PURCHASE AND REMOVAL OF SCRAP APPLIANCE

AND NON-SEGRAGATED SCRAP METAL

I. GENERAL INFORMATION

This contract will cover the collection of scrap metal generated by the recycling programs at the City’s recycling and disposal stations identified in section II of this attachment. All material will be accumulated by the City using its own labor and equipment and will be delivered by the City to the contractor’s facility. Scrap metal means aluminum, tin, brass, copper, stainless steel, and other ferrous and non-ferrous materials.

III. TECHNICAL SPECIFICATIONS AND REQUIREMENTS

1.The contractor and all subcontractors shall provide the service in full compliance with all applicable federal, state and local laws, rules, regulations and orders of all governmental agencies and entities, including but not limited to federal, state and local environmental, transportation, labor and industries, health and fire regulations, as applicable.

2. Prior to the execution of the purchase contract, the successful bidder shall provide a Certificate of Insurance evidencing appropriate insurance in accordance with “CGL Insurance Form,” Form B, attached.

3. The contractor shall have at least one (1) year experience in the business of recycling scrap metal.

4. The contractor shall accept scrap metal from the City’s two Recycling and Disposal stations.

5. All scrap metal accepted under this contract shall be recycled in some manner and shall not be land filled.

6. The contractor shall have all necessary governmental approvals for its facilities, equipment and other aspects of business operations.

7. The City desires that the contractor’s facility be available for delivery of these materials seven (7) days per week, from 7AM to 7PM.

8. The City shall make a good faith effort to remove any hazardous materials from loads of scrap metal delivered to the contractor’s facility, such as asbestos, chlorofluorocarbons (Freon) and PCBs. The contractor may reject City-generated materials that contain hazardous materials.

9. The contractor shall pay the City on a monthly basis for the total tonnage of scrap metal received.

10. Upon awarding this contract, the prices for recycling scrap metal shall be the price paid to the City by the contractor(s) for a minimum of sixty days. Thereafter, upon mutual agreement by the City and the contractor, market prices for scrap metal shall be used as an index for payment to the City by the contractor. Prices for scrap metal shall be adjusted either monthly or quarterly in proportion to the market price for scrap metal. The City and contractor shall define the market price and the frequency of adjustment.

11.The contractor shall immediately advise the City of any change in the contractor’s or subcontractor’s regulatory or compliance status, and of any notice of violation, citation, administrative order, court order, judgment or other regulatory or enforcement action initiated against the contractor or subcontractor by any governmental agency or entity. The contractor and all subcontractors shall fully cooperate with the City in its investigation of any permitting, approval or compliance matters.

12. The City reserves the right to visit the contractor’s and subcontractor’s facilities prior to awarding the contract and at any time during the duration of the contract. The City also reserves the right to view all financial records and other records, permits, licenses, insurance policies and other governmental approvals prior to and during the duration of the contract.
