Motion carried by unanimous vote.REPORT OF THE STATE FIRE MARSHALINFORMATIONAL ITEMSPersonnel ItemsFire Marshal Ingle has reported that the posting for the vacant Deputy Fire Marshal I position in Kent County has been closed. Forty applicants have qualified. The next step is for each applicant to take a written test either on October 28th or November 9th. State Personnel will provide a list of eligible applicants once that is completed. It will likely be December before interviews can begin.Deputy Fire Marshal III, Brent Billings has been assigned to headquarters to fill the vacancy in Kent County. Chief Deputy Bullock and Assistant State Fire Marshal Chionchio have placed themselves in the rotation to relieve some of the burden in Kent County. The Administrative Specialist I vacancy in New Castle County posting has closed. There were fifty candidates. A list of candidates have been selected for interview. Those interviews will take place in New Castle on October 28th. Fire Protection Specialist II, John Reedy has returned from extended medical leave. He has been placed on full duty. Jeff Cerri filled in for Mr. Reedy during his absence and did a great job. Assistant State Fire Marshal Brown was recognized by New Castle County Police Department for a civilian award as a result of his involvement in capturing a burglar. Fire Marshal Ingle congratulated him on these efforts.SFPC MinutesOctober 20, 2015Page 3DTI UpdateFire Marshal Ingle reported that the incident log has been down. He learned that the program is being transferred to another server. DTI thought the transfer had already taken place and turned the program off. DTI is now in the process of transferring that data to a new server. Everything else seems to be moving forward. They are working on the file structures, phone systems are all up and running, and help desk calls have started to taper off. There have been some issues with accessing State Police programs. DTI is in the process of getting that taken care of. The agency continues to work with Anthony Spiezio, System Control Specialist of DTI with respect to file access and securities. Public Budget HearingThe public budget hearing is scheduled for November 4, 2015 at 11 a.m. Delaware Fire Sprinkler CoalitionFire Marshal Ingle met with Past President Machiles of the State Fire Chief’s Association, Current Vice President Terry Jester, Ray Lonabaugh of the National Sprinkler Association, John Caufield, NFPA and Tim Travers, NFPA at the New Castle County division on September 25, 2015. The Chiefs were interested in developing a Sprinkler Coalition in Delaware. It was a positive meeting in which they discussed the details of forming this coalition. Paul Eichler has been chosen to be the Chairman of the coalition. The NFPA is working with them to add them to a website that is now up and running. There are already several members on board and they are soliciting more at this time. At this point the coalition will work with the educational proponent to mirror the legislation that was passed regarding a brochure for sprinkler systems for the general public and the fire service as a whole.Meeting Commercial Building Owners (CIRC)Fire Marshal Ingle met with commercial building owners on October 5, 2015. He was under the impression that they were going to submit some questions in writing. The concerns must have been remedied at this meeting because no formal questions were submitted. This will be a learning curve for everyone due to terminology changes in the Life Safety Code. This was a positive meeting and keeps an open door policy in working with the commercial building owners.SFPC MinutesOctober 20, 2015Page 4Fire ReportFire Marshal Ingle reported on the following fires:October 18, 2015 at approximately 2 a.m., three trailers were set on fire in Park Place Park in Mill Creek. The fires displaced 12 people. An investigator was on scene quickly and able to capture good evidence. The same type of incident happened approximately eighteen to twenty-four months ago. It remains under investigation as well as the agency is looking into the previous fires.October 10, 2015 at approximately 7 p.m. there was a structure fire in the Holloway Terrace fire district. Heavy fire was showing when the fire company arrived. It was a vacant structure and there was substantial damage to the home. This fire remains under investigation.September 24, 2015, Glasgow Trailer Park. There were two separate fires and the fire companies had to deal with fire hydrant issues. Those issues have been rectified. Director Newnam has not heard anything at this point from New Castle County with regard to putting the school’s props on the training grounds.Budget - Public Hearing – November 4th – Senate ChambersDirector Newnam reported on a recent concern with regard to social media. An individual taking a class at the DSFS had a conversation with someone from Florida and made inappropriate comments. In return they retaliated by finding a picture of the person taking a Vehicle Rescue class at the school online. They made comments that the Delaware State Fire School was an inappropriate place and improper students attending it. Director Newnam stated that signs have been placed in the hallways reminding students of the policy that pictures cannot be taken on the drill grounds. Over 300 EMTs and more than 50 trainers have been trained. After review of the July and August Data sheets, 5 companies have submitted forms for 20 patient encounters with positive reviews. The data sheet should only be completed for patient encounters in which BLS evaluates and administers BLS as part of the pilot protocol as opposed to assisting a patient with their own albuterol as was already within the DE BLS scope of practice. A general albuterol prescription for participating agencies is on file with Southeastern Medical Equipment and I can put on file at other pharmacies if requested.Office of Emergency Medical Services “OEMS” is now a participant in the EMSPS plan for HPAI (Highly Pathogenic Avian Influenza). Any quarantine area after a positive infection would pertain to poultry shipments and related supplies only, and not pertain to people or providers. In the event that there should be a positive HPAI infection, EMS should be notified by the dispatch centers regarding the area of concern as determined by the Department of missioner Marvel stated that he was invited to an Avian Flu meeting at the Department of Agriculture. He learned that a strain of the Avian Flu is adaptable to people. He is very concerned about this, because if an EMT picks up a patient and it’s not reported, it’s