmanship or a claim for a major structural defect. (A claim can involve one or more defects.)

This is the number of cases where it was determined that it was the builder's responsibility to correct a defect and the builder failed to do so. Defaults also include payments by warranty plans for major structural defects. These numbers are for 2005 through 03/31/2017.

Summary for related companies: This is a summary of the data in each column for all companies that have one or more of the same principals as the registered new homebuilder listed. When a company becomes a registered builder, the registration includes the names of all of the principals (director, officer, partner, or any other person having an economic interest of more than 10% in the organization). "Related companies" includes information for all of the current or former registered new homebuilders with one or more of the same principals. The information presented under "related companies" aids potential new homebuyers by presenting the claims history of companies with the same people involved.
