Part 2: Declaration on honour concerning exclusion criteria

Only required for applications for a grant of more than EUR 60.000.

To be signed by the person legally authorised to sign on behalf of the applicant organisation.

I, the undersigned, take note that under the provisions of the Regulation on the financial rules applicable to the general budget of the Union[1] (hereafter "the Financial Regulation"), grants may not be awarded to applicants who are in any of the following situations:

a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

b) they or persons having powers of representation, decision making or control over them have been convicted of an offence concerning their professional conduct by a judgment of a competent authority of a Member State which has the force of res judicata;

c) they have been guilty of grave professional misconduct proven by any means which the responsible authorising officer can justify including by decision of the EIB and international organisations;

d) they are not in compliance with their obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the responsible authorising officer or those of the country where the agreement is to be performed;

e) they or persons having powers of representation, decision making or control over them have been the subject of a judgement which has the force of res judicata for fraud, corruption, involvement in a criminal organisation, money laundering or any other illegal activity, where such illegal activity is detrimental to the EU's financial interests;

f) they are subject to an administrative penalty referred to in Article 109(1) of the Financial Regulation;

g) they are subject to a conflict of interest in the course of the grant award procedure;

h) they are guilty of misrepresenting in supplying the information required by the Agency as a condition of participation in the grant award procedure or fail to supply that information.

I confirm that neither I, nor the institution for which I am acting as legal representative, is in any of the situations described above, and that I am aware that the penalties set out in the Financial Regulation may be applied in the case of false declaration.

In the event that my grant application is successful, I authorise the Commission/the Agency to publish on its website or in any other appropriate medium:

• the name and address of the beneficiary(ies) of the grant;

• the nature and purpose of the project;

• the amount awarded and the rate of funding of the costs of the approved project.

Part 3: declaration on honour concerning the platform project

To be signed by the person legally authorised to sign on behalf of the Coordination entity.

I, the undersigned, certify that

- the platform members included in the present application have at least two years of legal existence and that they are established in one of the participating countries to the Culture sub-programme

- the platform members are active in the cultural and creative sectors as defined in article 2 of the Regulation n° 1295/2013 of European Parliament and of the Council on establishing the Creative Europe programme.

- the platform's main aim is to support the objectives and priorities of the non-audiovisual cultural and creative sectors

Should the declarations above not be complied with in the present application and/or during the lifetime of the project if selected, I confirm that I am aware that the application and/or the project will not be eligible anymore and will be rejected or cancelled by the competent authorising officer.
