Who issues licences?

1. The Licensing Service, based at The Hackney Service Centre, 1 Hillman Street, London, E8 1DY is responsible for skip licences. Our Licensing staff will be able to answer your queries; you can ring them on 020 8356 4968/8161 between 9.00 am - 5.00 pm, Monday to Friday. (See )

What requires a licence?

2. A licence is required to place a builder’s skip on the public highway, under Section 139 of the Highways Act 1980.

Who can apply for a skip licence?

3. We only accept skip licence applications from skip companies who appear on our approved list. If you want to be added to the list, you will need to forward copies of :

► your goods vehicles operators licence

► your control of pollution certificate issued by the Environment Agency

► public liability insurance

► standard waste transfer note and

► (for limited companies) your certificate of incorporation

Other required consents

4. If you are looking to place a skip on a ‘pay and display’ bay or residents parking bay, permission must be sought and obtained to suspend the bay for the day(s) when a skip is to be located there.

5. The Parking Service will advise further on suspension of bays. They can be reached on Telephone No. 020 8356 8877 (see .uk/parking)

Note: (1) A charge is made for suspension of a parking bay

The skip licence application

6. The enclosed application form must be fully completed and returned to us here at the Licensing Service, with an administration charge of £100.00 per skip.

We accept the following methods of payments;

• Cheque/Postal Order that should be made payable to the LONDON BOROUGH OF HACKNEY.

• credit and debit cards ( Visa, Master, Solo, Visa Electronic, Maestro, Switch, Delta). Please complete the payment details on the application form or telephone on 020 8356 4968/8161 and have your card ready. You will be asked for the following:

o Full name of the card holder

o Card number

o Card type

o Issue Number and start & expiry date

7. All applications are referred to the Council’s Environmental Enforcement officers for attention. Where relevant; Traffic Engineers and Market Inspectors are also consulted. Officers may need to meet you on site to discuss the placing of the skip. Please make sure, therefore, that you give a contact name and telephone number on the application form, so that such visits can be arranged speedily.

8. Once the inspection and assessment of your application has been carried out, you will be notified of the Council’s decision - normally within THREE WORKING DAYS. Any licence granted will be subject to the standard conditions listed below. (You will note that these include some details as set out in the specification details below, as well as general conditions). Other relevant conditions may be added to individual consents.

9. A licence can run for a maximum of FOUR WEEKS, depending on location, suspension of parking bays etc. To extend that timescale, you will need to make a further application.

Specification for skips

10. Builders’ skips shall comply with the appropriate Ministry of Transport Construction and Use Regulations when carried on a vehicle.

11. A builder’s skip shall not exceed 16ft in length by 6ft 6ins in width.

12. The ends of the skip (i.e. the sides of the skip facing traffic in both directions) must comply with the Builders’ Skip (Markings) Regulations 1984. They must be fitted with vertical red and yellow fluorescent reflective markings on each end. The markings must comply with British Standards BS AU152: 170 and must be marked with that number.

The markings must be clean and clearly visible at all times.

13. Provision shall be made for red lamps to be fixed securely to each corner of the skip.

14. A builder’s skip shall be clearly and permanently marked with the owner’s name and telephone number.

General rules to be observed

15. A skip shall be positioned:

(a) At least 10 metres clear of any junction

(b) At least 20 metres from

• Traffic Signals

• Pedestrian Crossings or Refuge

• Bus Stops

• School Entrances

16. Skips shall not be positioned on Zebra Crossings, “Zig Zag lines” or “School Keep Clear” markings.

17. No skip shall be placed so as to impede access to adjacent properties.

18. Hackney Council cannot deal with any application on any part of the Priority “Red” Route network. The Red Routes are administered by Transport for London (TfL). You should contact them on 020 7126 1212 for approval (see .uk/streets for Red Route locations).

19. A skip placed on a public highway shall be positioned in such a way so that safe movement of vehicular traffic and pedestrians is maintained at all times.

20. If the proposed site for the skip may cause traffic flow difficulties, you should arrange to meet a Traffic Engineer on site. The Traffic Section can be contacted on 020 8356 8284.

21. A skip shall only be placed in a BUS LANE or an URBAN CLEARWAY if no other alternatives are available, and then only for short periods of time.

22. Skips shall only be positioned in any street market on an agreed site. Such agreement will be obtained as part of the consultation process etc mentioned in paragraph 7 above.

23. A skip shall be sited so that it does not impede surface water drainage on the highway.

24. A skip shall be sited so that it does not obstruct access to any Statutory Undertakers and/or Hackney Council inspection chambers.

Standard conditions on all licences

25. The skip shall be positioned as prescribed by the London Borough of Hackney and shall be sited so that it does not impede the surface water drainage nor obstruct access to any manhole of the apparatus of any Statutory Undertaker or the London Borough of Hackney.

26. The builder’s skip shall not exceed 16 feet in length by 6 feet 6 inches in width.

27. Builder’s skip shall, while on the public highway, be marked and lit in accordance the following requirements:-

(A) The ends of the skip (i.e. the sides of the skip facing traffic in both directions) must comply with the Builders’ Skip (Markings) Regulations 1984. They must be fitted with vertical red and yellow fluorescent reflective markings on each end. The markings must comply with British Standard BS AU152: 170 and must be marked with that number. The markings must be clean and clearly visible at all times.

(B) At night, i.e. between half an hour after sunset and half an hour before sunrise, a red lamp shall be placed against or attached to each corner of the skip.

28. No builder’s skip, when standing on the highway, shall contain any inflammable, explosive, noxious or dangerous material, or any material which is likely to putrefy or which otherwise is, or likely to become, a nuisance to users of the highway.

29. No builder’s skip shall be used in such a way that any of it’s contents fall on to the public highway, or that there is an escape of dust from the contents of the skip when standing on the public highway.

30. A builder’s skip shall be removed for emptying as soon as practicable and, in any case, not later than two working days after it has been filled.

31. No builder’s skip shall remain on the highway after the expiry date of the licence. (A new application must be submitted for consideration in respect of any extension of time required).

32. All materials placed in a builder’s skip shall be properly disposed of.

33. The public highway, where the skip has been deposited, shall be left in a clean and tidy condition on the expiration of the licence.

34. Nothing in the permission shall be taken as authorizing the creation of a nuisance or of a danger to users of the public highway or as imposing any liability on the London Borough of Hackney for any injury, damage or loss resulting from the presence of the builder’s skip to which the permission relates, on the public highway.
