Rules and Regulations for Occupancy

1. OCCUPANCY POLICY The first objective of this occupancy policy is to achieve utilization of leased space without overcrowding. Overcrowding will be defined as when the total occupancy level in an apartment exceeds two persons per bedroom. A dining area, kitchen, living room, hallway or bathroom will not be considered a bedroom.

The second objective of the policy is to establish termination of occupancy. John Brown University students who have graduated or withdrawn from classes are subject to automatic termination of the lease. Students graduating in December will be required to move out of the apartment by the end of December. Students graduating in May will be required to move out by the end of June. Students withdrawing within the academic year will be required to move out at the end of the month in which they withdrew.

2. COMMUNITY STANDARDS All the tenants are to live in sympathetic appreciation of the JBU Community Covenant. Furthermore, students in the traditional undergraduate program are expected to abide by the expectations outlined in the JBU Community Covenant and Student Handbook. Students of the opposite biological gender (sex) may live in the same JBU apartment unit or house, provided they are married. Students of the same biological gender (sex) may live in the same JBU apartment unit or house provided their relationship is platonic in nature.

3. ADDITIONS TO HOUSEHOLD No person shall occupy the dwelling unit except those listed in the Lease Agreement. The tenants who allow individuals not named in the Lease Agreement to occupy the apartment will be found to be in material non-compliance with their Lease.

4. RENT COLLECTION POLICY Rent for John Brown University students will be charged to the student (The tenant) account each semester with the summer months billed separately. If the rent is to be paid monthly, it will be due on the 5th of each month. Any unpaid balance due the University at the time of termination of the use of the apartment will be considered the same as unpaid tuition, and no transcripts of credit will be released by the Registrar’s Office until such time as the balance is paid. Any cost of collection of an unpaid balance, including attorney’s fees and collection agency fees will be the responsibility of the tenant. Questions regarding rent payments and student accounts should be forwarded to the John Brown University Business Office.

5. THE TENANT CONDUCT The tenants agree to conduct themselves, and to require other persons in the apartment or on the premises with the tenant’s consent (whether known by the tenant or not) to conduct themselves, in a manner that does not disturb other the tenant’s peaceful, quiet, enjoyment of the premises; and is otherwise not offensive, noisy, dangerous, or disruptive to the rights, privileges and welfare of other residents and persons. All the tenants are responsible for the conduct of their guest(s). Verbal abuse and/or the use of foul language by the tenant or the tenant’s guests toward maintenance personnel, any representative of the Landlord, police or law enforcement official or another the tenant is not permitted and can result in immediate action to terminate the tenant’s occupancy.

6. INSPECTION Landlord reserves the right to enter apartments for reasonable inspection of health, safety, and sanitation standards. This includes maintenance, repairs and pest spraying. Every attempt will be made to allow the tenant to be present when entrance is necessary. These rights include search and seizure whenever sufficient reason is shown.

Pest Spraying will occur on the third Friday of every month beginning at 9:00 am.

7. SMOKING This facility is considered a Tobacco Free Facility. Tobacco and/or other smoking products (i.e. e-cigarettes and Hookah) and non-smoking tobacco are not to be used or possessed on any JBU property.

8. ALCOHOLIC BEVERAGES Students at John Brown University, their dependents living in this complex, and their guests, agree to the “no drinking of alcoholic beverages” rule on university-owned property. Violations of this rule will results in discipline sanctions and may lead to eviction from the apartment.

9. PETS Tenants will not keep, harbor, house, or board any animals, wild or domestic, in or about the leased premises. Fish in a 20 gallon or less aquarium will be the only exception.

Service Animal and Emotional Support Requests: JBU will accept and consider requests for reasonable accommodation in University housing at any time. The individual making the request for accommodation can obtain a request form from the Office of Disability Services in WSC 233. Requests should be made as soon as practicably possible before moving into University housing. However, if a request is made for an accommodation fewer than 60 days before the individual intends to move into university housing, JBU cannot guarantee that it will be able to meet the individual’s accommodation needs during the first semester or term of occupancy. If the need for the accommodation arises when an individual already resides in University housing, he/she should contact the Office of Disability Services and complete the request for accommodation as soon as possible. JBU cannot guarantee that it will be able to meet the accommodation needs during the semester or term in which the request is received. For more information please see JBU’s disability handbook: .

The tenants found to have pets in their apartment may forfeit their security deposit and will be responsible for any charges incurred by the University for additional cleaning and pest spraying.