easily forgotten. He left the meeting feeling a lack of preparedness for an event if it should happen here in the United States. What will the Fire and EMS personnel do in these cases? At the meeting it was stated that the EMS personnel have been told to call the call board and a response will be met of 3,000 gallons of water. Commissioner Marvel was told the response would happen at dawn. He does not feel the planning is complete and is concerned for the emergency workers. He asked if a box could be put in DEMERS that can be checked if Avian Flu? Dr. Matthews replied that if avian flu was confirmed, they would have to follow infection control orders.SFPC MinutesOctober 20, 2015Page 10BLS MEDICAL DIRECTOR cont.OEMS is overseeing the allocation of 2,000 Narcan auto injectors donated to the State. BLS agencies who wish to participate and receive the Narcan Auto injectors (at no cost) should contact Britany Huss in the OEMS. There is an agreement to sign which states that these BLS agencies understand that there is no guarantee of receiving the auto injectors again, and they are NOT obligated to purchase on their own. If funding does become available in the future for Narcan purchases, agencies that participate in this program will be given priority for future endeavors involving missioner Marvel stated that he has seen that the Narcan auto injectors expire in February. Dr. Matthews stated that there is concern as heard in exchange programs in other states, drug abusers are taking these auto injectors to their drug supplier and they are being given to the person purchasing the drug. It’s very unfortunate. Dr. Matthews encourages all BLS Providers to get their Influenza vaccine since we are entering the Influenza season. They should follow infection control PPE and documentation policies when transporting patients with symptoms of influenza.REPORT OF THE INVESTIGATOR/COMPLIANCE OFFICERIn September, Mr. Truax conducted 17 annual ambulance unit inspections. Four new investigations were opened; 1 Provider – Equipment Issues, 1 EMT – Self-Reporting, 1 EMT – Self- Report – Monitoring and 1 EMT – Patient Care Issue. 3 Consent Agreements will come before the Commission today for action.Case # 1515 – Mr. Truax asked that this case be placed on a future agenda for a hearing. The investigation is completed and Deputy Attorney General Phelopoles feels there is sufficient evidence to bring it before the Commission. It was moved by Commissioner Dicristofaro, seconded by Commissioner Truitt to schedule a hearing for Case # 1515. Motion carried by a unanimous vote.Case #1504 – Mr. Truax reported on the status of this investigation. The EMT involved failed to input DEMERS reports. The EMT has completed the missing PCRs and the complainant is satisfied with the outcome. Deputy Attorney General Phelopoles recommends that this case is closed for reasons of prosecutorial discretion. It was moved by Commissioner Dicristofaro, seconded by Commissioner Truitt to accept the DAGs recommendation for Case #1504 to be closed. Motion carried by a unanimous vote.SFPC MinutesOctober 20, 2015Page 11REPORT OF THE INVESTIGATOR/COMPLIANCE OFFICER cont.Mr. Truax updated the Commission on the case with regard to the Office of Emergency Medical Services complaint against Delmar Fire Company. A meeting was held on September 8, 2015 in which the following was agreed between Director Hainsworth of OEMS and Chief Rementer of Delmar Fire Company.There was an admission of Delmar Fire Company reporting in the Maryland Emergency Medical Services Data System (dMEDS) and not in the Delaware Emergency Medical Reporting System (DEMRS). Reporting in the DEMRS system is required for compliance with the ambulance regulations and the protocols of Delaware. The compliance time frame for the submission of reports is 90 days from the meeting date or 30 days from the receipt of the letter dated September 23, 2015. This will allow Delmar Fire Company time to speak to the State of Maryland about a data transfer interface into the DEMRS system. If this option is chosen, it will be at no cost to the state of Delaware. A more readily available option, which could provide instantaneous compliance, is the completion of reports using the state provided, free, DEMRS. Upon receipt of validated reports, OEMS will request official closure of the complaint that was filed with the Fire Prevention Commission. OEMS will recommend that disciplinary/punitive motions against Delmar Fire Company be held in abeyance until the compliance time frame has been completed concerning report submission as listed in the complaint.New Provisions for Federal Ambulance Specifications Date 7/1/15Mr. Truax was asked to research the KKK requirements. He found that the power stretcher is an option within the KKK requirements. Change order #7 was entered in April, 2015 the power stretcher was in this document. July 1, 2015 change order #8 and final change order has removed the power stretcher requirement. They only refer to a four point restraint system and a cot retention. The cot retention creates a more stable environment for automobile accidents. It is a locking system installed into the undercarriage of the frame on an ambulance. The cot system can be used with a manual or power stretcher. This is not retroactive to existing ambulances. It appears that the NFPA and the International Firefighters Association are in disagreement of the equipment requirements. Mr. Truax clarified that he has found nothing that mandates a power stretcher. DAG Davis-Oliva will present the Commission with an Order to be executed. That order will be republished along with the technical changes discussed at today’s meeting. The regulations will then go into effect on December 11, 2015.Wilmington Manor – Submit Written Correction Action PlanPace Campbell of Wilmington Manor Fire Company gave the commissioners an update with regard to recommendations given to them by their auditor. Ms. Campbell presented a document presented to Wilmington Manor by Douglas S. Kook, CPA, CVA of Bumpers & Company. The Commission agreed that a copy of this communication would be submitted to the audit committee and placed in the company file.Scratch Report UpdateIt was moved by Commissioner Dicristofaro, seconded by Vice Chairman Robinson to request Townsend Fire Company to appear before the Commission at the November meeting to discuss the scratch percentage for their company and require them to identify the trend of call times. After review and discussion, it was moved by Commissioner Marvel, seconded by Commissioner Guzzo to accept the consent agreement as presented.
