OFFICIAL PROCEEDINGS KINGSBURY COUNTY BOARD OF COUNTY COMMISSIONERS

The Kingsbury County Board of County Commissioners met Tuesday, January 8, 2013 at 8:30 AM in the County Commissioners meeting room in the Courthouse with Commissioners Nelson, Lee, Walls, Lembke and Jensen present.

OATH OF OFFICE

Gregg Gass, State’s Attorney met with the Board to swear in Roger Walls and Shelley Nelson as re-elected commissioners.

ORGANIZATION OF BOARD

Jensen moved and Lee seconded to appoint Nelson as Chairman of the Board for 2013. All present voting aye, motion carried.

The meeting was turned over to Chairman Nelson.

Jensen moved and Lembke seconded to nominate Lee as Vice-Chairman of the Board for 2013. All present voting aye, motion carried.

Jensen moved and Walls seconded to cast unanimous ballot for Nelson and Lee. All present voting aye, motion carried.

APPROVE AGENDA

Jensen moved and Lembke seconded to approve agenda as updated. All present voting aye, motion carried.

APPROVE MINUTES

Lee moved and Walls seconded to approve the minutes of the December 18, 2012 meeting as corrected. All present voting aye, motion carried.

EXECUTIVE SESSION

Lembke moved and Jensen seconded to adjourn from regular session and move into executive session at 8:44 AM for HIPPA purposes. All present voting aye, motion carried.

Walls moved and Lee seconded to adjourn from executive session and move back into regular session at 8:46 AM. All present voting aye, motion carried.

HIGHWAY

Dave Sorenson, Hwy Supt met with the Board to discuss highway matters.

Executive Session

Lembke moved and Walls seconded to adjourn from regular session and move into executive session at 9:11 AM for employee evaluations. All present voting aye, motion carried.

Jensen moved and Lee seconded to adjourn from executive session and move back into regular session at 10:00 AM. All present voting aye, motion carried.

BADGER DAIRY

Richard Vendrig met with the Board to let them know his plans for the proposed Badger Dairy. Vendrig’s previous CAFO permit expired but he would like to get a dairy started and wanted to know what he will have to do on the County level.

HOG CONFINEMENT IN CLARK COUNTY

Residents from LeSueur and Spirit Lake Township and the Willow Lake area met with the Board because they are concerned about a hog confinement that was permitted in Clark County but is located just across the county line. The residents are concerned about the confinement contaminating the water supply in Kingsbury County because it will sit close to or on the aquifer in that area. The Board listened to the concerns from the residents but took no action at this time.

Lee moved and Walls seconded to adjourn from regular session and move into executive session at 11:43 AM for litigation purposes. All present voting aye, motion carried.

Lee moved and Jensen seconded to adjourn from executive session and move back into regular session at 11:52 AM. All present voting aye, motion carried.

MILEAGE RATE

Lee moved and Walls seconded to keep the mileage rate at the state rate of .37 cents per mile. All present voting aye, motion carried.

OFFICIAL NEWSPAPERS

Lembke moved and Jensen seconded that the Arlington Sun, Lake Preston Times and De Smet News be designated as the official newspapers in the county for the year 2013. All present voting aye, motion carried.

ACCEPT BID

Lembke moved and Lee seconded to accept the bid from Hander Plumbing & Heating in the amount of $24,840 to repair the control valves in the ceilings of the Courthouse. All present voting aye, motion carried.

TRAVEL EXPENSES

Lee moved and Walls seconded to approve travel expenses for the Auditor to go to a TotalVote training in Mitchell on January 10 and the deputy Auditor to attend the training in Watertown on January 11. All present voting aye, motion carried.

MEMORANDUM WITH SDSU EXTENSION

Jensen moved and Walls seconded to approve the Memorandum of Understanding with SDSU Extension for 2013. All present voting aye, motion carried.

ABATE TAXES

Lee moved and Lembke seconded to abate the 2012 pay 2013 taxes in the amount of $25.61 on a mobile home of Lonnie Kruger’s that was moved several years ago. All present voting aye, motion carried.

OFFICE REPORTS

The Register of Deeds, Sheriffs and Director of Equalization office reports for the month of December were reviewed by the Board. Lee moved and Lembke seconded that the Auditor’s report with the Treasurer as of the close of business December 31, 2012 be accepted and placed in the Auditor’s office for review. All present voting aye, motion carried.
