Job Description

|JOB PURPOSE: |Directly responsible for the overall administration, coordination and evaluation of|

| |the Finance Department and coordination of State license renewals, State bonding |

| |and regulatory compliance. |

|FLSA STATUS: |Exempt |

General Function: Manages, directs and maintains the finance department in accordance with regulatory requirements and company policies; oversees financial and compliance department staff and all financial operations. Manages and maintains 501(c)(3) nonprofit organization’s compliance with state and federal laws, including state debt management licensing requirements, as well as requirements of the Internal Revenue Service, the Executive Office for U.S. Trustees (EOUST), the Federal Trade Commission, certifying organizations such as the National Foundation for Credit Counseling (NFCC), and other governing and regulatory organizations. Establishes and maintains regulatory compliance programs. Other responsibilities include maintenance of Secretary of State annual reports, state charitable organization reports, insurance policies, and corporate documents.

Essential Duties and Responsibilities - Finance

• Oversees and directs treasury, budgeting, audit, tax, accounting, payroll and benefits, retirement, purchasing, real estate and insurance activities as appropriate for AFS.

• Creates, implements, delegates and oversees procedures and systems necessary to maintain proper records and to afford adequate accounting controls and audit procedures.

• Directs (with direction from the Board of Directors and President) treasury functions as custodian of funds, securities and assets of AFS, including all trust fund activities.

• Monitors the financial position and issues periodic financial and operating reports, monthly reports to the Board of Directors, year-end financial statements and annual audit and 990s. Additional reports to the Board of Directors will be produced as requested.

• With the AFS President, coordinates the budget planning process and variance reporting.

• Keeps the President current with any changes in compliance requirements related to AFS.

• Trains, develops and supervises internal staff accordingly to meet current and future growth projections.

• Creates and maintains current financial operations manual.

• Assists with legal requests and monitoring of legal activities.

• Models business activities for various operating scenarios.

• Serves as liaison to insurance broker and coordinates corporate bonding and insurance renewal process

Essential Duties and Responsibilities – Compliance Activities

• Maintains relationship with certifying organizations and other trade organizations.

• Serves as liaison with state and federal regulators regarding state license applications, renewals, examinations, etc.

• Provides support on funding and grant applications.

• Acts as Board Secretary and works with the President and the Board Chairman to schedule board of directors’ meetings, develop board meeting agendas, draft board meeting minutes, and perform other tasks as requested. Presents Compliance Reports to the board of directors.

• Oversees compliance with the requirements of various state regulatory agencies, including without limitation state banking departments, justice departments, charities departments, and secretaries of state.

• Oversees compliance with the requirements of various federal agencies, including the IRS, EOUST, and FTC.

Additional Duties and Responsibilities

• Accomplishes all tasks as appropriate.

• Additional duties as assigned.

KNOWLEDGE, SKILLS AND ABILITY: Thorough knowledge of and experience with not-for-profit practice in regards to industry standards, regulations, and compliance; thorough knowledge of current financial laws and regulations.

Experience, Education and Licensure

• Four-year degree in Accounting, Finance, or similar discipline.

• CPA preferred.

• Significant experience working in a not-for-profit environment in finance or accounting management position with progressive levels of responsibility.

Language Skills

• Ability to read, analyze and interpret common scientific and technical journals, financial reports, and legal documents

• Ability to respond to common inquiries or complaints from customers, regulatory agencies, oversight committee members, Board of directors and members of the business community

• Ability to prepare correspondence and documentation in accordance with specific requirements

• Ability to present facts and recommendations effectively in written and oral form

• Ability to effectively present information to Board of directors, public groups and media personnel