10. USE The apartment and grounds are to be kept in good, clean, safe, and sanitary condition at all times. The tenant agrees to:

a. Use in a reasonable and proper manner all utilities, services, facilities, appliances, plumbing, and equipment provided by the Landlord.

b. Keep all appliances and equipment within the apartment or on the premises in good and clean condition. Reasonable wear and tear is expected.

c. Not place fixtures, signs, banners or advertisements in or about the apartment.

d. Not place any item outside of the apartment except bicycles, lawn furniture, and grills.

e. Not disconnect/disengage smoke alarms at any time whether smoke alarm is direct wired or battery operated. The tenant will replace non-working batteries in battery operated smoke alarms during the course of residency in the apartment and upon move-out from the apartment.

f. Pay for any damages resulting from or cost incurred as a result of the misuse of appliances, equipment, facilities, or plumbing, whether by the tenant or guest(s) of the tenant.

g. Not allow any grease, bulky paper products (paper towels, sanitary napkins/tampons, disposable diapers) or other foreign objects (toys, etc.), which could clog fixtures or lines to be placed in bathroom or kitchen plumbing fixtures. If clogging occurs as a result of the tenant misuse, the tenant will be responsible for all cost incurred to open the fixtures or lines.

h. Not use the apartment or premises, or permit the use thereof by others, for any illegal purpose or activity.

i. Not keep in or about the apartment or premises any explosives or flammable fluids or materials of any kind and also not to keep nor use firecrackers or fireworks of any kind in or about the apartment or premises.

j. Not hang, for any purpose, any laundry or other articles or materials from the outside of The tenant’s apartment or on the premises.

k. Not deliberately or negligently destroy, deface, damage, impair, or remove any part of the apartment or premises or permit or fail to prevent a person in the apartment or on the premises with The tenant’s consent to do so (whether known by the tenant or not) and to repair or replace any such part of the apartment or premises if affected by such.

l. Not allow on the apartment complex premises any firearms or other weapons, air rifles, BB guns, Co2 rifles, etc.

m. Use care to insure the tenant is not locked out of the tenant’s apartment. Should the tenant be locked out, report to John Brown University Campus Safety. Under no circumstances will the tenant or others attempt to force open a door or remove a screen and attempt to go through a window to the apartment.

n. Comply with the Fire Pit Use policy () when planning to use metal fire pits outside the apartment.

11. MAINTENANCE The tenant shall notify Landlord immediately of any needed repairs to plumbing or other equipment by submitting an email request or calling Facility Services. Failure to immediately notify Landlord will result in the tenant becoming responsible for repairs of further damage caused by said failure to immediately notify Landlord. The Maintenance reporting procedures are as follows:

a. All requests for maintenance work are to be scheduled through workreq@jbu.edu. The tenant will not make a request directly to the maintenance person(s) as all work must be scheduled and recorded (emergencies expected).

b. The tenant may also contact DFarine@jbu.edu for assistance.

c. A request for maintenance, either verbal or written, is authorization for the maintenance personnel/site manager to enter the tenant’s apartment to inspect the maintenance problem and/or to make the needed repairs at reasonable times. A tenant cannot require that he/she be present when repairs/inspections are to be made.

d. The maintenance person will complete the repairs on a scheduled priority basis. Maintenance service is not promised on weekends, nights, or holidays.

e. The tenants are responsible for replacing batteries in the smoke detectors and lightbulbs during the Lease.

12. GARBAGE The tenant is to remove from apartment and premises all garbage, rubbish, and other waste in a clean and safe manner and to place such in the receptacles provided. All household trash is to be bagged. All garbage, trash, littering, or defacing of the common areas of the premises shall be defined as those areas outside the tenant’s apartment.

13. ALTERATIONS The tenant shall not make any alterations or additions to the dwelling units or to the premises without written permission from Landlord. Such alterations include but are not limited to the installation of additional locks, painting of walls, doors, woodwork, hanging of wallpaper, etc. The tenants shall not clutter windowsills with items considered to “excessive” or “in poor taste”. Landlord reserves the right to determine the suitability so as to maintain the outward appearance of the community in the proper condition at all times.

14. AUTOMOTIVE

a. The tenants who wish to park on campus must purchase a Day Student sticker for their vehicle. You may register your vehicles at .

b. There are two reserved parking spaces per apartment. Tenants are not to park in a parking space with another number belonging to another apartment. There are ample unmarked parking spaces provided for guests.

c. No automotive repair or lubrication is permitted on the premises. No vehicles are to be washed on the premises. No boats, campers, trailers, buses, or other motorized vehicles are to be parked, kept, or stored on the premises. No vehicle will be parked on the premises that leak a large quantity of grease, oil, or other fluid. The vehicle must be repaired within forty-eight hours (48) after written notice of infraction from the landlord. The tenant will be responsible for all charges to clean up the grease, oil, etc.

d. The tenants shall not park or store inoperable and/or unlicensed/unregistered vehicles at the complex. Inoperable vehicles are defined as ones with flat tire(s), broken windshields, or exterior parts missing such as doors, hoods, or vehicles that cannot be driven under their own power. The violation of any rule concerning motorized vehicles will permit the landlord to have the offending vehicle towed from the premises at the vehicle owner’s expense. Generally, a 24 hour notice will be given before towing

15. THE TENANT COMPLAINT PROCEDURE. Landlord will only respond to the tenant’s written, dated, and signed complaints.

16. EMERGENCY PROCEDURE If there is an emergency, call John Brown University Campus Safety at 479-215-5000.

17. THE TENANT CERTIFICATION I/We certify that I/We have read, reviewed, and received a copy of the Rules and Regulations for Occupancy.
