Arkansas State Board of Education Regulations effective July 1, 1973, states that; “All pupils who are transported in a school bus shall be instructed in safe riding practices and shall participate in emergency evacuation procedures at least twice each school year.” Has this school district complied with the above regulation? Act 609 of 1989

“Arkansas Public School Choice Act of 1989"

“AN ACT TO ENABLE ANY PUPIL TO ATTEND A PUBLIC SCHOOL IN ARKANSAS IN A DISTRICT OTHER THAN THAT ONE IN WHICH THE PUPIL RESIDES, SUBJECT TO THE RESTRICTIONS AND CONDITIONS CONTAINED HEREIN; AND FOR OTHER PURPOSES.”

(Please note that only Section 8 that addresses transportation is presented below.)

SECTION 8. Transportation. The responsibility for transportation for a non-resident pupil shall be borne generally by the pupil. The resident district may transport the student to the district boundary or to a point agreeable to the parent or the non-resident district within either the resident or non-resident district and count that student in the resident district’s calculation for transportation funding. The non-resident district may provide transportation from the resident district’s boundary or from a point agreeable with the parent or the resident district within either the resident or non-resident district to a school in the non-resident district and count that student in the non-resident district’s calculation for transportation funding.

NOTE: The legislative intent behind this section was to give districts latitude in assisting parents/guardians with transportation by allowing the districts (either sending or receiving or both) to participate in the student’s transportation and count the student in the district’s transportation aid calculations. At the same time, no district is obligated to provide transportation under this Act; however, other state and federal statutes may require that transportation services be provided to certain categories of students as determined on an individual basis. Districts might note that districts boundaries can be crossed under this section.

Act 214 of 1991

“AN ACT TO PROVIDE THAT COUNTY LINES MAY BE CROSSED IN ORDER TO TRANSPORT STUDENTS FROM THEIR RESIDENT SCHOOL DISTRICTS TO A NON-RESIDENT SCHOOL DISTRICT; AND FOR OTHER PURPOSES.”

Be it enacted by the General Assembly of State of Arkansas.

SECTION 1. The responsibility for transportation for a student from his resident school district to a non-resident school district shall be borne, generally, by the student. The resident district may transport the student to the district boundary or to a point agreeable to the parent or the non-resident district within either the resident or non-resident district and count that student in the resident district’s calculation for transporting funding. The non-resident district may provide transportation from the resident district’s boundary or from a point agreeable with the parent or the resident district within either the resident or non-resident district to a school in the non-resident district and county that student in the non-resident district’s calculation for transportation funding.
